Oliva, Chairwoman/Member Gerard P. Goehringer, Member Vincent Orlando, Member James Dinizio, Jr, Michael A. Simon, Member Linda Kowalski, ZBA Assistant and Secretary 6:00 p.m. Chairwoman Oliva called the meeting to order. The Board proceeded with the first item on the Agenda as follows: DELIBERATIONS/DECISIONS. The Board deliberated on the following applications. Requests, based on the Building Inspector's October 13, 2005 Notice of Disapproval, concerning property located in the R- 40 Low-Density Residential Zone District, referred to as 3245 and 3505 Camp Mineola Road, Mattituck: #5811. Request for a Lot Waiver under Section 100-26 to unmerge property shown as CTM #123-6-12.3 (vacant with 14,200+- sq. ft.) from CTM #123-6-12.2 (improved with 14,200+- sq. ft). #5812. If a Lot Waiver is granted under ZBA File #5811, a Variance is requested under Section 100-244 to locate a new dwelling at less than the code-required 35 feet from the rear property line, concerning property shown as CTM #123-6-3. 11:05 A.M, JONATHAN and CHRISTINE BAKER #5813. Request for a Variance under Section 100- 244, based on the Building Inspector's August 24, 2005 Notice of Disapproval concerning proposed additions and alterations to the existing dwelling at less than 35 feet from the front yard lot line, and under Section 100-242A, constituting an increase in the degree of nonconformance. Location of Property: One High Road, Shingle Hill, Fishers Island; CTM 1000-9-1-8. Vote of the Board: Ayes: Members Oliva (Chairwoman), Goehringer, Dinizio, Simon and Orlando. This resolution was adopted (5-0). RESOLUTIONS/OTHER ACTION, Continued: B. Brief reviews of pending files and general discussions by Board Members followed. C. Resolution for re-appointment of ZBA member Vincent Orlando and Ruth Oliva as Chairwoman with letter to Town Counsel and Town Board. On motion by Member Goehringer and seconded by Member Dinizio, it was Page 4 - Minutes Meeting held December 1, 2005 Southold Town Board of Appeals RESOLVED, that the Zoning Board of Appeals recommends the following: (a) reappointment of Vincent Orlando for a full term as Member of the Zoning Board of Appeals, and (b) reappointment of Ruth D. Oliva as Chairwoman; and BE IT FURTHER RESOLVED, that a copy of this Resolution shall be forwarded to the Southold Town Board and the Southold Town Clerk. Vote of the Board: Ayes: Members Oliva (Chairwoman), Goehringer, Dinizio, Simon and Orlando. This resolution was unanimously adopted (5-0). There being no other business properly coming before the Board at this time, Chairwoman Oliva declared the meeting adjourned.
