(631)765-1809 •Fax(631) 765-9064 "et 64E2407ca - FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF DECEMBER 27, 2005 Sovfhad Fc,.n Clerk ZB File No. 5798— ROY RODRIGUEZ Property Location: 975 Hillcrest Drive North, Orient CTM 13-2-8.21 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 1.5655 acre parcel has 150 feet Hill Crest North Drive and is improved with a new two-story home, situated as shown on the January 20, 2004 survey prepared by Young & Young, amended November 4, 2004, and October 12, 2005 site plan prepared by Fairweather-Brown Design Associates. BASIS OF APPLICATION: Building Department's August 28, 2005 Notice of Disapproval, citing Section 100- 33 in its denial of an application for a building permit to construct a swimming pool, for the reason that the new construction will be located (partly) in a side yard, instead of the code-required rear yard or required front yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on December 15, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct a 20'x40' swimming pool approximately 13 feet from the west side of the existing house, in the northwesterly yard area 15 feet from the westerly side lot line, more than 65 feet from the front property line adjacent to the street, and at least 100 feet from the top of the bluff adjacent to the Long Island Sound. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. At least 688 square feet of the proposed swimming pool is in a conforming rear yard area behind the home,with the remaining 112 square feet requiring relief because it is located on the side of the house. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The pool is proposed located 100 feet from the top of the bluff adjacent to the Long Island Sound, and moving the pool further north or south would require greater variances. The difficulty has been self-created 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Orlando, and duly carried, to GRANT the variance as applied for, as shown on the October 12, 2005 site plan prepared by Fairweather-Brown Design Associates, subject to the condition that there be no structural enclosure or roof construction. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Since the"Notice of Hearing"sign posted at the property in mention listed the pool as the structure requiring a variance,the second half of this letter specifically addresses the pool installation. It appears that the site was cleared and fill was placed on site to provide a level grade for the construction of the house, As indicated on the site plan,a two-story house has been constructed at this location and some landscaping plantings have been installed(photo 7). A stone retaining wall notidentified on the site plan map is shoring up the filled area and is located on the northwestern side of the property just off the house(photo 2,4). A swimming pool and the driveway indicated on the site plan have both yet to be installed(photo 1,3). The greatest concern with this site is the dose proximity of the house and pool to the bluff and the threats that such construction may have on the bluff stability.As you are aware,bluffs are dynat is environments that are easily compromised by both natural forces (storms)and human impacts. The concern with bluff protection is compounded as the house and pool are sited within a natural drainage way leading to the bluff. The top of the bluff(directly north of the house)is in stabile condition,as an approxhttately 100 foot of forested area exists between the back lawn and the bluff. The face of the bluff was not investigated due to inaccessibility.This vegetation on the top of the bluff is serving to stabilize the bluff and also as buffer, protecting the bluff from runoff and human activities. Therefore,it is critical than,this are remains in its natural state and is not cleared or disturbed by any means (i.e.removing trees to improve the view) (Photo 1,3). . As shown on the topographic map provided, all the water from this site, including the landscaped areas, is directed to this ravine. The main concern is the impermeable surfaces on this site have been increased significantly because of the clearing and installation of this and neighboring houses, the pool and structural landscaping activities. Therefore, the amount of runoff at this site has increased substantially and has the potential to cause,serve gully and bluff erosion due to the increase in water quantity and magnified by the slope of the this area. Such erosion could ultimately compromise the retaining wall, the house stability and increase sedimentation into the Long Island Sound. The following are the recommendations for insuring bluff protection and thereby ensuring the house and proposed pool are not structurally compromised. The first recommendation is that the house should be fitted with the gutters, down spouts and drywells. In an effort to decrease impermeable surfaces, the driveway should'he covered with a surface such as permeable pavers, pebbles, crushed rock or shells rather than asphalt. This will allow water to percolate into the ground thereby compensating for runoff caused by an increase in impermeable areas on the property. Although not completely installed,corrugated black plastic pipes found in the retaining wall appear to function as a conduit to discharge runoff(or pool water),which collects above the retaining wall, and convey it into the ravine (photo 2,4). It is advised that the true purpose of these pipes be determined,as the above-mentioned use would also initiate erosion of the ravine. Dry wells installed both along the grassed area just east of the house and at the top of the retaining wall, are the recommended means to deal with the runoff water..This will allow the water to be discharged directly into the ground rather than directed into the ravine (via black piping) where erosion may occur. The locations of these dry wells are indicated on photo 4&�. As nutrient loading is a concern within Long Island Sound, we recommend that any landscaping activities use native plantings. Beach plum, Bayberry, Beach pea, Seaside Goldenrod, Cape American Beach grass, and Red Cedar are examples of x-ative Long Island plants appropriate for this site. As these plants are able to tolerate the harsh climate of Long Island,limited additions of nutrients,pesticides,and water will be needed in order for these plants to thrive. Thus, Long Island Sound will not be impacted by the choice of landscaping selected for this property. Finally,the following are the recommendations to ensure that bluff damage does not occur from the installation and the maintenance of die pool. First, as the top of the bluff is wooded and appears in stable condition, the installation of the pool seems feasible. This. is as long as the pool is to be installed to the west of the house in the area already cleared and flagged. No additional clearing of the site should occur especially between the current lawn area and the bluff on the north and east side of the property in order to facilitate the installation of the pool. As discussed above, the forest is serving to protect the bluff and subsequently the pool from erosion. Any removal or Bearing of this area would 02 . The water from the pool should not be discharged directly on the ground, over the bluff face, or into the ravine via piping to the east of this property. Such an extremes amount of water would damage the bluff face and may initiate erosion ill)the ravine. The best means to dispose of this water is through direct discharge into the ground. However, the test pit revealed that the surface soils are a 9-foot silty sand soil layer with an underlying 19-foot thick day layer. Therefore,an in ground drain would need to be installed to a depth of 48 feet to sand to properly allow the pool water to drain way and not outlet through on the bluff face when it hits the impermeable clay Iayer. Lastly and equally important,similar concerns with the clay layer are raised in regard to the proper installation of the septic systems. A septic system installed above or in a clay layer will cause system failure due to ponding,improper treatment and possibly blufflerosion, as it is an impermeable layer of soil. The septic system should be investigated to ensure Suffolk County Department of Health Standards are met and that the septic system was installed in pure sand.
