EXISTING ACCESS R~D
COM~!ENT$:
~he access from the State Highway into the above subdivision is in a 30 ft.
R.O.W. the road varies from 8 ft. to l0 ft. in width f~ a length of
approximately 600 L.F. It is stabilized, with sand and gravel and is in
fairly good oondition. However, I would recommend that the ]~st 150 ft. be
updated with 2" of the same kind of gravel mixture used in the original road
for a width of l0 ft. According to Mr. Gillispie, topsoil was removed fc~
the total length when the road was constructed quit~ some time ago. The
house on Lot No. 5 has a circular concrete driveway at the north east corner
which would serve as a t~ning area for emergency vehicles. The only other
house in the subdivision (Mr. Gillispie's residence) has access from another
road.

Dear .Mr. Wickham:
~e have received your letter of June 1, 1772, with attachments for the
above referenced project. In reviewing the submission, we find that ~under
our code, this is not a minor subdivision, as it consists of five lots;
therefore, we require a full submission w±th the usual fee of $3~0 per lot.
We would normally require a test ?~ell for this project, however, in in-
specting the site this morning, it was noted that a house is under construc-
tion by G. Ahlers, and we will consider the well for this home as our check
of the availability of a good water supply. Until such time as we have the
water analysis results from this ~-zell snd a complete submission, we are not
in a position to approve this application.
you wish to discuss this further, please contact this office.

Dear Sir:
As you are aware, decision on your proposed minor subdivision
was tabled at the meeting of the Planning Board held on October
5, 1971 for conference with the Town Attorney, as to the legality
of granting a minor subdivision with "sub-lots" and placing
restrictions on them.
Since the date of the meeting of October 5, 1971, your file
has been referr.~d to Robert Tasker, our Town Attorney. Mr.
Tasker has advised us that it would be legal to grant this
minor subdivision under these conditions, providing that
covenants are filed in the County Clerk's Office and a fee
for such is collected.
Please be advised that the f611owing resolution was passed by
the Southold Town Planning Board at their regular meeting held
on October 27, ].971:
"IT WAS RESOLVED that the Southold Town Planning Board grant
final approval to the minor subdivision of David Gillispie,
located at north side of Main Road, East Marion, New York,
subject to the following conditions:
Covenant and Restriction to be in the proper form for
recording in the office of the Suffolk County Clerk,
and fete for recording to be collected by the Planning
Board.?
In rega=d to. the actual covenant, a copy of which we received
from Irving L. Price, Jr., Attorney, you state that "The party
of the second part covenants that neither he nor his heirs or
assigns shall at any time hereafter erect, maintain or permit
any dwelling on Parcel II (iA through 5A in contemplated deeds)
November 1, 1971
and that this covenant shall run with the land and bind the
future owners thereof."
At the last meeting you stated that you wished to covenant
the property against the building of any type of structure
(dwelling, beach house, accessory building, etc.), if this
is the case, it must be clearly defined in the covenant.
Very sincerely,
Wickham, