PROPERTY FACTS/DESCRIPTION: The applicant's 2,470 square foot parcel has 45.07 feet along 7th Street in Greenport, and is improved with a single-story frame building (non-habitable dwelling prior to as-built construction), shown on the November 19, 2003 survey prepared by Pat T. Seccafico and September 9, 2005 as-built elevation diagram prepared by Robert J. Higgins, Architect. BASIS OF APPLICATION: Building Department's August 24, 2005 Notice of Disapproval, amended September 13, 2005, citing Sections 100-230 and 100-244 in its denial of an application for a building permit for as-built alterations and construction. The reason stated by the Building Inspector in the denial of the application for a building permit is that the non-habitable structure contains as-built additions and new alterations which require a front yard setback of 22.6 feet after taking an average setback of existing buildings within 300 feet on the same side of the street. ADDITIONAL RELIEF: The Zoning Board of Appeals has noticed this application under Chapter 58 for additional zoning code relief under Section 100-244, involving total lot coverage exceeding the 20% code limitation, and for habitable area containing less than the code-required minimum 850 square feet, after as- built renovations, alterations, and deck enlargement. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on November 17, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to obtain variance relief for as-built construction with a setback at less than 35 feet from the front lot line (less than the average 22.6 ft. setback of other homes within 300 feet on the same side of the street) and for lot coverage at 23%, or 568 square feet (ref. John Metzger letter dated October 24, 2005. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: a M • page 2—December 1,2005 • ZB File Ref.5787 and 5801 —S. Ca o CTM 48-2-19 1. Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The as-built construction included an increased deck size and new alterations within the existing building for a single-family dwelling, from the former 335 square feet of non-habitable floor area (ref. Preexisting Certificate of Occupancy #Z-30069 dated 3/8/2004). It is necessary to increase the lot coverage for livable floor area as a minimum. The one-story building has existed for more than 60 years with less than 500 square feet of floor area and exceeding the code's limitation of 20% lot coverage. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The property is 2,470 square feet in size, having a width of only 45.07 feet and depth of 54.81 feet, which limits the size for a dwelling. If the home were enlarged to meet the code's 850 sq. ft. minimum requirement for a single-family dwelling, the lot coverage would increase to 35% or more. Adjacent homes are of comparable size to the existing, as-built construction requested in this application. 3. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The neighborhood consists of homes that are comparable in size and with similar nonconforming setbacks. 4. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition and alterations, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Dinizio, and duly carried, to GRANT the variances as applied for, as shown on the November 19, 2003 survey prepared by Pat T. Seccafico, October 24, 2005 letter certifying lot coverage at 23% by John Metzger, and September 9, 2005 as-built elevation diagram prepared by Robert J. Higgins, Architect. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. No. 5474— DANIEL and TINA FINNE Property Location: 1020 Seventh Street, Greenport CTM 1000-48-2-40 (unmerged from adjacent CTM #48-2-19) FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The applicant's property, shown with an area of 4,500 sq. ft. with 45 ft. frontage along the west side of Seventh Street, is presently improved with a one-story frame house situated 4.5 feet from the front lot line (zero setback from the front stoop), and 8 ft. from the southerly side lot line. The adjacent property, CTM 48-2-19, consists of.9�980P-sq. ft. with Pr)6 ASt. of frontage along Seventh Street and 100 ft. frontage along the south side of Flint Street. The November 7, 2003 title search, prepared by South Bay Abstract, Inc., indicates that CTM 48-2-40 was transferred 10/1/1976 to Frank A. Field, and to Frank A. Field Realty Inc. on 3/17/1984. The adjacent house parcel, 48-2-19 was also transferred 12/12/1977 to Frank A. Field, and to Frank A. Field Realty, Inc. on 3/17/1984. 2. The title search also confirmed that Frank A. This waiver of merger will recognize the original lot lines for Lot 56 shown on the Map of Greenport Driving Park filed December 1, 1909 in the Office of the Suffolk County Clerk, and in the originals deeds, dating back to 1953 and 1956, and earlier. 5. Information was submitted by applicant to show that the waiver will avoid economic hardship because both lots are owner by different owners and to continue with this merger will deprive each homeowner of the reasonable use of their property. No increase in the number of dwellings is proposed; each lot is improved with a dwelling. 6. In granting this waiver, the Board finds that the better interest of the town will be served because the applicant intends to reconstruct a house on the property within the required setbacks for this zone, utilizing all of the current codes pertaining to fire, building, safety, and zoning codes that apply.
