Quarterly payments of $25,856.50 will be mailed by the Office of the Comptroller on the 25th of June, September and December, 1986, and on April 25, 1987. In addition, new legislation authorizes an additional $7 million for the program this year. This will result in a one-time payment of $8,631 to the Town on March 25, 1987. The Town must expend $67,997 of its annual CHIPS apportionment for Capital Construction projects and maintain its current level of expenditure of local source revenue for operating and maintaining its highway system, or risk a reduction in CHIPS apportionments in subsequent years. A CHIPS Certificate of Accomplishment must be filed after the end of the Town fiscal year, indicating the extent of compliance with these requirements. The one-time $8,631 payment, authorized by the legislature, indicates their perception that additional money is needed to stem the steady deterioration of local highways. It also indicates the Legislature's feeling that CHIPS is an important program of aid for local highways, and that you are using this aid prudently. The fourth quarterly payment is slated to be mailed on April 25, 1986. Continued in the CHIPS legislation is the requirement that the Town expend $68,518 of its annual CHIPS apportionment for Capital Construction projects. The Town is also required to maintain its level of expenditure of local source revenue for the operation and maintenance of its highway system; otherwise it will be subject to a reduction in its CHIPS appor{ionment in subsequent years. Your municipality must submit its CHIPS Certificate of Accomplishment attesting to the fulfillment of these requirements by the first day of the third month following completion of your fiscal year. Recently enacted legislation exempts municipalities receiving an annual apportionment of under $5,000 from the requirement to maintain the level of expenditure of local source revenue for operating and maintaining their road systems. These municipalities need Not file a Certificate of Accom- plishment. The exemption from the minimum capital program for these muni- cipalities continues. AS before, the CHIPS money must be used exclusively for highway purposes. The continued funding of the CHIPS program depends ON the wise use of your apportionment and your adherence to the rules of the program. I believe this course will be very useful to the Long Island municipalities since it deals with the proper methods of setting up municipal traffic codes (ordinancing stop signs, speed limits, parking, etc.). As you know, properly ordinanced signs are enforceable by your police and adjudicated in your local courts. Quarterly installments equal to one-fourth of the apportionment will be mailed by the Office of Comptroller starting June 25, 1982. Chapter 314 of the Laws of 1981, as amended, requ~ires that the towh take certain actions to ensure that the quarterly payment of $25,693.75 is not reduced. - The Town Of Southold may not reduce its expenditures of local source rev- enues for street/highway operations and maintenance below the average of the previous two years. - At least $67,257 of the town's allotment must be expended for Capital Construction projects (street/highway improvements with service lives of ten or more years). - The rules of the program must be followed. Enclosed are two brochures. The CHIPS brochure briefly explains how the program works. The TAP brochure explains our new Technical Assistance program, designed to help in the start up Of the CHIPS program and beyond that, to provide techni- cal aid in the accomplishment of your highway program. Guidelines for the CHIPS program are being mailed under separate cover. All three documents explain how additional program information can be obtained. The present law continues CHIPS for the next four years. Extension of CHIPS be- yond this psriod will depend on how wisely you spend your apportionment and how well you follow the rules. Area Code 518 -- 465-7933 or 46~2015 ~ ~ June lst~ 1982 Dear Supervisor: I dislike having to tell you this but it's vital to all 18,000,000 New York State residents, includiug, of course, our 8,000,000 townspeople --- CHIPS (the Consolidated Highway Improvement Program) is not yet securely in place. No funds have yet been legally appropriated for it. With its enactment last year, all other state statutes providing aid for maintenance and improvement of local highways wererepealed, while solid commit- ments were given to me personally by the Governor, the State Commissioner of Transportation, all the leaders of the Legislature and scores of Assemblymen and Senators that CHIPS would be fully financed. In reliance on these assurances, we went along with the CHIPS proposal, fore- going all other existing local highway aid prograph (the Donovan Plan, the $75 per mile of Highway Law, §279, etc.) in the process. You responded magnificently to my letter of May lOth, 1982. The impact of your response was truly felt in Albany. Mr. Kremer, Chairman of the crucial Assembly Ways and Means Cogent tree, has applauded what you and your Association have done but he wrote to me only last week to "Keep up the pressure" (his own words). LET'S DO IT! This is a real mess - for towns, a $32,000,000 mass. We thought we were going from $9 million a year to $32 million. We could go from $9 million to 'NOTHING. This is not Just another bill we want passed. This is a failure by Albany which constitutes a breach of faith. Your Association staff is working hard at it daily and we will "KEEP UP THE PRESSURe". Be mindful that we are not pleading for a favor from those in charge of the state government. We are demanding what is rightfully ours, what has been solidly promised for towns and ocher local governments. I implore you to write, call, wire your Assemblyman and Senator, the Governor and anybody of influence tm state government you may know. Quarterly installmenta equal to one-fourth of the apportionment will be mailed by the Office of Comptroller starting June 25, 1982. Chapter 314 of the Laws of 1981, as amended, req%~ires that the town take certain actions to ensure that the quarterly payment of $25,693.75 is not reduced. - The Town of Southold may not reduce its expenditures Of local source rev- enues for street/highway operations and maintenance below the average of the previous two years. - At least $67,25;7 of the town's allotment must be expended for Capital Construction proDects (street/highway improvements with service lives of ten or more years). - The rules of the program must De followed. Enclosed are two brochures. The CHIPS brochure briefly explains how the program works. The TAP brochure explains our new Technical Assistance program, designed to help in the start up of the CHIPS program and beyond that, to provide techni- cal aid in the accomplishment of your highway program. Guidelines for the CHIPS program are being mailed under separate cover. All three documents explain how additional program information can be obtained. The present law continues CHIPS for the next four years. Extension of CHIPS be- yond this period will depend on how wisely you spend your apportionment and how well you follow the rules.
