The folloWing took place at a meeting of the Southold Town Planning Board on Monday,
February 14, 2005:
The following resolution was adopted:
WHEREAS, Amelia Mendoza is the owner of the property known and designated as
SCTM#1000-15-2-15.1, located n/o Main Road, Orient; and
WHEREAS, this proposal is to subdivide a 7.04 acre parcel (Lot 1 ) from a 26.69 acre
parcel (Lot 2) in Orient; and
WHEREAS, this application was classified as a set-off and exempt from the Local Law
re: Temporary Moratorium on the Processing, Review of, and making Decisions on the
applications for Major and Minor Subdivisions, and Special Use Permits and Site Plans
containing dwelling Unit(s) in the Town of Southold; and
WHEREAS, on February 10, 2004, the Southold Town Planning Board issued
conditional final approval for the proposed action and all conditions have been met;
therefore, be it
RESOLVED, that the Southold Town Planning Board grant final approval on the maps,
dated as revised October 7, 2003, and authorize the Chairperson to endorse the final
maps.

mylar maps, which were also endorsed by the Chairperson, must be picked up at this

WHEREAS, Amelia Mendozdis the owner of a certain parcel of real property described
in Schedule "A" annexed hereto ("overall parcel"); and
WHEREAS, a certain lot is being created from said overall parcel described in Schedule
annexeo hereto; and
WHEREAS, because the parcel described in Schedule "B" needs access to and from said
property to the Main Road, a right-of-way is bereby established, more particularly described in
Schedule "C" ("right-of-way").
NOW, THEREFORE, it is hereby declared that the following maintenance agreement
shall be established.
The owner of the parcel described in Schedule "B" shall be responsible for seventy-five
(75%) percent of the cost of the maintenance of said right-of-way in a passable condition
sufficient to allow emergency vehicles, delivbry vehicles, and private passenger vehicles to pass
to and from said property described in Schedule "B."
The owner of the remaining property shall be responsible for twenty-five (25%) percent
of the cost of the maintenance of said right-of-way in a passable condition sufficient to allow
emergency vehicles, delivery vehicles, and private passenger vehicles to pass to and from said
property described in Schedule "B."
The declarant does hereby covenant that any conveyance of the remaining parcel shall be
made subject to the right-of-way as well as the maintenance agreement contained herein.

Dear Board Members:
In our letter dated January 2, 2005 to the Southold Town Planning Board, the Board of
Fire Commissioners of the Orient Fire District stated that they reviewed the installation
of the fire cistern on the Mendoza property at 38015 Orient, NY. (SCTM# 1000-15-2-
15.1).
It was noted that the installation was completed and met the requirements of the Board of
Fire Commissioners with the exception, it was not located as the Board had stated on the
map. The Board would accept the fire cistern where it is installed; if the property owner
would extend the gravel entrance road 50 feet passed the location of the fire cistern. This
extension to be constructed using the same material as the main entrance roadbed. Please
note that we also required that the roadway be at a minimum of 15 feet wide.
As of this date the property owner as not compiled with the request of the Board of Fire
Commissioners and that this fire cistern is still not accessible by fire emergency vehicles.
The Board of Fire Commissioners is asking the Southold Town Planning Board if they
would address this issue.
If you have any question regarding this matter, please inform the Board of Fire
Commissioners.

Dear Ms. Mendoza:
Please be advised that the Planning Board has been informed by the Orient Fire District
in a letter dated October 23, 2007 (enclosed) that you have not yet complied with all of
the requirements as set forth by the Board of Fire Commissioners. While the Board has
no object to location of the cistern, the gravel entrance extension was never completed
and the cistern remains empty at this time.
Please be advised that this is the third attempt by the Fire District to have you comply
with their requirements. The Planning Board considers this a violation of your
subdivision approval and unless we receive notification of your intent to complete the
work, your approval will be nullified. In addition, we have informed the Building
Department of this issue and have requested that no further building permits or
certificates of occupancy be issued for either of the properties in your subdivision.

