(631) 765-1809 • Fax (631) 765-9064 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF DECEMBER 27. 2005 S a d wn lerk ZBA #5811 (Waiver to Unmerge 12.3 from 12.2); ZBA #5812 (Setback for 12.3) - Nancy Righi, Anna Hommel Property Location: East Side of Camp Mineola Road, Mattituck CTM No. 123-6-12.3 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' property as merged contains a total area of 28,400+- square feet with 100 feet along a private right-of-way to the north and 300 feet along Camp Mineola Road. Only the northerly half of the property is improved with a single-family home, constructed in 1976. BASIS OF APPLICATION: Building Department's October 13, 2005 Notice of Disapproval, citing Sections 100-25 and 100-244, in its denial of an application for a building permit to construct a single-family dwelling on the southerly portion of applicant's property, referred to as CTM #123-6-12.3. The reasons stated by the Building Inspector in the denial are that the subject lot (12.3) has merged with an adjacent lot to the north (123-6-12.2) pursuant to Article 11, Section 100-25. In addition, it is noted that the location of the new dwelling is not permitted, if the waiver of merger is granted, for the reason that the rear yard setback will be less than the code -required 35 feet for lots measuring less than 20,000 square feet in total size. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on both of applicant's requests on December 15, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: REQUEST TO UNMERGE LOT (WAIVER) — ZBA File No. 5811 APPLICANTS' REQUEST TO UNMERGE LOT: The applicants wish to unmerge properties shown as Lots 3 and 4 on the Map of Lena F. Howell, approved by the Southold Town Planning Board June 11, 1969 and signed on September 15, 1969. Mrs. Hommel acquired Subdivision Lot 4 with her husband in October 1975, and built their home during 1976. The adjacent lot (Subdivision Lot 3) was acquired by Mrs. Hommel in August 1979. REQUEST FOR SETBACK VARIANCE ZBA — ZBA File No. 5812 REAR SETBACK RELIEF REQUESTED: With regard to CTM 123-6-12.2, the applicants wish to construct a single- family dwelling with a 3.3 foot reduction for a small section which extends at the rear of the home, resulting in a 31.7 ft. setback at its closest point, as shown on the 8/25/05 survey prepared by Kenneth H. Beckman. Page 2 — December 27, 2005 ZB No. 5811 and 5812 — Hommel and 01 CTM No. 1236-12.3 REASONS FOR BOARD ACTION On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: • Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The setback of the applicant's home is consistent with the setbacks of other homes in the area. The home on the corner of Reeve Avenue and the private Right -of -Way (Subdivision Lot 4) is less than 35 feet from the easterly lot line (the smaller remaining yard was deemed the side yard being a lot with two front yards). • The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. • The variance granted herein is not substantial. • No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. • Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. • During 2003, Mr. Hommel passed away unexpectedly, at which time the house lot became merged with the vacant lot, owned by Mrs. Hommel. Five months after Mr. Hommel's passing, the vacant lot was conveyed by Mrs. Hommel to her granddaughter and her husband, Nancy Righi and Alan Righi. • Grant of a waiver of merger will not result in a significant increase in the density of the neighborhood or district containing single-family dwellings. The grant of this waiver will provide for future construction of not more than one dwelling with single-family occupancy. • Grant of a waiver of merger would recognize a lot that is consistent with the size of lots in the neighborhood. The neighborhood and district is well-developed with single-family residences, and consists almost exclusively of older lots that do not conform to the R-40 (40,000 sq. ft.) minimum for this zone district. The 14,462 sq. ft, size of the vacant lot (CTM 12.2) in question is equal to some, but it is clearly consistent with the average size of lots in the immediate neighborhood and district. • The waiver will avoid an economic hardship for the owners. • A waiver of merger will allow for construction of one single-family dwelling, on the previously approved subdivision (for Lot 3), which will not result in a significant increase in the density of the neighborhood. There will be no need for significant change in its contours or slopes, and no evidence was presented to suggest that the lot would require filling affecting nearby environmental or flood areas, or to suggest that its natural details, character, contours or slope would be significantly altered in any manner. • The waiver will recognize the original lot lines as set forth in the subdivision approved in 1969 by the Southold Town Planning Board, and set forth in the applicants' separate 1975 and 1979 deeds for these lands. