The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, February 27,2008:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Permit #5701 to construct approximately 88 linear feet of 100-200 lb. stone rip-rap atop
landward side of existing rip-rap and backfill with approximately 50 cubic yards clean
sand fill to be trucked in from an upland source and planted with Cape American
Beachgrass (12" on center), and as depicted on the revised site plan prepared by En-
Consultants, Inc., last dated January 17, 2008, and received on January 30,2008.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

#5701 to construct approx. 88 linear ft. of 100-200 lb. stone rip-rap atop landward side of
existing rip-rap and backfill with approx. 50 cy. clean sand fill to be trucked in from an upland
source and planted with Cape American Beachgrass (12' on center). Located: 905 Willis Creek

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of South old Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the L WRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is CONSISTENT with the following Policy Standards and
therefore is CONSISTENT with the L WRP. To further the policies of the L WRP the
following is recommended.
lIthe action is approved the following best management practices (BMP's) are recommended:
I. Require that construction practices minimize destruction of the existing
vegetation.
2. Require that anv areas disturbed due to the construction of the rock revetment be
re-planted with native vegetation.

3. Require a significant non-disturbance buffer landward of the proposed rock
revetment.
The BMP will further Policies 5, Protect and improve water Quality in the Town of Southold and
6.3, Protect and restore tidal and freshwater wetlands, item D (below),

in order to ensure protection oj the wetland's character, quality, values, and junctions.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

Dear Mr. Scollard:
The Board of Town Trustees took the following action during a Regular Meeting, held on
January 22, 2003 regarding the above matter.
WHEREAS, Patrick J. ScoUard applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of South old, application dated January 2.
2003.
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
January 22, 2003 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold
Town Code.
WHEREAS, the Board has determined that the project as proposed will not affect the health,
Safety and general:welfare of the people of the town.

RESOLVED, that the Board of Trustees approved the application of Pmriek J. Seo/lard for s
Wetland Permit to add to bulkhead and protect th bog with rock with the stipulation that the
contractor contact the Trustee's Office when the project is to start - two inspections first day and
when the project is complete.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar proj ect.
Fee must be paid, if applicable and permit issued within six months of the date of this
notification.
If inspections are required, at a fee of $5.00 per inspection (See attached schedule).

OF THE RIP-RAP WITH HEAVIER STONE IS PROPOSED TO BETTER MAINTAIN THE FILL AND PLANTlNGS TO BE

Dear Mr. Kmpski:
During your January 2003 regular meeting, permits were granted to the captioned property owners to
install a vertically faced bulkhead along and behind the natural embankment of their properties to stem
a chronic erosion problem.
Since the issuance of these permits, the owners have retained En-Consultants, Inc. to assist them in
obtaining a Tidal Wetlands Permit for the same project fi:om the New York State Department of
Environmental Conservation (DEC). Based upon my inspection of the property, however, it is my
opinion that the DEC would be unlikely to grant approval for what the Board approved. It is also my
position that there is indeed a preferable design alternative that would not only be more appropriate
ecologically but also more effective in retaining the upland portion of the owners' properties.
Specifically, though I understand fi:om the owners that the bulkhead was intended to be emplaced
primarily landward of the existing embankment, I am not sure I understand the rationale for such a
design. As long as the bulkhead was located in the approved location, it would be ineffectual at
stemming the erosion problem the owners are seeking to mitigate, and by the time it were exposed, an
additional and significant amount of buffer area vegetation and upland material will have been lost.
The ultimate result would be an exposed, vertically faced bulkhead located at a new, substantially
transgressed shoreline with no environmental benefit I can conjure.
Use of rip-rap stone instead of a bulkhead, on the other hand, would allow the retaining wall to be
contoured along the naturally curving toe of the existing embankment, such that the existing interface
between the shoreline and upland could be preserved. Also, unlike a bulkhead installation, rip-rap
could be installed with limited hand excavation and disturbance to the adjacent environment. And as
the Board knows, use of a sloped stone wall allows erosive wave energy to be dissipated over the face
of the stone rather than be reflected by the bulkhead, which is the scenario that would ultimately be
generated under the current permit. In short, the rip-rap would effectively stem the loss of the owners'
upland while maintaining the naturally existing site conditions to the maximum extent possible.
Therefore, we plan to submit an application to amend the current permit to approve a proposed rip-rap
design in place of the approved bulkhead, the environmental impact of which we believe would be
more beneficial to the environment, pursuant to the requirements of the moratorium. In order to afford
the Board an opportunity to visualize and more specifically discuss the proposed implementation of the
project, however, we are requesting that the Board first meet us at the subject properties during your
monthly field inspections for a "pre-application inspection." The location of the proposed rip-rap has
already been staked, and I will be happy to meet the Board at whatever time is convenient. I look