Fire Commissioners with the exception, it was not located as the Board had stated on the
map. The Board would accept the fire cistern where it is installed; if the property owner
would extend the gravel entrance road 50 feet passed the location of the fire cistern. This
extension to be constructed using the same material as the main entrance roadbed. Please
note that we also required that the roadway be at a minimum of 15 feet wide.
As of this date the property owner as not compiled with the request of the Board of Fire
Commissioners and that this fire cistern is still not accessible by fire emergency vehicles.
The Planning Board as not responded our letters of January 2, 2006 and November 8,
2006. The Board of Fire Commissioners is asking for a response addressing the stated
issue.

to the MENDOZA Application
Situate: 38015 Middle Road (C.R. 48fNorth Road); Orient; Town of Southold, NY

Concerning D. Informational Derails of the Environmental Assessment Form - Part I (Long Form)
Provide explanation of existing site use, occupancy, structures, sanitary flow,
water use; compare to proposed use, occupancy, structures, sanitary flow,
water use.
Subject property is currently improved in the northern section with a private
single family residence, garage and swimming pool. Subject improvements are
currently serviced by typical sanitary systems and a private well. The proposal to
Set-Offsubject property is to ultimately gain approval to construct a second
dwelling within the resultant southern lot (Lot 2), which would contain 19.6 acres,
and would be serviced by a typical sanitary system and private well comparable to
the existing utilities found within the resultant northern lot (Lot 1). Sanitary flow
will not exceed 300 gallons per day per lot.
Please note that this proposal for a Set-Offwill result in only two (2) lots and will
not be for the full fourteen (14) lots allowable within an A - C Zoning District, as
per the Town of Southold Zoning Code.

As you know, this Firm represents Amelia Mendoza who owns the
property referenced above. The approval for the subdivision expires on February
10, 2005.
Enclosed herewith please find the certified copy of the covenant barring
further subdivision of the waterfront parcel and the road maintenance agreement
in satisfaction of condition 2 and 4 of the approval resolution. I will be shortly be
submitting the required mylars and paper prints for signature and filing.
As discussed with your staff, you already have the Health Department
exemption for the subdivision. The exemption provided certifies that the Health
Department does not regulate this subdivision. I am informed that the Health
Department is not going to re-certify the exemption on your mylars because the
Health Department does not regulate the proposed action.
I am in receipt of correspondence from the Fire District. Please be
advised that the cistern was installed as per the in the location specified by the
Fire District. The area approved by the Fire District was staked out in the field by
a licensed land surveyor and the cistern was installed in that area. The
requirement to further widen the road to the north of the cistern is acceptable to
my client. However, we would resist you amending your own approval and
suggest that the widening of the northerly portion of the road simply be
implemented and that the Chief Building Inspector of the Town link the approval
of the widened road to the issuance of Certificate of Occupancy.
Please let me know if you require further discussion on this contents of
this correspondence.

1. Subbase
a. The suhbase course shag be a minimum of 12 inches thick unless otherwise approved. The material shag meet the requirements of current Department of Transportation

