DECLARATION made this 7th day of May, 1986, by
CECIL T. YOUNG, residing at (no #) Main Road, Laurel, NY
11948, hereinafter referred to as the "Declarant";
WHEREAS, the Declarant is the owner in fee simple
of
Main Road (N.Y.S. Route 25),
County of Suffolk, New York,
deed dated December 7, 1940,
a certain parcel of land situate on the north side of
Laurel, Town of Southold,
being the premises described in
recorded in the Suffolk County
Clerk's Office in Liber 2150 at page 305, a metes and bounds
description of which is shown on Schedule A attached hereto
and made a part hereof, hereinafter referred to as the
"premises".
WHEREAS, the Declarant intends to subdivide said
)remises into lots for residential purposes and desires to
~ubJect said premises to certain conditions, covenants and
restrictions.
NOW, THEREFORE, the Declarant does hereby declare
that the aforesaid premises and every portion thereof is
hereby held and shall be conveyed subject to the conditions,
covenants and restrictions hereinafter set forth, and that
every purchaser of said premises or any portion thereof, by
the acceptance of a deed thereto, covenants and agrees that
the premises so purchased shall be held subject to the
covenants, conditions, and restrictions hereinafter set
forth.
Neither of the lots in the
aforesaid subdivision shall be further subdivided or its lot
lines changed in any manner at any future date without the
approval of the Planning Board of the Town of Southold.

ARTICLE V: All stormwater runoff resulting
from the development and improvement of this subdivision or
any of its lots shall be retained on the site by adequate
drainage structures so that it will not flow onto the right-
of-way of Main Road.
ARTIC~VI: No sanitary disposal facility shall

insure that no development adverse to the aesthetic quality
of the shoreline will take place adjacent to these features.
The conservation or scenic easement shall also cover the
wetland areas within the property as well as the abutting 50
feet of upland.

Dear Mr. Orlowski:
The Suffolk County Planning Commission at its regular meeting on April 2,
1986, reviewed the proposed subdivision plat, entitled, "Minor Subdivision -
Cecil T. Young", referred to it pursuant to Section 1333 of the Suffolk County
Charter. After due study and deliberation it resolved to approve said map
subject to the following ten conditions deemed necessary to help preserve the
traffic safety and carrying capacity of Main Road, a state road, and to help
preserve the natural and aesthetic attributes of the shoreline of Laurel Lake
and the freshwater wetlands adjacent thereto.
No lot shall be subdivided or its lot lines changed in any manner at
any future date unless authorized by the Town of Southold Planning
Board.
Since this tract has the potential to be further subdivided, any
subdivision of any part of this tract in the future shall have a
map of the subdivision filed in the office of the County Clerk.
All new or reconstructed driveways on Main Road shall make an angle of
at least 70° and preferably 90° with the Main road.
All new or reconstructed driveways on Main Road shall have a

majority plus one of the Town Board of the Town of Southold after a
public hearing. Adjoining property owners shall be entitled to notice
of such public hearing but their consent to such modification shall
not be required.
The Comission also offers the following coments on the map for your use
and consideration:
It is suggested that before approval is granted to this subdivision
that the subdivider be required to submit this proposal to the Suffolk
County Department of Health Services for review to insure that the
proposed subdivision will meet the requirements and standards of that
agency.
It has been noted that the freshwater wetlands within the parcel are
not indicated on the map. It would be helpful in our review if the
proposed subdivision map would be complete in the information about
the subdivision.
Conditional approval of this subdivision does not in any way imply
approval of the layout of any future subdivision of this tract that
may presently be under consideration.
The map of this minor subdivision should be filed in the office of the
County Clerk. This is to insure the validity of the subdivision map
and that the subdivision map will be available to the general public
in a central office of official records.

The Health Department's primary environmental concern pertaining
to development is that the applicant comply with the requirements of the
Suffolk County Sanitary Code especially Article V and VI, and relevant
construction standards for water supply and sanitary sewage disposal.
These considerations are to be reviewed completely at the time of
application. Full consideration in placement of water supply wells
and disposal systems is given to state and town wetland requirements.
The Health Department maintains jurisdiction over final location of
disposal and well systems and the applicant should not undertake to
construct any water supply or disposal system without Health Department
approval.
Other portions of the Suffolk County Sanitary Code also apply to
conmmrcial development such as Article XII. The Lead Agency is requested
to forward a copy of this form to the applicant with its findings.
