Dear Mr. Murphy:
This refers to a telephone conversation of last November between yourself and
Mr. Albert Robbins of our office concerning the speed limit on Aldrich Lane
in the Town of Southold.
As you requested, we have reviewed the Department's decision to establish a
speed limit of 40 MPH on this highway. The matter was discussed at length
with our Hauppauge Regional Office which, as you are aware, reviews speed
limit requests jointly with the State Police. We have also received radar
speed data recorded by the Tow~ of Southold Police Department.
Based on this latest review of the matter, we must continue to support 40 MPH
as a proper speed limit on Aldrich Lane for the reasons previously explained.
If problems develop and/or conditions change, plesse feel free to discuss the
matter further with our Hauppauge Regional Office.
We umderstand your concern in this matter and, although a further reduction
could not be justified, we want to assure you your request was given careful
consideration.

Pursuant to Section 1625 of the Vehicle and Traffic Law all movement of vehicles, persons or
animals on such highway is hereby restricted and regulated in accordance with the determination of the
Commissioner of Transportation as evidenced by posted signs, signals or barriers placed along said highway and/or
by directions by an authorized representative of the Commissioner of Transportation.
Any action taken by the Commissioner of Transportation pursuant to Section 1625 of the
Vehicle and Traffic Law shall supersede'any other provisions of the Vehicle and Traffic Law where inconsistent
or in conflict with respect to the following enumerated subjects:
1. Establishment of maximum and minimum speed limits at which vehicles may proceed along any
such restricted highway.
2, Weights and dimensions of vehicles.
3, Use of such restricted highway by pedestrians, equestrians, and anima[s.
4. Parking, standing, stopping and backing of vehicles.
5. Control of persons and equipment engaged in work on such highway.
The provisions of the Vehicle and Traffic Law with respect to registration shell not apply to
vehicles and equipment engaged in work on such restricted highways.
When used on such restricted highways, all traffic control devices shall be considered as official
traffic control devices and shall conform to the manual and specifications for a uniform system of traffic control
devices adopted by the Department of Transportation.

Pursuant to Section 1625 of the Vehicle and Traffic Law, the Commissioner of Transportation added the following
Rules and Regulations to Title 17 of the Official Compilation of Codes, Rules and Regulations of the State of New York w~ich
were filed and effective on June 26, 1973.
Part 41
Traffic Regulations on Restricted Highways
(Statutory authority: Vehicle and Traffic Law, Section 1625.)
Section 41.1 Definition. The term restricted highway when used in this pert shall mean any highway or portion thereof
under construction or reconstruction under the supervision of the Commissioner of Transportation and which is designated by
him as a restricted highway pursuant to Section 104a of the Highway [.aw.
41.2 Traffic control device~. Unless otherwise posted traffic control devices used on restricted highways shall conform
to the requirements of the Vehicle and Traffic Law.
41.3 Flagman. Operators of vehicles on restricted highways shall follow the directions of any flagman with respect to
movement of Such vehicles.
41.4 Control of persons and equipment. Construction personnel and equipment engaged in work on such restricted
highway shall be afforded the widest latitude in operating within the restricted highway consistent with the safety of the traveling
public. This shall include, but not be limited to, the crossing of the highway and the mag; the shutting-off of lanes of travel
consistent with the contract and the orders of the Commissioner of Transportation or his duly authorized agar, t; the loading,
unloading and manipulation of material; the movement and direction of vehicles and equipment; and, other similar operations
necessary to the reasonable and practical performance of the contract.
41.5 Other requirements. The other provisions of the Vehicle ~nd Traffic Law relating to motor vehicles shall not apply
to special purpose construction equipment, such as described in section 401, subdivision 7. paragraph (f) of the Vehicle and
Traffic Law, while engaged in work on a restricted highway, except that all such vehicles and equipment shall be kept in safe,
mechanical operating condition at all t~mes and reasonable caution shall be used to protect the traveling public. However, such
other provisions shall apply to those vehicles that normally operate on public highways to transport persons and/or material and
are ordinarily considered commercial vehicles.
41.6 Emergency or unusual conditions. The Commissioner of Transportation may by the erection of signs, signals or
other traffic control devices alter or modify the provisions of this Part to adequately protect the public at locations where
emergency or unusual conditions occur or exist as a result of the construction or reconstruction on ~ restricted highway. These
alterations or modifications shall have the same force and effect as though they were specifically set forth in this Part and shall
remain in force until the condition is considered by the Commissioner to be safe and the erected signs, signals or other traffic
control devices have been officially removed.
41.7 Effective date, The prov*sions of this Part shag be effective with respect to a ~pecific restricted h*ghway from the
date the highway is designated a restricted highway by an official designation of the Commissioner of Transportation until the
restriction is removed by a notice of cancellation of such designation issued by the Commissioner of Transportation. The
provisions of this Part shall also be effective with respect to all restricted highways which have heretofore been designated as
restricted highways by the Commissioner of Transportation and on which the restriction has not been removed by a nozice of
cancellation issued by the Commissioner of Transportation.