2. Pavement and Shoulders
a, Permanent
The replaced pavement shop be similar to the existing pavement in composition and texture. The selection of the materlaJ type and compesltofl shall be sub,act to the
approval of the Regional iilrector or his representative. The gmit of pavement replacement shall be such that the repraced pavement is supported by thoroughly compacted
subbase material and the pavement is restored to the proper grade, cross-slope and smoothness.
When bituminous concrete mixtures are required for lhe pavement replacement, the layers shall consist of uno or a combination of mixture types contained in Table 401-1,
Composition of Bituminous Plant Mixtures in SecUoff 401 of the New York State Department of TraflsportaGon's Specification, including addenda. The mixture shall be
placed at the proper temperature, without segregation, and compacted thoroughly.
When portland cement concrete mixtures are required for pavement replacement, the mixtures shall consist of either Class C or Class F as contained in Table 501.3, Concrete
Mixtures in SecUon 501 of the New York State Department of TransportaUon's Specifications, including addenda. Class F is a high early strength mixture and should be
used when early opening to traffic is desired.
The concrete mixtures shall be placed without segregation, then consolidated, finished to the proper elevation, and textured. Curing the concrele pavement shag be in accor-
dance with one of the methods permitted in Section 502 pertaining to curing.
Pavement shoulders, curbs, gutters and other incidental features shop be replaced in kind unless otherwise approved by the Regional Director or his representative.
b, Temporary
Pavement that is replaced temporarily may be paved with either a hot bituminous concrete mixture mentioned above or a cold bituminous patching mixture. When a cold
patching mixture is used it shall consist of aggregate and bituminous material proportioned and mixed in a bituminous mixing plant or rotating paddle shaft pugmdE Regardless
which patching mixture is used it shag be laid on a PrePared foundation and thoroughly compacted. Since co~d bituminous patching mixtures ate subiect to distortion by
traffic, the temporary patch shag be maintained to provide a smooth surface unto the pevemenl is permanently replaced.
3. Manholes
Manhole frames and covers shall have sufficient structural adequacy to support the roadway traffic. The type of manheJe frame and cover shall be approved by the Regional
Director or his representative. The manhole frame shag be set flush with the surface of the roadway unless otherwise pefmilted by the Regional Director or his representative.
D. MAINIENANCE AND PROTECTION OF TRAFFIC
1. Traffic is to be mainlamed at all limes during the progress of this work and adequate signs, barricades and bghts shall be provided in accordance with the provisions of Sub-chapter N
of the N.Y.S. Department of Transportation's Manual of Uniform Traffic Control Devices. A maintenance and prolactiofl of traffic plan may be required. No lanes shag be closed
without prior approval.
2. The applicant shall erect and maintain suitable barricades around all trenches while work is in progress for the protection of the public, and they shag be suitably lighted by
yellow gghts at night. The work shag be carried on in such manner that not more than 100 feel of trench in earth remains open at end of day's work.
3. No pavement cuts are to be left unfilled over nighl, except in emergencies, and in such cases, adequate precautions must be exercised to protect traffic, Prior approval must
be obtained to use steel plating.
4. No construction materials or equipment shall be left on the shoulders or pavement after working hours, nor shall any construction equipment or material be placed in any manner
or location that wig obstruct highway or railroad warning signs.
B. All open trench in the highway right of-way shall be barricaded. There shag be conspicuously displayed bright red flags no less than 24" x 24" attached to such barricades
and illuminated at night with flashing yegow lights. If in the judgment of the representative of the Commissioner of Transportation, flagman are necessary, they shall he employed
by the permittee and on duty at all times during the progress of the work so as to direct traffic and maintain yellow flashing lights, etc.
G. Soft shoulder signs of adequate size, not less than 24" square, shall be erected and maintained on all backfill trenches within the shoulder area untd the backfill is thoroughly
settled. These signs shall be located at the beginning of each section of work at intersections and at a distance not greater than 1000 feet apart.
7. During winter conditions highway shoulders shop be maintained free of obstructions which would interfere with snow removal and ice control.

F. NECESSITATED FUTURE WORK
1. The applicant agrees, that any present or future injury to or disturbance of the highway, its slopes or gutters, caused by placing mains and service pipe shag be repaired by
the applicant at his own expense and in accordance wUh the requirements of the State Department of Transportation.

1. All poles shall be set outside the ditch Ones so that lhe proper drainage of the highway wig not be interfered with. In case it is impracticable to set poles so as not to interfere
with the flow of water in the ditches, the shoulder, ditch and space around the poles shall be paved by the applicant to protect against wash.
2. There shag be no obstruction to private d veways, connecting highways or roads, paths or sidewalks.
3. In case it is found necessary to trim trees within the boundaries of the highway, the
owner must be secured before the poles are set and trees trimmed, least possible amount shag be done, and in all cases the consent of the abutting property
4. Poles shop be of sufficient length to provide a clearance of not Jess than eighteen feet between the wire and the crown of the highway, under the worst condtiOons of temperature

worst condition of lemperature and loading.

Submitted herewith please find five mylar copies and seven paper print
copies of the survey prepared by Joseph A. Ingegeno last dated October 7, 2003
for the subdivision referenced above. Each mylar and paper print have been
stamped and signed by the surveyor and engineer. I also attached a check
made payable to the Town of Southold in the amount of $5000.00 covering the
required park fee.
As evidenced by this and our prior submissions all conditions of approval
have been satisfied in this application. I am aware that the Orient Fire District is
requesting some additional clearing of the read north of the approved fire cistern.
I have discussed this request with my client who is amenable to further widening
the right of way. I suggest that the widening of the right of way be linked to a
condition of the Certificate of Occupancy (as is the curb cut permit) so that the
map can be signed and filed. This approval expires on February 10, 2005 and
thus it is important to me that the map be signed and filed by that date. In the
vent that that the signing of this map is delayed by you, I request further
extension of the approval.

