Dear Mr. Herrmann:
The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, February 15, 2006:
RESOLVED, that the Southoid Town Board of Trustees APPROVE the Amendment to
Permit # 6198 for the removal of a 12'X 16' deck at the top of the embankment and construct a
10'X 19' (rather than 10'X 10') deck landward of bulkhead, 20' from the property line; and
revegetate backfilled and other disturbed areas of embankment with beach grass, bayberry, and
Rugosa Rose with the condition of one year survivability inspection on the plantings, and all as
depicted in the plan with the condition that there be a inspection at the completion of the
plantings and a one year survivability inspection, and all as depicted on the plans drawn by En-
Consultants, Inc. revised 3/16/06.
This project will need a final inspection.

At the meeting of the Southold Town Conservation Advisory Council held Wed.,
February 8, 2006, the following recommendation was made:
Moved by Don Wilder, seconded by Jack McGreevy, it was
RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of

The Board of Town Trustees took the following action during its regular meeting held on
Wed., September 21,2005 regarding the above matter:
WHEREAS, En-Consultants, Inc. on behalf of KEVlN & DOREEN BARR applied to the
Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold
Town Code, the Wetland Ordinance of the Town of Southold, application dated August
30, 2005 and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory

WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on September 21, 2005, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of'the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of KEVlN & DOREEN
BARR to remove and replace (in-place) approx. 158 linear ft. of existing timber
bulkhead with vinyl bulkhead and backfill with approx. 25 cy. of clean sand fill to be
trucked in from an upland source. Remove existing beach steps and deck, and
construct 4' boardwalk, 10'X 10' deck and platform and steps to beach, with the
condition no CCA treated lumber is used on any of the structures, except for the pilings,
and all as depicted on the plan prepared by En-Consultants, Inc. dated July 27, 2004.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

Thc proposed action has been reviewed to Chapter 95, Waterfront Consistency Review
of the Town of Southold Town Code and the Local Waterfront Revitalization Program
(LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is generally
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the
LWRP, with the following conditions:
1. The proposed deck must be 20' from the property line.
2. No CCA treated wood used in the construction of the deck.
3. A survivability plan and inspection schedule for the bluff restoration.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

deck, and construct 4' boardwalk, 10'X 10' deck and platform and steps to beach. Located: 200

The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is generally CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP provided the following standard best
management practices are implemented.
1. To further the intent of LWRP Policies 5, 6, and 8; protect water quality, marine
organisms and the health of the users of the structure; require that no CCA
treated wood~ oil based preservatives containing creosote (CRT) or
pentachlorophenol {PCP}~ applied to the surface of wood materials shall be
permitted in the construction materials of the structure. The applicant shall use
a decay resistant alternative.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

The Board of Town Trustees took the following action during a Regular Meeting, held on March
18th, 2003 regarding the above matter.
WHEREAS, En-Consullants, Inc. on behalf of Doreen & Kevin Barr applied to the Southold
Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of
Southold, application dated February 27, 2003.
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
March 18th, 2003 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold
Town Code.
WHEREAS, the Board has determined that the project as proposed will not affect the health,
Safety and general welfare of the people of the town.
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approved the application of En-Consultants, Inc. on
behalf ofDOREEN & KEVIN BARR request a Wetland Permit to excavate +/- 10' wide area
of existing bulkhead and install tie rods and dead men - backfill with additional 25 cubic yards
of clean sand fill to be trucked in from an upland source - construct 4' timber walkway landward
of bulk.head - remove existing 4.5'x10' deck - construct 10'xl0' deck and construct +/- 10 linear
feet of timber retaining wall landward of new deck.
BE 1T FURTHER RESOLVED that th/s determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Fee must be paid, if applicable and permit issued within six months of the date of this
notification.
If inspections are required, at a fee of $5.00 per inspection (See attached schedule).

making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial perrnits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).

public view. As these structures and the proposed access steps to the

Because the proposed in-kind bulkhead reconstruction qualifies as a

is exempted from the LWRP consistency review requirements set forth

approved bulkhead replacement (see Town Wetlands Permit No. 5725 with
8-18-04 amendment - copies attached) entails the in-place reconstruction
of an existing bulkhead, which will protect the loss of existing structures