Your June 18, 1986 Speed Limit Request
Aldrich Lane - Laurel
We have completed our investigation and a 40 mph speed limit will be
authorized for Aldrich Lane from Franklinville Road to Sound Avenue. Our
study also included Franklinville Road also known as the Aldrich Lane
extension. Franklinville Road is the old Route 25 through the Hamlet of
Laurel and presently serves as the connecting roadway between Route 25 and
Aldrich Lane and is part of truck Route 25. The east portion of
Franklinville Road rejoins Route 25 and serves the Laurel Elementary
School.
In conducting this study, w~ considered the building sites on Aldrich Lane
that have been cleared and future expansion of the Town's softball fields
and picnic grounds. The use of the road as a truck route was also
considered.
Thank you for bringing this matter to our attention. The ordinances
covering these speed limits are attached. If the Town requires any
assistance in the posting of the signing please have them contact Mr. D.

Reference is made to your letter of May 28th, and Supervisor
Murphy's response of June 5th with regard to the speed limit on
Aldrich Lane.
As a result of a speed limit request to the New York State
Department of Transportation, the speed limit has been reduced
to 40 mph. I am enclosing a copy of the Dept. of Transportation
letter for your information explaining the results of their, investiga-
tion. The new signs for this 40 mph speed limit should be erected
in the very near future.

Your August 15, 1986 Letter
The maximum vehicular speed on non-posted roadways in New York State is 55
MPH. To provide ~uidance in determining if a reduced speed limit is required
on a roadway, standard procedures have been adopted. The first step is to
evaluate and index the roadside development. The index on Aldrich Lane,
including proposed building plots, showed that radar samples should be taken
to determine an appropriate speed limit. A radar sampling showed that 85
percent of the vehicles were traveling at or below 40 MPR and this was
selected as the speed limit of Aldrich Lane. The use of this 85th percentile
speed is nationally accepted and prevents the establishing of a speed limit
where iow compliance would occur and a speed trap would exist.
Franklinville Road (01d Route 25) was also considered in our speed study since
Aldrich Lane's south terminus is at Franklinville Road and rather than leave
Franklinville Road as an unposted roadway with a 55 M~H statutory speed limit,
a 40 MPR speed limit was established for it.
The proposed speed limits on Aldrich Lane and Franklinville Road were reviewed
by the state police and concurred with by the Southold Town Police.
We appreciate your concern in this matter and we assure you that the interest
and concerns of local residents and motorists were considered. If the town
feels a school speed reduction is required on a very small portion of
Franklinville Road, please let us know and we will study it. A school speed
1/mit may only be established within 300 feet of the school's building line.

Dear Mr. Hoffman,
I have received a copy of your 7/24/86 correspondence with Mrs.
J. Terry, Southold Town Clerk, regarding the speed limit change
on Aldrich Lane.
I find it difficult to understand why a 40 mph speed limit was
determined as opposed to a 50 mph limit. Those of you who
studied this matter have clearly chosen to give preferential
treatment in the use of our road to trucks and other vehicles
over the safety of 21 children.
I'd like to share this conversation with you. A nine year old
girl on our street asked me, "Are you going to change the speed
limit on our block to 50?" I explained to her how that's what
I'd like to see, but it wasn't up to me. I then asked her if she
wanted it lower then 40. She answered, "Oh yeah, then we could
rollerskate and ride our bikes on the road." This girl is living
in "the country" and doesn't feel she can ride her bike safely on
the road and she's absolutely right. She'd be much safer on
Route 25 which also has sections of 40 mph but has double lines
for no passing, wide shoulders and in some places a side walk.
Your letter does not ~how that you considered the fact that we'
have an elementary school at the end of our road. But,
interestingly, you do comment on "future expansion of the Town's
,softball fields and picnic grounds" on Aldrich Lane.
I repeat from my initial correspondence, the truck route in
Greenport with no homes on .it is 30 mph and the road connecting
Sound Avenue to Route 25 just one block west of us is 30 mph.
I urge you to do what you can to further reduce the speed limit
on Aldrich Lane so that this road is not the sight of a terrible
accid~t and so that it meets, the changed needs of the community!

the highway and police departments. We are requesting
that the New York State Department of Transportation
do a survey and will proceed accordingly. The survey
from the state is needed because New York State controls
the speed on all roads, Southold Town has no speed laws
in its town code. I realize this is a long drawn out
procedure but unfortuately this is the way it has to
been done. I will keep you informed as to what is
happening.