Dear Mark Terry:
The Board of Fire Commissioners has reviewed the installation of the fire cistern
installed on the Mendoza property at 38015 Orient, NY. (SCTM# 1000-15-2-15.1).
The Chief's of the Fire Department recently inspected the installation~ It was noted that
the installation was completed and that it meets the requirements of the Board of Fire
Commissioner, with one exception, it was not located on the property where the Board of
Fire Commissioners had specified on the map.
The Board of Fire Commissioners will accept the fire cistern where it is located, if the
property owner will extend the gravel entrance road 50 feet passed the location of the fire
cistern. This extension to be constructed using the same material as the main entrance
roadbed. Please note that we also required that the roadway be at a minimum of 15 feet
wide.
If you have any question regarding this matter, please inform the Boafd~Of Fire

As you know, this Firm represents Amelia Mendoza who owns the
property referenced above. On February 10, 2004, we received approval from
you for 7.04 acre set-off (see enclosed) That approval required, among other
things, installation of a fire well, which was subsequently amended by the Orient
Fire District for a fire cistern. Please be advised that the required cistern has
been installed at the property in the location specified by the District. Enclosed
herewith please find photographs showing the installation and completion of the
fire cistern.
You will note that condition #3 required submission of a covenant
guaranteeing the installation of a fire well prior to issuance of a Certificate of
Occupancy for a single family dwelling on lot #2. Obviously, there would be no
need for a covenant to be filed relating to fire protection on this site. Thus, I
assume no such covenant is required.

This is in regard to the site plans for the referenced project which were submitted to us for
review.
Prior to an approval of the site's access and issuance of a New York State Highway Work
Permit, the following items must be addressed:
A driveway profile or on site elevations, including elevations at the State highway right-
of-way line, shall be shown on the plans to insure that all drainage is contained on site
since we do not permit runoff from property onto our State highways. Please provide this
information which was part of the site plan requirement checklist that we previously sent
to you.
It should be noted that this access is being reviewed and pending approval for residential
use only, which includes four (4) family units or less. Should development occur in
excess of that or should any commercial activity occur on site, the property owner is
required to submit plans and secure a Highway Work Permit for commercial and/or
subdivision street access to this site.
Any utility work proposed in State Highway right-of-way will require separate
application and submission of plans (installation details, restoration details and
Maintenance and Protection of Traffic plan - all referenced to NYSDOT specification
item numbers and the Manual of Uniform Traffic Control Devices) to our Riverhead
Maintenance facility. The applicant may contact Mr. Kevin Matthaei at (631)
727-1731 for further directions regarding Utility Highway Work Permit
(HWP)applications. The applicant should be made aware that utility HWP
issuance is subject to issuance of the HWP required for site work.

Site plan approval for highway work permit issuance is contingent upon our receipt of all of the
following items within six (6) months of the date of this letter and no further revisions are made
to the plans once we approve them.
Kindly submit four sets of the revised plans, permit fee and surety bond (sample enclosed). It is
also mandatory that protective liability insurance be provided by the permittee. This must be
accomplished by submitting a completed Perm 17, Certificate of Insurance, in accordance with
Option A (form enclosed), or by submitting the fee specified below to be covered under the
NYSDOT Blanket Policy. We have the Highway Work Permit Application on file. The
application, completed Perm 17 and the Surety Bond must be secured by the same party.
All checks issued to the State of New York must show a Federal Identification Number.

Dear Planning Board Members,
This Firm represents Amelia Mendoza in connection with the slip-off of a 7_+ acre
parcel at the property referenced above. Approval of the proposed split off is attached
hereto.
I note that condition #1 of the approval resolution calls for the installation of a fire
well. Please be advised that the fire district in. lieu of the fire well now requires a 10,000-
gallon cistern. In addition, it is inappropriate to require the filing of a covenant for fire
well or cistern, as such condition would be a condition of performance. Therefore, I
request that condition #3 be modified to require the bonding or installation of a cistern as
a condition of subdivision approval.
Condition #5 requires Health Department Approval or Exemption to be obtained.
I have discussed this matter with Mr. Trent of the Health Department who informs me
that the Planning Board and its staff are well aware that no approval from the Health
Department is required because the lots created exceed five acres in area. In any event, I
will be securing an exemption from the Health Department shortly and the exemption
will be forwarded to you. It is unusual and completely unnecessary that 3 mylars and 7
prints bearing the exemption stamp be submitted to you. Instead the final map should
bear the chairwoman's name and signature "Approved" and that the approved plat should
be filed with the County Clerk orthe Town Clerk. Accordingly, I request that condition
number 5 be modified to properly reflect the mechanics of completing a subdivision
review process with proper filing requirements.

