TERMS and CONDITIONS

part of the consideration for the issuance of the Permit does understand and prescribe to the fol-
lowing:
f. That the said Board of Testees and the Town of Southold are released from any and
all damages, or claims for damages, of suits arising directly or indirectly as a result of any oper-
ation performed pursuant to this permit, and the said Permittee will, at his or her own expense,
defend any and all such suits initiated by third parties, and the said Permittee assumes full liability
with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold
2. That this Permit is valid for a period of 24 mm which is considered to be the
estimated time required to complete the work involved, but should circumstances warrant, request
for an extension may be made to the Board at a later dace.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes
to maintain the structure or project involved, to provide evidence to anyone concerned that auth-
orization was originally obtained.
4. That the work involved will be subject to the .inspection sad approval of the Board or
its agents, and noes-compliance with the provisions of the originating application, may be cause for
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along
the beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations
in the location of the work herein suthothmil, or If, in the ophdon of the Board of Testees, the
work shall cause unreasonable obstruction to free navigation, the said Permittee will be requited,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold
8. That the said Board will be notified by the Permittee of the completion of the work auth-
orized.
9. That the Permittee will obtain all other permits and contents that may be required sup.

Dear Mr. Krupski:
My neighbor to the west, Bob Keith, wrote to you on June 27, 2001 to ask what
suggestions you and the Trustees might have to address the continuing erosion of the bog which
underlies his house and ours. A copy of Bob's letter is enclosed.
The erosion problems have not abated, and we are seeking your help and ideas about
ways to deal with the problem. The sand which would normally drift from west to east here from
Marratooka Point gets dredged out of Deep Hole Creek, and all of it gets put back on Marratooka
Point to the west. Sand remaining on our side continues to drift to the east, thereby scouring our
properties, and that of Judge Suter as well.
We again request that you give consideration to our situation so we might address the
matter as soon as possible. Our tax map numbers are 1000-123-10-2 and 10-3

the erosion of the bog which underlies the fill upon which our house and that of our neighbor to the East, Pat
Scollard, have been built.
We talked about possible solutions, including a row of rocks or coconut matting, but the Board wanted to think
about it before reaching a conclusion.

WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on December 15, 1999, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety, and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approved the application of PAT SCOLLARD
to construct a 132' retaining wall of "C-Loc" series 4500 vinyl sheathing and install rock
armor on the northern return and 28' out on the southern end, with the condition that a
new survey be submitted when the job is complete.
BE IT FURTHER RESOLVED, that this determination should not be considered a
determination made for any other department or agency which may also have an
application pending for the same or similar project.
Permit to construct and complete project will expire two years from the date it is signed.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified upon completion of said
project.

As per our recent meeting at the proposed site we have revised the drawings to
satisfy the concerns of the Southold Town Trustees by angling the easterly line behind
the existing dry well in order to minimize scouring as requested. We have also included
armor to the easterly return as an additional measure to reduce scouring further. Included
in our revised plans is the extension of the westerly section of bulkheading by 20' and
adding a 24' low armor border perpendicular to the bulkhead and adjacent to the existing
vegetated wetlands in order to protect the bog/clay wetlands area from eroding into Deep
Hole Creek. Hopefully, all the adjustments desired by the Trustees are included in our
revised plans.
I sincerely believe that the combined efforts of the Trustees' and Mr. Scollard's
willingness to adjust to the method of curtailing the severe erosion that has taken
approximately 30 to 40 feet off his land will result in a project that is better for the Town
and allows the property to be protected.

Dear Mr. Barton:
in response to your letter dated November 5, 1999, 1 am sending the letter
and information regarding the above-mentioned application in an attempt to
clarify several points.
Mr. Scollard has attempted on two separate occasions to utilize a non-
structural, soft approach to minimize the erosion at his property. Mr. Scollard
intends to use vinyl to construct the retaining wall in order to minimize the toxicity
of the materials used. By proposing the small bulkhead as "Toe Protection" we
are trying to minimize the degree of erosion that is presently occurring at that site
and adjacent to the inlet of East Creek and Mud Creek in Cutchogue. Mr.
Scollard's property has eroded approximately 28' since his survey was
completed in 1992 and as recent as our application submittal in July of 1999, Mr.
Scollard has lost an additional 12'. The eroded material (sand) is causing
shoaling of the adjacent beach area and into the creek's entrance.
Enclosed please find several photographs of the waterfront at Mr.
Scoliard's showing the erosion.

As a consequence of Hurricane Floyd our beach has experienced significant erosion,
exposing the outfall box for our water plant and threatening a great deal more damage.
Because our property is a cutout from the lot of Mr. Scollard, the problem of the two lots
are linked together.
We hope that the Trustees will make a pre-submission visit to the site on Wednesday,
October 20, to determine what can be done to overcome the problem. Both Mr. Scollard
and I will be present. I live next door to Mr. Scollard at 995 Willis Creek Drive and my
telephone is 298-8508. Mr. Scollard lives at 905 Willis Creek Drive and the beach can be
approached across his property or by the walkway just to the East of his lot.
A cutout of the survey is attached. We have had one earlier permit to rebury the outfall
box following a storm. It is our hope that you will treat this as an emergency,
