Martin Property Location: 1695 Meadow Beach Lane, Mattituck CTM 116-4-31 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' 3.69 acre parcel is located at the end of a private right-of-way known as Meadow Beach Lane, Mattituck, and is improved with a single-family, 1-1/2 story frame house with detached swimming pool and two small sheds, shown on the May 21, 2002 survey prepared by John C. Ehlers, L.S. BASIS OF APPLICATION: Building Department's May 25, 2005 Notice of Disapproval, amended June 10, 2005, concerning the construction of a citing Section 100-33 in its denial of an application for a building permit to construct a proposed tennis court with fence enclosure, shown on the 5/6/04 site plan. The reasons stated by the Building Inspector in his denial are that the tennis court fence enclosure will exceed the four foot height limitation when located in the front yard of this residential zone, and that the tennis court is proposed less than the code-required 60 feet from the front yard lot line and less than 20 feet from the side yard lot line. SEPARATE APPEAL NO. 5794/AMENDED APPLICATION BY APPLICANTS: On September 21, 2005 documentation was added for amended, additional relief for the location of an as-built accessory shed located in the easterly front yard at less than 60 feet from the front yard lot line, for enlargement of the same shed, and for a partially sunken hot tub and trellis accessory structures. This amendment will require the applicants to complete separate mailings with notices under Chapter 58, as well as separately notice for a public hearing and decision. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 20, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: Page 2—October 27, 2005 • ZB File Ref.5742—J. and D. Marti CTM 116-4-31 AREA VARIANCES REQUESTED: The applicants wish to construct a sunken 54' by 112' tennis court at a minimum of 60 feet from the northerly front yard lot line and a minimum of 10 feet from the westerly lot line, at its closest points. The tennis court will be 24 inches below grade with low stone retaining walls, 24 inches above grade surrounding the court, and with a 6 ft. high fence on wood frame with screening is also proposed. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicants are proposing to locate a tennis court in the northwesterly portion of their property, mainly in the front yard and partly along the side of the existing dwelling. Maps A, B and C with different setbacks were discussed during the hearings with regard to a tennis court location. Option C with more conformity to the setback requirements is the maximum the Board will approve, with setbacks at a minimum of 60 feet from the front lot line at the northwestern section of the property and 10 feet from the side line, instead of 30 feet and 5 feet, respectively, and with the surface of the court finished with a rubber-like adhesive (such as deco or the like), applied as the finished top coat over a hard surface, such as cement or asphalt. 2. The benefit with regard to the tennis court will be sought by the applicants with alternative Option C, which will place the tennis court in a more conforming location and which will be constructed of a rubber-type composite to reduce the noise effects by players when hitting the tennis balls against the base of the court. Landscaping with trees will provide a main buffer between the tennis court and adjacent properties to the north and north/east. 3. The variances granted are substantial. 4. The difficulty is self-created since accessory structures may be placed in the rear yard adjacent to the waterfront side of the house without a variance. 5. Grant of relief, as modified, is the minimum action necessary and adequate to enable the applicants to enjoy the benefit of a sunken tennis court with 6 ft. high fence, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Chairwoman Oliva, and duly carried, to GRANT the variances as applied for, subject to the following Conditions: 1) That the tennis court shall be located at the west side of the dwelling, in the northwesterly yard portion of the property, set back not closer than 60 feet from the northerly front lot line and not closer than 10 feet from the westerly lot line, shown on the map labeled "C" of 10/19/05; • Page 3—October 27, 2005 ZB File Ref.5742—J. and D. Marti • CTM 116-4-31 2) That the tennis court shall be enclosed on three sides, by mature evergreen plantings, continuously maintained at a minimum height of 6 feet, and additional screening with landscaping shown on the "enlarged site plan Sheet#2 dated 9/14/05"; 3) That the surface of the tennis court shall be finished with a rubber-like composite material applied over a hard surface such as cement or asphalt; 4) That there be no lighting for use after dark; 5) The fence enclosure shall not exceed six feet in height. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : 1 . No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. The owner wishes to construct a tennis court on the property. The best location is in the proposed location because the fence will not obstruct the views of the waterfront, and the tennis court surface will not interfere with an existing water easement . The proposed location of the tennis court is the optimal location, according to the neighbor Alma Suter, the former owners had located a tennis court in the same location. The neighbor had no objection to the placement of the tennis court along the front/side of the house. The tennis court will be located 10 feet from the property line. The property has mature vegetation and a wood fence as well as the 8 ' proposed tennis court fence to keep the balls from traveling beyond the property line. 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance. The tennis court is only practical in the proposed location, with adequate setbacks from the existing house, the 30 ' right-of-way which is an access driveway for the neighbor. A tennis court would not be appropriate in the rear yard because it would have to be placed close to the Bay and block the waterfront views of the residence. 