Neii Merxloza Orient Fire District Board of Fire Commissioners November 8, 2006 Southold Town Planning Board PO Box 1179 Southold, NY 11971 Dear Board Members: In our letter dated January 2, 2005 to the Southold Town Planning Board, the Board of Fire Commissioners of the Orient Fire District stated that they reviewed the installation of the fire cistern on the Mendoza property at 38015 Orient, NY. (SCTM# 1000-15-2- 15.1). It was noted that the installation was completed and met the requirements of the Board of Fire Commissioners with the exception, it was not located as the Board had stated on the map. The Board would accept the fire cistern where it is installed; if the property owner would extend the gravel entrance road 50 feet passed the location of the fire cistern. This extension to be constructed using the same material as the main entrance roadbed. Please note that we also required that the roadway be at a minimum of 15 feet wide. As of this date the property owner as not compiled with the request of the Board of Fire Commissioners and that this fire cistern is still not accessible by fire emergency vehicles. The Board of Fire Commissioners is asking the Southold Town Planning Board if they would address this issue. While the Board has no object to location of the cistern, the gravel entrance extension was never completed and the cistern remains empty at this time. Please be advised that this is the third attempt by the Fire District to have you comply with their requirements. The Planning Board considers this a violation of your subdivision approval and unless we receive notification of your intent to complete the work, your approval will be nullified. In addition, we have informed the Building Department of this issue and have requested that no further building permits or certificates of occupancy be issued for either of the properties in your subdivision. It was noted that the installation was completed and met the requirements of the Board of Fire Commissioners with the exception, it was not located as the Board had stated on the map. The Board would accept the fire cistern where it is installed; if the property owner would extend the gravel entrance road 50 feet passed the location of the fire cistern. This extension to be constructed using the same material as the main entrance roadbed. Please note that we also required that the roadway be at a minimum of 15 feet wide. As of this date the property owner as not compiled with the request of the Board of Fire Commissioners and that this fire cistern is still not accessible by fire emergency vehicles. When bituminous concrete mixtures are required for lhe pavement replacement, the layers shall consist of uno or a combination of mixture types contained in Table 401-1, Composition of Bituminous Plant Mixtures in SecUoff 401 of the New York State Department of TraflsportaGon's Specification, including addenda. The mixture shall be placed at the proper temperature, without segregation, and compacted thoroughly. When portland cement concrete mixtures are required for pavement replacement, the mixtures shall consist of either Class C or Class F as contained in Table 501.3, Concrete Mixtures in SecUon 501 of the New York State Department of TransportaUon's Specifications, including addenda. Class F is a high early strength mixture and should be used when early opening to traffic is desired. The concrete mixtures shall be placed without segregation, then consolidated, finished to the proper elevation, and textured. Curing the concrele pavement shag be in accor- dance with one of the methods permitted in Section 502 pertaining to curing. Pavement shoulders, curbs, gutters and other incidental features shop be replaced in kind unless otherwise approved by the Regional Director or his representative. b, Temporary Pavement that is replaced temporarily may be paved with either a hot bituminous concrete mixture mentioned above or a cold bituminous patching mixture. The manhole frame shag be set flush with the surface of the roadway unless otherwise pefmilted by the Regional Director or his representative. D. MAINIENANCE AND PROTECTION OF TRAFFIC 1. Traffic is to be mainlamed at all limes during the progress of this work and adequate signs, barricades and bghts shall be provided in accordance with the provisions of Sub-chapter N of the N.Y.S. Department of Transportation's Manual of Uniform Traffic Control Devices. A maintenance and prolactiofl of traffic plan may be required. No lanes shag be closed without prior approval. 2. The applicant shall erect and maintain suitable barricades around all trenches while work is in progress for the protection of the public, and they shag be suitably lighted by yellow gghts at night. The work shag be carried on in such manner that not more than 100 feel of trench in earth remains open at end of day's work. 3. No pavement cuts are to be left unfilled over nighl, except in emergencies, and in such cases, adequate precautions must be exercised to protect traffic, Prior approval must be obtained to use steel plating. 4. No construction materials or equipment shall be left on the shoulders or pavement after working hours, nor shall any construction equipment or material be placed in any manner or location that wig obstruct highway or railroad warning signs. B. All open trench in the highway right of-way shall be barricaded. There shag be conspicuously displayed bright red flags no less than 24" x 24" attached to such barricades and illuminated at night with flashing yegow lights. If in the judgment of the representative of the Commissioner of Transportation, flagman are necessary, they shall he employed by the permittee and on duty at all times during the progress of the work so as to direct traffic and maintain yellow flashing lights, etc. G. Soft shoulder signs of adequate size, not less than 24" square, shall be erected and maintained on all backfill trenches within the shoulder area untd the backfill is thoroughly settled. These signs shall be located at the beginning of each section of work at intersections and at a distance not greater than 1000 feet apart. 7. NECESSITATED FUTURE WORK 1. The applicant agrees, that any present or future injury to or disturbance of the highway, its slopes or gutters, caused by placing mains and service pipe shag be repaired by the applicant at his own expense and in accordance wUh the requirements of the State Department of Transportation. 2. Thus, the Planning Board determined that our reqi~est to set-off 7.044 acres constituted a set-off from a previous a s~t-offthat is not authorized in the Subdivision Moratorium. Subdivision Moratorium - Appeal Appeai is hereby requested for the proposed 7.044-acre set-offon the basis that the previous creation of ~A-acre parcel described as SCTM # 1000-15-2-16 has caused extraordinary hardshi.'p to the applicant and that the granting of the variance or waiver would not adversely effect the purpose of the local law, the health, safety or welfare of the Town of Southold or any comprehensive planning being undertaken in the Town. Specifically, the creation of the ~A-acre lot occurred decades prior to the adoption of the Subdivision Moratorium thereby causing extraordinary hardship to the applicant. In addition, the applicant has offered to covenant the 7.044-acre parcel set-off from the 27- acre parcel existing today against further subdivision.