Dear Mr. Murphy,
I am a resident; of Aldrich Lane in Laurel and very concerned
about the 55 mph speed limit chat now exists.
There currently are twenty one pre-school and school- aged
children living on Aldrich Lane. There's a school at the end of
the block, a new ball field and no sidewalks or even defined
shoulders on this street.
Moores Lane in Greenport shares the status of a truck route with
Aldrich Lane. It too has a school and a ball field. There are
no homes on the street and it has a speed limit of 30 mph.
I would very much appreciate your help in facilitating a
decrease in the speed limit on Aldrich Lane to 30 mph.

Federal Aid Rural Secondary Program
Dear Supervisor Pell:
In June of 1981, we filed applications for h£g~way funds for
two projects in the Town of Southold on the above-captioned federal
aid program. Subsequently, on November 27, 1981, then Commissioner
R.M. Kammerer, forwarded a tentative program indicating projects to be
constructed usin~ this aid to tke New York State Departmen~ of
Transportation. One of tke projects selected is the Aifrich
~roject in the Town of Southold at an estimated total cost
of $530,000.
We have recently learned that this program is taking another
step forward. By now or in the near future, you should be receiving
a letter from Mr. C. Roger Meeker, Chief Engineer for the Suffolk
County Department of Public Works. This letter should indicate
that the Aldrich Lane project has been recommended by SCDPW for
federal aid rural secondary funding. It should also indicate
that the next step in the process is the preparation of a project
initiation report. I have also been advised that NYSDOT is
anxious to initiate the projects under this program and, therefore,
if the Town intends to continue to proceed with this application,
the project initiation' report should be completed very quickly.
We would be pleased to assist the Town in this effort.
Please contact our office if we may be of any further assistance
in this matter.

Dear Mr. Dean:
We have contacted Charles Kitdorf of NYSDOT and Frank Giordano
of SCDPW regarding the proposed Aldrich Lane project. They inform us
that a representative from NYSDOT, Albany, visited prospective projects
in each of the six eastern towns on Friday, June 4,1982. Presently,
work on the Aldrich Lane project is still being considered.
Within the next month the county expects to be contacting and
meeting with each town regarding the preparation of Project Initiation
Reports for each proposed project. At this meeting the county will
outline what information will be needed in these reports. At this time,
they feel certain that traffic and accident data will be required.
When these meetings are arranged, we would be happy to attend if you
so desire.
Regarding the CHIPS Program, we have obtained some additional
information. The county will be conducting a CHIPS presentation for
towns and villages on or about June 24, 1982. We would be happy to
attend this meeting with you or as your representative if you so desire.
If you have any questions regarding these matters, please do not

The New York S~ate Department of Transportation will conduct an infor-
mational center to provide information on the proposed improvement
along Route 25 in the vicinity of Aldrich Lane, in the Township of
Southold.
The accompanying notice will be published as Legal Notice in the Lon~
~sland Traveler-Mattituck W~tchmen, a local newspaper, and in the Suffolk
Edition of the Newsday on Thursday, October 2? of this year informing
the public of this project.

INFOFA~ATIONAL SESSION 'FOR 'PROPOSED 'IMPROVEMENT OF ROUTE 25 IN LAUREL
Regional Director, Austin H. Emery, of the New York State Department
of Transportation, announced today that the Department will conduct an
informational session for thepurpose of providing information to the public
on the proposed improvement along Main Road, Route 25 at Aldrich Lane in
the hamlet of Laurel, Town of Southold.
The project will consist of realigning a ~ mile section of Route 25
to eliminate existing sharp curves in order to provide a safer highway
facility for the motorist where many accidents have occured in the past.
The new construction will consist of one travel lane in each direction
and full width shoulders. Drainage improvements and landscaping compatable
with the area will be included in the contract.
Since this project will be constructed primarily on a new alignment,
right-of-way acquisition will be necessary.
Detail plans and a design report will be available at the meeting.
Engineers and real estate agents from the Department will be on h~Lnd to
explain the project and answer questions.
The public is cordially invited to the information center which is
located in the Laurel Elementary School, Main Road, Laurel, N. Y. on
November 3, 1977 from 3:00 P.M. to 9:00 P.M.
