Our application, #5357, is scheduled for a public hearing on August 21, 2003. Our application seeks an interpretation and, in the alternative, a variance. This application relates to a notice of disapproval from the Building Department dated April 1, 2003, stating that the proposed construction is "not permitted"pursuant to Section 100-162(C)(3) because the proposed wireless communication facility would be located less than 300 feet from two properties found on an inventory of properties compiled by the Society for the Preservation of Long Island Antiquities. As detailed below, we believe that the Building Department inadvertently applied the review standard in Section 56-7 of the Town's Landmark Law to our application and that this simple mistake may be quickly rectified by the Board of Appeals. Section 100-162(C)(3)requires the base of a wireless communication tower be located "300 feet from any landmark property or district listed by federal, state or town agencies". The only issue for interpretation is whether the list of landmark properties or districts to which reference is made in Section 100-162(C)(3)may be interpreted to include properties found on the Society for the Preservation of Long Island Antiquities Inventory of Southold Historic Properties. It is critical to note that Section 56-7(A), which applies to applications for activities at the landmark property itself, expressly references the Inventory prepared by Society for the Preservation of Long Island Antiquities. This reference to the Society for the Preservation of Long Island Antiquities (hereafter"SPLIA") Inventory is in addition J Mr. Yakaboski, Town.Attorney Town of Southold August 6, 2003 Page 2 to, and separate from,property listed by federal, state, or town agencies. Notably, section 56-7 does not apply to our application. In stark contrast, a reference to the SPLIA Inventory is not included in Section 100-162(C)(3). If the Town Board had wished to include the SPLIA Inventory in Section 100-162(C)(3) it could have done so,but did not. Pursuant to New York law, Section 100-162(C)(3) stands for what its words manifest and the Building Department may not supply requirements it may believe should have been included by the Town Board. According to information obtained from the Town and the Town's website, the SPLIA Inventory contains over 800 parcels throughout the Town and about 100 in Mattituck alone. In contrast, there are only about 56 sites listed on the Towns Register of Landmark Structures (3 in Mattituck) and 13 properties listed on the State and National Registers of Historic]Places. Looking to the SPLIA Inventory in the context of Section 56-7 presents no real hardship to applicants seeking approvals under that section because the only effect is that the application may, at most, be delayed 14 days while the Landmark Commission reviews the application and potentially files non-binding recommendations or comments. Applying the SPLIA Inventory to applications for building permit applications pursuant to Section 100-162(C)(3), however, would present real hardships and circumvent the Town's goal to encourage wireless telecommunications facilities to locate in industrial areas. The SPLIA Inventory is so large and includes so many parcels that it would be very difficult to find an industrial-zoned parcel that is located 300 feet from a property in the SPLIA Inventory.
