The following action was taken by the Southold Town
Planning Board, Monday,June 10, 1985.
RESOLVED that the Southold Town Planning Board Qv~rride
the Suffolk County Planning Commission regarding the set-off
of Charles Gillispie located at East Marion.
The Board also requested covenants and restrictions
stating that Lots No. la and 2a are part of Lots 1 and 2
and are not to be considered building lots, as well as,
no further subdivision in perpetuity.
When the above mentioned covenants and restrictions are
prepared, would you please submit them to our office so the
Town Attorney may review them prior t~filing with the County
Clerk.

RESOLVED that the Southold Town Planning Board declare itself
lead agency with regard to the State Environmental Quality Review
Act for the set-off of Charles Gillispie located at East Marion.
RESOLVED that the Southold Town Planning Board approve the
set-off of Charles S. Gillispie located at East Marion for 2 lots
on 6.5 acres located at East Marion, plans dated as last amended
February 19, 1985 subject to the review of the Suffolk County
Planning Commission.

I am in receipt of the letter from the Suffolk County
Planning Commission dated May 3, 1985 forwarded by your office.
I have discussed the matter with Mr. Gillispie and it is
his wish to request that your board override the County's ob-
jections as to item i in that the creation of two separate access
roads to parcels I and 2 would cause an unnecessary financial and
practical hardship and requests that access to Lot # i be handled
as a right-of,way over land of Lot # 2.
As to'item 2, Mr. Gillispie is aware that any residential
use of the structure on Lot # 2 will require an application to
and compliance with the then current regulations of the Suffolk

approximately 4,000 feet northeasterly from
Stars Road, East Marion.
Dear Mr. Orlowski:
The Suffolk County Planning Commission at its regular meeting on May 1,
1985, reviewed the proposed subdivision plat entitled, "Minor Subdivision -
Charles S. Gillispie", referred to it pursuant to Section 1333 of the Suffolk
County Charter. After due study and deliberation it resolved to disapprove said
map for the following reasons:
The proposed subdivtsiom will result in the creation of a landlocked
parcel; that is, a parcel that does not have frontage on an existin~
or proposed public road. The creation of such a lot is contrary to
good subdivision layout principles and creates problems as far as
access by emergency and service equipment is concerned; this could
result in health, safety and welfare problems for the future resi-
dents of this lot. Creation of a landlocked lot also places the
Zoning Board of Appeals in the awkward position of having to grant a
building permit for the lot under Section 280-a of the Town Law as
the future owner of the lot cannot be held responsible for the land-
locked nature of the parcel.
No information was provided to show that this subdivision proposed
was submitted to the Suffolk County Department of Health Services for
its review.
The Commission also offers the following comment on the map for your use and
consideration:
The proposed 20 foot right-of-way should be incorporated into Lot 1 thereby
making it a panhandle lot and giving each lot frontage on a public road.

The Planning Board reviewed the above mentioned set-off at

It was the consensus of the Board to request that the strip
of land along Main Road, labeled as Lot lB on the estate map,
be incorporated to Lot No. 2 of the set-off. This is recommended
so as not to create a separate parcel of the 1022' stri~ since