3 . The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance. The shed was placed on the property by prior owners- the Martin family uses the shed for storage. It is very useful in it' s present location because it stores the pool accessories and lawn furniture. 3 . The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance. The shed does not interfere with the use of the right of way and is smaller than the existing fence around the pool . 4 . The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district . The shed is less than 200 square feet and has no adverse impact on the environment 5 . The alleged difficulty was not self-created. The prior owner placed the shed in its present location, the Martins were not aware that the location violated the zoning code. 6 . We will submit a separate application for the proposed trellis 06 � in the "side yard" if the Board believes it is necessary. It appeared to us (Architect and me) that there are two reasons why the trellis does not require a variance: 1 . the trellis is in the rear yard since it is behind the existing building 2 . we are seeking a variance for the existing shed which is east of the trellis . If the trellis where an existing structure the distance of the shed (closest structure) to the right of way would be reviewed by the Board. With regard to the Tennis Court: the Architect has provided the enclosed plans which also provide on page two an extensive _ landscape plan. In addition the tennis court will be dropped down 24" below existing grade, with a retaining wall and a planted hedge added to block the view and muffle the sound of the tennis court. We live at 1635 Meadow Beach Lane, across the street from the Martin property. Our position is very simple-- we feel that the proposed tennis court would be better situated in the backyard of the Martin property and not the front . We feel that the granting of the variance will be a detriment to our quality of life and possibly, effect the value of our property. The part of our house that is closest to the proposed tennis court is our bedroom. According to the site plan, the un screened side of the court will be in a direct sight line of our bedroom and the sights and sounds of a tennis court are undesirable to us and could be considered a nuisance. As to Ms. Patricia Moore's statement in the application for the variances, the proposed location for the court is "the optimal" one. That indeed may be true from her clients point of view but not ours. The Town Zoning Code discourages, if not outright prohibits, tennis courts and swimming pools in front yards for obvious reasons. Tennis courts require eight foot fences that are not allowed in front yards. We are aware that waterfront properties are granted exceptions because of regulations imposed by agencies protecting wetlands that would not allow a tennis court to be built in a rear yard. After viewing the map of the Martin property, this exception does not seem to apply. There appears to be ample property on a side yard and rear yard to build a tennis court. Variances might be necessary to meet side setbacks, but the court would not be in view from the street. Our last comment concerns Ms. Moore's conversation with Mrs. Alma Suter who is the adjoining property owner. In the application, Ms. Moore says that Mrs. Suter told her that "the former owners had located a tennis court in the same location." Ms. Suter's recollection of a tennis court in the proposed location is not borne out by Town records. There are no records in the Town Assessor's Office nor the Town Building Department of a tennis court having been taxed or even built by the previous owners of the Martin property. My husband and I hope that in fairness to those property owners who will be negatively impacted that the Zoning Board of Appeals will deny the Martins' request for a variance for a front yard tennis court. Our association, comprising 38 homeowners and lot owners, owns Meadow Beach Lane and other streets in the Harbor View at Mattituck subdivision. The Martin property borders on Meadow Beach Lane on which they have deeded access. The Martin property and four other properties south of our subdivision are not included in the association as their properties predate the subdivision. However, as their property, as well as our subdivision, is in the area called "Harbor Farm"and these properties appear to be part of our subdivision. Therefore, we feel that we have a vested interest in the overall appearance and tranquility of Harbor Farm. Our Association has Covenants and Restrictions and Architectural Guidelines that allow the Homeowner's Association Board of Directors to protect the properties and require the owners to maintain their homes and properties in a manner that preserves the overall appearance of Harbor Farm. The board has the authority to approve the architecture of the homes, landscaping, driveways, fences, swimming pools and tennis courts among other things. On September 17, 2005, the Board of Directors of the Bayview at Mattituck Homeowner's Association met and voted to oppose the zoning variance application which would allow the Martins to construct a tennis court in their front yard. The board felt that a tennis court in the front yard would be a detriment to the appearance of the community and would be a nuisance because it will be in the view of the adjacent neighbors (i.e. Strode, Eckert, and Amper/Lee) as well as from Meadow Beach Lane, and the noise will also be heard by them as well as other neighbors. The Board of Directors feels that it would be more appropriate in the back yard, where, in this case, there is ample space without impinging on setbacks and wetlands. My remarks are presented on behalf of myself and Mr. Joseph Lee (who could not be here today). We live at 1645 Meadow Beach Lane, directly across a shared 20' wide right of way from Jim and