(631)765-1809•Fax(631) 765-9064 JA 4 2006 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF DECEMBER 1, 2005 Sout old Town Clerk ZB Ref. 5786—Alexander Sznurkowski Property Location: 710 West Shore Drive, Southold CTM 80-1-46.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 10,890 square foot parcel has only 19 feet along West Shore Drive, widening to 91.94 feet along Southold Bay. The property is improved with a two-story frame house, shown on the August 18, 2005 survey prepared by John C. Ehlers. BASIS OF APPLICATION: Building Department's July 21, 2005 Notice of Disapproval, citing Section 100-244 in its denial of an application for a building permit to construct a proposed addition and alterations to the existing dwelling for the reasons that the total side yards will be less than the code requirement, proposing 12.9 feet, and the lot coverage will exceed 20%, proposing 21+- percent. On September 14, 2005, the Building Inspector reviewed a surveyor map requested by the Zoning Board of Appeals certifying the size and setbacks of the proposed construction, and issued an amended Notice of Disapproval citing the proposed setback of the new garage addition at less than 10 feet on a single side yard, proposing eight (8) feet. The total side yards will result in a nonconformity of 10.5 feet instead of the code-required 25 feet. The reason pertaining to the lot coverage was removed since the surveyor certified the total calculation at 15.6% instead of 21+-percent. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on November 17, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to construct a 23'x16' garage addition at the southeast corner of his dwelling, resulting in a reduced setback, presently 22 feet, to a minimum of 8 feet, to the side property line. The height of the new addition is shown on the 6/29/05 construction diagrams at 14'2" to the top of the ridge. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Sznurkowski CTM 80-1-46.1 at the building line, and the property is very narrow with only 19 feet along the front property line along West Shore Drive. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance due to the shape and size of this waterfront property of 10,890 square feet. 3. The variance granted herein is substantial and is the maximum that the Board will approve. The remaining side yard must remain open and unobstructed for access purposes between the road and the bayfront. 4. The difficulty has not been self-created and is related to the configuration of the property and layout of the dwelling on the property. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a garage addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Chairwoman Oliva, and duly carried, to GRANT the variance as applied for, as shown on the August 18, 2005 survey prepared by John C. Ehlers and 6/29/05 construction diagrams prepared by Penny Lumber, subject to the following condition: That this easterly side yard shall remain open and unobstructed for the purposes of access between the road and the waterfront side. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Additionally,the house which was formerly my permanent resident has been sold in order to make my home on West Shore Drive my current permanent residence. It is of the utmost importance to me to protect the health, safety and welfare of this community and it is my interest to preserve and protect the character of the neighborhood of Reydon Shores, as this will be my home for the latter part of my life.