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Chairwoman Oliva, and duly carried, to GRANT the waiver granting the unmerger of lots, and to GRANT, the setback variance as applied for, as shown on the 8/25/05 survey prepared by Kenneth H. Beckman, L.S. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The variance should be granted for the following reasons: 1. No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. There were four (4) lots created by the Minor Subdivision for Lena F. Howell (map attached), approved on June 11, 1969 by the Southold Town Planning Board. On 10-31-1975 Charles and Anna Hommel purchased lot 2 on the subdivision map (Tax Lot 12.2) and they built their house on the property Four years later, on 8-5-1979, Mrs. Hommel purchased the lot next to their house. The proposed house is located with a front yard setback of 28.6' and rear yard setback of 317. The balance of the properties have similar setbacks: 1000-123-6-12.2 has a front yard setback of 40.6 but a rear yard of 15'. 1000-123-6-12.5 has a front yard of 27' and rear yard setback granted by the ZBA in decision #5461 & #4505 of 30.9 1000-123-6-12.4 is the original house prior to subdivision and has a front yard of 18.1 and rear yard of 17.2'. The owner has been able to comply with the average setback for the front yard, however, there is no similar exception for the rear yard. There is a pedestrian right of way to the beach along the rear of this and adjacent properties. The right of way has never been cleared or used, however, it shows in the title and on the survey. 2. The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance. The house is modest for a year round house for a young family. The rear yard setback is the minimum necessary to build the house proposed. The proposed house will not have a basement because of the proximity to the water but includes an attached garage. An existing gardening shed 0 • which stores the riding lawn mower will remain on the property. The ZBA has over the years repeatedly recognized that the lots in the Howell subdivision were consistent with the size of lots in that neighborhood. The following record of Board actions is as follows: (1) The ZBA granted a variance to the original developer in 1959 which allowed the waterfront parcel to sell 20 feet to the parcel to the east. In granting that approval on May 6, 1959, the ZBA stated that "the lot would be in conformance with the entire area and would improve the area by enlarging the surrounding lot". (2) In 1997 the ZBA recognized lot 12.5. In making their determination in decision #4504 and #4505, the ZBA made a finding of fact that lot 12.5 "adjoins improved lots of similar size to the south (1000-123-6-12.4) and to the north (12.3)' 3. The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance. The zoning requires 35 feet rear yard, and the house is proposed at 31.7 which is a minimal variance. The setback variance is only a 10% reduction in the required setback. The proposed house and setbacks will be in conformity with the new and existing houses on this street. 4. The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district. The property has been cleared and maintained for over 30 years. There are no environmental constraints preventing the development of the property. The existing 10 x 22 shed will be retained for the storage of gardening tools. 5. The alleged difficulty was not self-created. The lots were created by the Planning Board and at the time of lot creation there were no limitation on rear yard setbacks. 6. The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant. Less than 5 months after her husband passed away she transferred her home as the surviving tenant by the entirety to her daughters, retaining a life estate. Again, as evidence of her belief that she retained a separate lot, the lot was conveyed to her granddaughter and her husband, Nancy Righi and Alan Righi. Nancy Righi has been Mrs. Hommel's caretaker since her husband passed away and having her next door will enable Mrs. Hommel to stay in her home. See enclosed notarized letter from Mrs. Hommel. The merger was caused solely by death, without intent by the owner to merge the parcels or notice to the owner that the merger had occurred. Mrs. Hommel did everything in her power to retain the lots as separate parcels. Her husband's death was sudden and she now faces both a financial and emotional hardship that her caretaker and granddaughter can not build the house she planned. Mrs. Righi, the granddaughter (the owner of 12.3), had obtained health department approval, construction drawings and selected a builder to begin the construction. The builder alerted Mrs. Righi that a merger may have occurred, a single & separate was obtained and the merger confirmed. (2) THE WAIVER WOULD RECOGNIZE A LOT THAT IS CONSISTENT WITH THE SIZE OF LOTS IN THAT NEIGHBORHOOD The four lots were subdivided in keeping with the size of lots in this area. The ZBA has over the years repeatedly recognized that the lots in the Howell subdivision were consistent with the size of lots in that neighborhood. The following record