The purpose of this correspondence is to confirm the substance and agreement
between the District and the applicant with respect to fire protection for the 2dot

and the applicant agrees to install a 10,000-gallon cistern west of the terminus of the
proposed 50' Right of Way. Enclosed herewith please find a copy of the'survey for the

In recent years, many states have employed access management as a major technique to address
conflicts between through traffic and that generated by developments. The goals of access
management are to limit the number of access points, separate conflict points and remove
turning traffic from through movements. New York State is utilizing this technique to minimize
impacts to State highways. We recommend, therefore, that cross access to this site be obtained
from adjacent properties. If this is not presently possible, it should be shown on the plans for
implementation as part of future redevelopment.

The following took place at a meeting of the Southold Town Planning Board on Monday,
February 9, 2004:
The public hearing was closed.
The following resolution was adopted:
WHEREAS, Amelia Mendoza is the owner of the property known and designated as
SCTM#1000-15-2-15.1, located n/o Main Road, Orient; and
WHEREAS, this proposal is to set off a 7.04 acre parcel (Lot 1 ) from a 26.69 acre parcel
(Lot 2) in Orient; and
WHEREAS, on January 12, 2004, the Southold Town Planning Board, acting under the
State Environmental Quality Review Act, performed an uncoordinated review of this
Unlisted Action. The Planning Board established itself as lead agency, and as lead
agency, made a determination of non-significance and granted a Negative Declaration;
and
WHEREAS, on January 12, 2004, the Southoid Town Planning Board issued conditional
sketch plan approval and all conditions have been met; and
WHEREAS, the Suffolk County Planning Commission issued no comment upon the
action as they feel it is a matter for local determination; therefore, be it

RESOLVED, that the Southold Town Planning Board grant conditional final approval on
the maps, dated as revised October 7, 2003, subject to the following conditions. These
conditions must be met within six (6) months of the resolution:
1. The submission of the $5,000.00 Park & Playground Fee.
The submission of a right-of-way maintenance agreement and, upon approval
by the Planning Board, the filing of the agreement with the Office of the
Suffolk County Clerk. The Liber and page number must be recorded upon the
map.
To satisfy the Orient Fire District's request for an electric fire well, the
Planning Board is requiring that the applicant file a covenant and restriction
mandating that, prior to the issuance of a building permit upon the residual
19.64 acre parcel, the specified fire well will be installed. The Planning Board
is also requiring that following the installation of the fire well, that the
operation is verified, in writing, by the Orient Fire District and submitted to this
office. Following approval of the covenant and restriction by the Planning
Board, the document must be filed with the Office of the Suffolk County Clerk
and, upon filing, the Liber and page number recorded upon the plat.
The filing of the offered covenant and restriction on Lot #1 with the Office of
the Suffolk County Clerk and, upon filing, the Liber and page number

Submission of 3 mylar and 7 paper plats with Suffolk County Department of

The Board of Fire Commissioners of the Orient Fire District reviewed the subdivision of
Mendoza, at Orient, Town of Southold, Suffolk Cotmty, New York. This was referred to
the Board of Fire Commissioners for their recommendations, as whether any fire wells
are needed.
The Board of Fire Commissioners recommends that fire well be installed. The fire well
shall be, 8" piping, capable of producing 500 GPM, with gravel packed 20' screen, with
standoffpiping for connection to fire equipment. An electric fire well may be required to
meet requirements stated. Location has been mark on the site plan/survey. It should be
located 1500 feet from the edge of the Main Road and 10 feet to the left of the shoulder
of the entrance road.

This proposal is to set off a 7.04 acre parcel (Lot 1 ) from a 19.64 acre parcel (Lot 2) in Orient
Reasons Supporting This Determination:
An Environmental Assessment Form has been submitted and reviewed. No sensitive features
exist on site.
The determination was based upon the following:
Lot I is improved with a single family residence. Proposed Lot 2 is currently improved
with a guest cottage. No substantial adverse change in existing air quality, ground or
surface water quality or quantity, traffic or noise levels; increase in solid waste

production; increase in potential for erosion, flooding, leaching or drainage problems are
expected to occur if the proposed action is implemented as planned. Note, however,
that the Department of Health approval has not issued a determination on the
application, therefore, the feasibility of a septic system and associated impacts (if any)
have not been fully evaluated.
The parcel consists of cleared areas and a large area comprised of early successional
pioneer vegetative communities in the south of the parcel. No removal or destruction of
large quantities of vegetation or fauna is expected to occur as a result of this action.
No substantial interference with the movement of any resident or migratory fish or
wildlife species; impacts on a significant habitat area; substantial adverse impacts on a
threatened or endangered species of animal or plant, or the habitat of such a species; or
other significant adverse impacts to natural resources will occur.
No Critical Environmental Area as designated pursuant to subdivision 617.14(g) is
contiguous with the parcel.
The proposed action is not in a siqnificant material conflict with a community's current
plans or goals as officially approved or adopted.
The proposed action will not impair the character or quality of important historical,
archaeological, architectural, or aesthetic resources or of existing community or
neighborhood character.
No major change in the use of either the quantity or type of energy will occur.
No creation of a hazard to human health is expected to occur.
The proposed action will not cause a substantial change in the use, or intensity of use,
of land including agricultural, open space or recreational resources, or in its capacity to
support existing uses.
Based upon such, no significant adverse impacts to the environment are expected to occur
should the project be implemented as planned.

