We currently have it on the market for sale. On June 21, 1976, the Southold Town Planning Board approved the subdivision of property owned by Robert T. Bayley (Example 5). This subdivision included my lot. Within the subdivision, there is a proposed road "reserved for possible future dedication to the town of Southold". This road was first proposed April 7, 1976 in a letter to Mr. Bruer from a Muriel Brush, Secretary. The letter stated that, `This road should go from Middle Road, past the Long Island Lighting Company easement and fifty feet wide west to the land of Latham" (Example 1). The proposed road is again mentioned in a letter from Charles G. Lind, Chief Planner on August 9, 1976 (Example 3). His letter states that, "The proposed road as shown on the map should be required to provide access to Lot 3 and to prohibit access from Lot 4 to the country road." This is further clarified in a letter dated September 28, 19 76 (Example 4), which asserts: 1. A right-of-way is provided from Lot 3 to C.R. 27. 2. The map has been corrected to state that the ingress and egress to Middle Road, C.R. 27 has been restricted to right-of-way. The letter written on April 7th is the only one to mention the road extending along two sides of our property however does not state any specific purpose for this road to exist on Lot 3. All subsequent correspondences affirm that the proposed road is solely a right-of-way for our lot (Lot 3) exclusively through Lot 4 from C.R. 27. As the owners of Lot 3, now 59.-7-29.5, my husband and I propose that this right-of-way on our property is unneeded. Lot 3 remains the only land locked parcel in the subdivision and currently has access through Lot 4, as seen on the map dated May 1976 (Example 2). Furthermore, due to the subdivision's covenants and restrictions none of the lots may further be divided. We currently have it on the market for sale. On June 21, 1976, the Southold Town Planning Board approved the subdivision of property owned by Robert T. Bayley (Example 5). This subdivision included my lot. Within the subdivision, there is a proposed road "reserved for possible future dedication to the town of Southold". This road was first proposed April 7, 1976 in a letter to Mr. Bruer from a Muriel Brush, Secretary. The letter stated that, `This road should go from Middle Road, past the Long Island Lighting Company easement and fifty feet wide west to the land of Latham" (Example 1). The proposed road is again mentioned in a letter from Charles G. Lind, Chief Planner on August 9, 1976 (Example 3). His letter states that, "The proposed road as shown on the map should be required to provide access to Lot 3 and to prohibit access from Lot 4 to the country road." This is further clarified in a letter dated September 28, 1976 (Example 4), which asserts: 1. A right-of-way is provided from Lot 3 to C.R. 27. 2. The map has been corrected to state that the ingress and egress to Middle Road, C.R. 27 has been restricted to right-of-way. The letter written on April 7th is the only one to mention the road extending along two sides of our property however does not state any specific purpose for this road to exist on Lot 3. All subsequent correspondences affirm that the proposed road is solely a right-of-way for our lot (Lot 3) exclusively through Lot 4 from C.R. 27. As the owners of Lot 3, now 59.-7-29.5, my husband and I propose that this right-of-way on our property is unneeded. Lot 3 remains the only land locked parcel in the subdivision and currently has access through Lot 4, as seen on the map dated May 1976 (Example 2). Furthermore, due to the subdivision's covenants and restrictions none of the lots may further be divided. This means no further land locked parcels may be created in this subdivision, which would then require a right-of-way. My husband and I are requesting that this reserved road be removed in its entirety from our deed and title. The reserved road's only intended purpose was to provide the owners of Lot 3 with access to their lot. Since access is already provided through Lot 4, the reserved road on Lot 3 is extraneous.
