Dear Mr. Wiggins:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, December 21, 2005 regarding the above matter:
WHEREAS, Merlon Wiggins as agent for STIRLING HARBOR SHIPYARD & MARINA
applied to the Southold Town Trustees for a permit under the provisions of Chapter 97
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated November 23, 2005, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on December 21, 2005 at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application STIRLING HARBOR
SHIPYARD AND MARINA to replace approx. 165' of partially failed bulkhead with vinyl
sheathing with the condition of a 4' gravel walkway/non turf buffer covered with a wood
walkway landward of the bulkhead, re-landscaping the disturbed areas, reinstallation of
the pool and a drywell to contain pool drainage, a haybale line during construction of the
pool, and all as depicted on the plans drawn by Peconic Associates received Feb. 23,
2006.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)
This is not a determination from any other agency.

STIRLING HARBOR SHIPYARD & MARINA requests a Wetland Permit to
replace approx. 165' of partially failed bulkhead with vinyl sheathing. Located:
Manhaset Ave., Greenport. SCTM#36-1-1
The proposed action has been reviewed to Chapter 95, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront
Revitalization Program (LWRP) Policy Standards. Based upon the information
provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that
the proposed action is generally CONSISTENT with the Policy Standards
and therefore is CONSISTENT with the LWRP with the following condition:
1. There will be no CCA lumber used.
2. To further support the LWRP and the policies~ assess the feasibility of thc
installation of a silt boom/turbidity screen to bc employed during
construction of the bulkhead to minimize turbidity in the water column.
Pursuant to Chapter 95, the Board of Trustees shall consider this
recommendation in preparing its written determination regarding the consistency
of the proposed action.

In accordance with your inquiry about other work et thla site, attached is self
explanatory letter from Brewer Stiriing Harbor Marina regarding the
replacement of the pool and Its retaining wall. The drawings end survey for
the replacement pool, which la only half the size of the original pool and in
the same location, are being prepared.
So ae not to delay the approval of the replacement bulkhead end further lose
of baokfill into Stiriing Harbor, request permit be amended to include pool
end bulkhead replacement in eccordanoe with the attached letter.

SUBJECT: Application for Emergency Bulkhead Repair
Stirling Harbor Shipyard & Marina, Greenport, New York
The recent storm and high tides resulted severe flooding of the subject
marina's upland areas. This extra weight of water caused in some areas a
total bulkhead failure and a partial failure in adjacent areas(see photos). The
loss and settling of backfill material(see photo looking South) is interpreted
as a partial failure of this single sheathed bulkhead built prior to 1980.
Immediately upland of the failed and partially failed bulkhead is the marina's
pool and cabanas. Further failure of this bulkhead would in all probability
result in severe damage or loss of these facilities. You expeditious review
and approval of this emergency bulkhead repair is requested.

proposed actions that are subject to the Town of Southold Waterfxont Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in

SUBJECT: Application for Emergency Bulkhead Repair
Stirling Harbor Shipyard & Marina, Greenport, New York
The recent storm and high tides resulted severe flooding of the subject
marina's upland areas. This extra weight of water caused in some areas a
total bulkhead failure and a partial failure in adjacent areas(see photos). The
loss and settling of backfill material(see photo looking South) is interpreted
as a partial failure of this single sheathed bulkhead built prior to 1980.
Immediately upland of the failed and partially failed bulkhead is the marina's
pool and cabanas. Further failure of this bulkhead would in all probability
result in severe damage or loss of these facilities. You expeditious review
and approval of this emergency bulkhead repair is requested.