This is to confirm the resolution reached by you during the Planning Board work
session of December 15, 2003 regarding the proposed set-off for the property referenced
above. During that meeting, you resolved to process the application as a set-off not a
minor subdivision and you have directed me to undertake the following:

Withdraw my previous request to the Town Board for hardship exemption
from the Town's moratorium on new subdivisions; and
(2)
Amend the previously proposed covenant at page 2 paragraph 2 to delete

The Planning Board at the December 15, 2003 worksession issued the following
comments regarding the above application:
The Planning Board ruled that the proposed action can proceed as a set-off
pending a voluntary agreement to extinguish development fights on Lot 1 is
reached.
2. The Planning Board has reviewed the draft C&R's submitted on December 15,
2003. The following changes are recommended:
a. Page 2, Paragraph 2; Omit the reference to the Planning Board and

This Firm represents Amelia Mendoza, who owns the 27-acre parcel referenced
above. Mrs. Mendoza proposes to set-off a 7.044 acre waterfront parcel from the 27-acre
parcel. Application is hereby made pursuant to Section 6 of Locai Law 13, "A Locai
Law in Relation to a Ninety-day Extension of the Temporary Moratorium on the
Processing and Review of, and making Decisions on applications for Major Subdivisions,
Minor Subdivisions and Speciai Exception Use Permits and Site Plans containing
Dwelling Unit(s) in the Town of Southold" ("Subdivision Moratorium").
Background
Application for set-off of a 7.044-acre parcel from a 27-acre parcel was made to
the Planning Board on September 18, 2003. The application was made subsequent to a
meeting with the Planning Board during which the Planning Board determined that such
set-off was exempt from the Town's Subdivision Moratorium. Subsequently, the
Planning Board determined that the proposed set-oft'was not exempt from the
Subdivision Moratorium because a ~A acre parcel described as SCTM # 1000-15-2-16
was once part of the parcel but separated by deed sometime in the late 1960's or early
1970's. Thus, the Planning Board determined that our reqi~est to set-off 7.044 acres
constituted a set-off from a previous a s~t-offthat is not authorized in the Subdivision
Moratorium.
Subdivision Moratorium - Appeal
Appeai is hereby requested for the proposed 7.044-acre set-offon the basis that
the previous creation of ~A-acre parcel described as SCTM # 1000-15-2-16 has caused
extraordinary hardshi.'p to the applicant and that the granting of the variance or waiver
would not adversely effect the purpose of the local law, the health, safety or welfare of
the Town of Southold or any comprehensive planning being undertaken in the Town.
Specifically, the creation of the ~A-acre lot occurred decades prior to the adoption of the
Subdivision Moratorium thereby causing extraordinary hardship to the applicant. In
addition, the applicant has offered to covenant the 7.044-acre parcel set-off from the 27-
acre parcel existing today against further subdivision. That is, because the 7.044 acre
parcel could not be further subdivided, no adverse effect to the health, safety and welfare
of the Town or its comprehensive planning being undertaken would occur as a result of
this Board granting a variance or waiver from the Subdivision Moratorium.

Consistent with the requirements of the Subdivision Moratorium, I attached the
following:

Copy of correspondence from Bennett Orlowsky, Jr., Chairman of
the Southold Planning Board dated October 15, 2003 to Bruce
Anderson rejecting the filed set-off application.
(2)
Seven copies of the survey prepared by Joseph A. Ingegno last
dated September 6, 2003 that shows the overall parcel and the
7.044-acre parcel to be set-off. The 7.044 acre parcel is designated
Lot 1 on the survey. Lot 1 could n¢~ be further subdivided as per
covenant.
(3)
Tax Map showing the overall property and the % acre parcel
(highlighted) that caused the hardship experienced by the
applicant.
(4)
Check made payable to the Town of Southold in the mount of
$250.00 covering the application fee for variance or waiver.