Denise Martin's front yard. From our front windows we would have an unobstructed view of the tennis court they are proposing, and the prospect has filled us with dismay. Eight and a half years ago,when we were searching for a home on the North Fork,we looked at a house on James Creek.It was by far a much nicer house than the one we ultimately purchased next door to the Martins.Unfortunately, the view from the house was,to our thinking,unacceptable,for directly across the creek from the house was a tennis court,which is why we rejected that property. When we discussed our rationale with the realtor,he agreed that it was a definite drawback, one that had discouraged several other prospective buyers. Now, should this'variance be approved, we will find ourselves looking out our windows at a tennis court--and this one will be located much closer to our house than the one across from the house on James Creek.We are, as you might imagine, disheartened by the irony of the situation, and hopeful that the Martins will reconsider and shift the location of the tennis court to their back yard or their western side yard.It seems to us that there is ample room in the back yard to position the tennis court--well beyond the 100'wetland setback required. Ms.Moore indicated in her letter outlining the reasons for the Appeal, that there would be no "detriment to nearby properties if the variance is granted." Based on the comments made by our realtor about homebuyers' reluctance to live opposite a tennis court,we worry that the proposed tennis court will impact negatively on the resale potential of our house. Ms.Moore also writes that the proposed location is "the best location" because, "the fence will not obstruct the views of the waterfront."This is true, and I can certainly empathize with the Martins for not wanting to mar their fabulous view with any man-made structure. While we do not have the Martin's enviable unobstructed view of Peconic Bay, we did enjoy a lovely scenic vista from our front windows--sweeping lawns, towering trees,mature landscaping, a small vineyard--truly a bucolic setting and one of the main reasons we bought the house in May 1998.In the course of the recent construction,some of those trees and shrubs have been moved or cut down and the vineyard was removed,but the view remains lovely. Ms. Moore writes that the proposed location of the tennis court"is the optimal location, according to the neighbor Alma Suter. . . [who] had no objection to the placement of the tennis court along the front side of the house."Since Mrs. Suter's house is located to the southwest of the back of the Martin residence,well out of sight (and sound) of the proposed location,we can certainly understand her lack of objection. However, the proposed location is not optimal from our viewpoint.The proposed tennis court is to be fenced and screened with mature vegetation on three sides. (The one un-fenced,un-screened side faces our house). But even additional landscaping to hide the court from our view offers no permanent guarantee. The Martins or subsequent owners of their property can remove any and all landscaping at any time. Incidentally, Ms.Moore indicates that according to Mrs. Suter, the former owners had located a tennis court in the same location. We were unable to confirm this. The Building Department has no record of a permit for a tennis court on this property in their files,which date back to 1957. On the chance that the former owners had indeed erected a tennis court without an official permit, we checked with the tax assessor's office. They have no record of any tennis court on the property since they began keeping records on May 11, 1960. (All they have is a permit request from the Martins dated 3/23/04, status pending.) Their records indicate that the property was inventoried in 1962 and showed no tennis court at that time. In 1982 the former owners applied for and were granted a permit for an in-ground swimming pool (#11605).Accompanying their application was a survey dated July 1972,again, showing no tennis court on the property. A couple of minor points. In Ms.Moore's letter outlining the reasons for the appeal, there are a couple of factual errors. In paragraph three, she writes, "the actual public street is Meadow lane . . ." The street she is referring to is Meadow Beach Lane, and it is a private road, owned and maintained by the Bayview at Mattituck Homeowners Association. (The Martins, and the other four houses located at the southern end of Meadow Beach Lane have deeded right of way along Meadow Beach Lane from New Suffolk Avenue.) Thank you for your attention. The premises in question contains an area of approximately four acres and constructed thereon is a large , one-family dwelling with attached garage , and separate accessory building generally north of the garage area. It is the feeling of this board that the circumstances are quite unique, particularly due to the location of a right-of-way commencing at the northerly end of the premises in question and extending southeasterly and southerly the entire depth of the parcel. It is the opinion of this board that the most practical and feasible area in which to locate the swimmingpool is in the area depicted by the applicant and which area is located to the rear of applicant's house. In considering this appeal, the board determines that the variance request is not substantial in relation to the code requirements; that the circumstances herein are unique and the practical difficulties have been shown; that by allowing the variance no substantial detriment to adjoining properties would be created; that the difficulty cannot be obviated by a method , feasible to appellant, other than a variance; that no adverse effects will be produced on avail- able governmental facilities of any increased population; that the relief requested will be in harmony with and promote the general purposes of zoning; and that the interests of justice will be served by allowing the variance.