of Board actions is as follows: (1) The ZBA granted a variance to the original developer in 1959 which allowed the waterfront parcel to sell 20 feet to the parcel to the east. In granting that approval on May 6, 1959, the ZBA stated that "the lot would be in conformance with the entire area and would improve the area by enlarging the surrounding lot". (3) THE WAIVER WILL AVOID ECONOMIC HARDSHIP Mrs. Hommel and her husband have been paying the taxes and maintaining these parcels for more than 30 years. She has conveyed her house to her daughters, and reserved only a life estate. The lot had been purchased for their future needs. Her family is ready to provide both companionship and medical assistance in her senior years. Not only has Mrs. Hommel suffered the economic and emotional hardship of sterilizing a buildable lot, but her granddaughter (the owner of the lot) has planned a relocation to Southold Town. They are in limbo due to the inability to obtain a building permit, they have already paid significant sums on permit processes and construction plans. There is also an emotional turmoil on the entire family by the unintended merger of the property by death. (4) THE NATURAL DETAILS AND CHARACTER OF THE CONTOURS AND SLOPES OF THE LOT WILL NOT BE SIGNIFICANTLY CHANGED OR ALTERED IN ANY MANNER, AND THERE WILL NOT BE A SUBSTANTIAL FILLING OF LAND AFFECTING NEARBY ENVIRONMENTAL OR FLOOD AREAS. There are no environmental constraints on this property. A rear yard variance is required due to the narrowness of the lot. However, rear yard variances have been granted by the ZBA to Grattan/Stufano. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b -3(b). The variance should be granted for the following reasons: 1. No undesirable change will be produced in the character of the neighborhood ora detriment to nearby properties, if the variance is granted. There were four (4) lots created by the Minor Subdivision for Lena F. Howell (map attached), approved on June 11, 1969 by the Southold Town Planning Board. On 10-31-1975 Charles and Anna Hommel purchased lot 2 on the subdivision map (Tax Lot 12.2) and they built their house on the property Four years later, on 8-5-1979, Mrs. Hommel purchased the lot next to their house. The proposed house is located with a front yard setback of 28.6' and rear yard setback of 317. The balance of the properties have similar setbacks: 1000-123-6-12.2 has a front yard setback of 40.6 but a rear yard of 15'. 1000-123-6-12.5 has a front yard of 27' and rear yard setback granted by the ZBA in decision #5461 & #4505 of 30.9 1000-123-6-12.4 is the original house prior to subdivision and has a front yard of 18.1 and rear yard of 17.2'. The owner has been able to comply with the average setback for the front yard, however, there is no similar exception for the rear yard. There is a pedestrian right of way to the beach along the rear of this and adjacent properties. The right of way has never been cleared or used, however, it shows in the title and on the survey. 2. The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance. The house is modest for a year round house for a young family. The rear yard setback is the minimum necessary to build the house proposed. The proposed house will not have a basement because of the proximity to the water but includes an attached garage. An existing gardening shed which stores the riding lawn mower will remain on the property. The ZBA has over the years repeatedly recognized that the lots in the Howell subdivision were consistent with the size of lots in that neighborhood. The following record of Board actions is as follows: (1) The ZBA granted a variance to the original developer in 1959 which allowed the waterfront parcel to sell 20 feet to the parcel to the east. In granting that approval on May 6, 1959, the ZBA stated ,that "the lot would be in conformance with the entire area and would improve the area by enlarging the surrounding lot". (2) In 1997 the ZBA recognized lot 12.5. In making their determination in decision #4504 and #4505, the ZBA made a finding of fact that lot 12.5 "adjoins improved lots of similar size to the south (1000-123-6-12.4) and to the north (12.3)" 3. The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance. The zoning requires 35 feet rear yard, and the house is proposed at 31.7 which is a minimal variance. The setback variance is only a 10% reduction in the required setback. The proposed house and setbacks will be in conformity with the new and existing houses on this street. 4. The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district. The property has been cleared and maintained for over 30 years. There are no environmental constraints preventing the development of the property. The existing 10 x 22 shed will be retained for the storage of gardening tools. 5. The alleged difficulty was not self-created. The lots were created by the Planning Board and at the time of lot creation there were no limitation on rear yard setbacks. 6. The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant.
