(631) 765-1809 Fax (631) 765-9064 Sout idk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF DECEMBER 27, 2005 ZB File No. 5813— CHRISTINE and JONATHAN BAKER Property Location: 920 Naugles Drive, Mattituck CTM 99-5-13 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 29,591 sq. ft. parcel has 85 feet along Naugles Drive and lot depth of 350 feet along the easterly lot line. The property is improved with a single- family dwelling as shown on the 11-19-2004 survey prepared by John C. Ehlers. BASIS OF APPLICATION: Building Department's October 13, 2005 Notice of Disapproval, citing Section 100-244 in its denial of an application a proposed second-story deck addition at less than 15 feet on a minimum side yard, and less than 35 feet for both side yard setbacks, combined. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on November 17, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct an 18 ft.x13.5 ft. deck at the rear of their home, with a setback 12 feet from the easterly side property line. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The relief sought is limited to a variance for rear easterly section of a proposed deck behind the house. The house is situated on an angle on a long, narrow lot where the pre-existing side setback is 9 feet. The setback for the proposed deck will be slightly more than 12 feet and will hardly be visible to the neighbors. Page 2—December 27,2005 ZB File Ref.5813—J. and C. Baker CTM 99-5-13 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The topography of the lot precludes placement of the deck at any other location. The location of the garage plus the fact that the land rises approximately 20 feet above the level of the house on three sides of the house, make placement of the deck anywhere else on the property impossible. 3. The benefit sought by the applicant cannot be achieved by any feasible method other than an area variance, given the topography of the land and the placement of the house. 4. The variance granted herein is not substantial, representing only a 2.8 ft. corner section of the new deck, for a 12.2 ft. side yard setback instead of the code-required 15 feet. 5. Grant of this variance is the minimum action necessary that will adequately enable the applicant to enjoy the benefit of a deck while preserving and protecting the neighborhood and the health, safety, and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Chairwoman Oliva, and duly carried, to GRANT the variance as applied for, as shown on the survey site map dated 11-19-2004, revised 11-02-2005 by John C. Ehlers and 8/12/05 deck diagram prepared by Penny Lumber. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
