Dear Al,
I am in receipt of your letter dated October 12 regarding the above referenced
application. I do not agree that our proposed Site Plan differs from the originally
approved site plan to such an extent as to require a full review and permit procedure.
Our design is consistent with the intent of the original plan, and differs only in its details.
In fact, because Mr. Scollard has chosen to construct neither a dock nor a swimming
pool, this proposed plan will create less impact on the shoreline. Moreover, we have
chosen to locate the house further back from the high water mark than the originally
approved site plan. The sanitary system is in the same location, remote from the
surface water, and we have proposed no construction within 75 feet of the Bay.
For reasons of timing, this new application procedure creates a hardship for my client.
Please reconsider your decision to require a new permit, and grant an amendment to
the original permit, as per our request. We are certainly willing to accept additional
conditions that the Trustees feel are appropriate. Please let me know if we can arrange
a meeting to discuss this matter.

Dear Mr. Lau:
In response to your February 26, 1991 letter, we have
elected to modify the dock to a reverse "L." The outer
section will be 25' long. Wave baffles will be
constructed on the outer sections as well as the
southerly 40' of the main dock section. Two pilings will
be placed within the "L" section. We believe that this
will satisfy your concerns while still leaving a
protected area in which to place the boat.
Another minor modification is to add steps within the
inter-tidal area to provide access along the beach which
was a concern of the Department of State.
Another benefit to this revised configuration is to
reduce the incursion beyond the easterly property line as
extended. Due to the shallowness of the water further
west, we are hopeful that the dock can be placed as
shown.

On a motion by John Holzapfel, seconded by Bruce Loucka, it was
RESOLVED to recommend to the Southold Town Trustees disapproval of
Wetland Application No. 87-4-7 of Herbert and Catherine Lindtviet to fill
approximately 2' to an elevation of 7'. The Council recommends disapproval
because there is no reason to justify the project and the project could cause
runoff problems to neighboring properties. The Council also feels the application
is incomplete, nothing is submitted for the new addition or cesspools.
Vote of Council: Ayes: All
Motion carried.
On a motion by Stephen Angell, seconded by John Holzapfel, it was
RESOVED to recommend to the Southold Town Trustees disapproval of Wetland

deck, pool, sanitary system, bluestone or similar pervious driveway; a
fi~ed "T" dock consisting of a 4' x 100' base and 6' x 50' upper section;
aware baffle made of 2" x 10" boards with 1" spacing to be placed on
the outbound side Of the "T". The Council have concerns with the house
and sanitary system. 1. Horizontal migrating household sewage 2. Fill
might cause runoff problems to adjacent neighbors. The Council also questions
the accuracy of the wetland line and would prefer to see the house and
poc~l moved back 4' - 5'. The pool, of course, would have to backwash
intq a drywell as per the CAC check off list. The Council disapproves
the dock project. It feels the structure as submitted would have an adverse
effect to the bottom on the west and could result in the closing of Deep
HoI~ inlet.

Recommendation of Wetland Applications
The following recommendations were made by the Council at its meeting held
Thrusday, February 7, 1991:
On a motion by Stephen Angell, seconded by Margaret Feeney, it was
RESOLVED to reo0m~end to the Southold Town Trustees approval with limitations
on Wetland Application No. 1 11 - 1 of Thomas Samuels to maintenance dredge
a channel 30-+' x 1440+' to maximum depth 6' below MLW with spoil to be
used as beach nourishment on southwest side of Fisherman's Beach. The
CAC approves if the dredcjing depth is limited to 4'. The Council feels
that 6' is too big, 4' is adequate for most pleasure crafts in the area and
the Council is concerned that the 6' depth would create potholes and problems
to the surrounding water and shellfish.
Vote of Council: Ayes: All
Mo~ion carried.
Application No. 12-2-90-78-5-16 of James Grathwohl was tabled pending
receipt of the landscape plan, buffer zone and placement of a retaining
wall as requested by the Board of Trustees.
On a motion by Stephen Angell, seconded by Bruce Loucka, it was
RE$OVLED to recommend to the Southold Town Trustees approval with suggestions
of l~/etland Application No. 12-4-90-123-10-1 of Panagiotis Gazouleas to construct
a single family dwelling, attached decking and associated sanitary system.
Construct a 4' x 30' fixed dock, 3' x 10' ramp and 6' x 20f float. The
Council approves the house as submitted with the stipulation that the applicant
follow the checklist the CAC submitted to the Trustees in a letter dated
February 9, 1990 which requires roof gutters and drainpipes, no runoff
by grading, straw bales during construction, no planting requiring fertilization
and heavy watering within 75' of wetlands, etc. The Council approves
the dock with the suggestion that the two floats be turned 90° to plan
so it would be in line with the last adjacent dock.
Vote of Council: Ayes: All
Motion carried.
On a motion by John Holzapfel, seconded by Cynthia Sturner, it was
RESOLVED to recommend to the Southold Town Trustees approval with stipulations
of Wetland Application No. 24-2-11 to remove existing dilapidated docking
facility and replace in-kind, in-place, a 4' x 28' fixed timber dock, 3' x 16'
aluminum ramp, 6' x 20' float dock and two 2-pile float support dolphins.
The Council approves provided the project does not interfere with the adjacent

Please indicate the level of public use of the intertidal beach area and
how this proposal would preserve public access along this beach.
The proposed structure will be beyond the extension of the applicant~
south-eastern property line and can obstruct the access of the eastern
neighbor. Please explain or amend the proposal so that the structure lies
within the property line extensions.
Please provide a section drawing of the wave baffle.
Pursuant to 15 CFR 930.60(a), the review of your gonsistency certification
will begin after we receive and determine that the necessary data and
information is adequate to assess coastal zone effects.

ACTIVITY: Construct a T-shaped timber pier assembly consisting of a 4 foot
by 100 foot fixed pier with a 6 foot by 50 foot section at its bayward
end, and place a wave baffle made of 2 inch by 10 inch boards with one-inch
spacing on the bayward end of the 50-foot pier.
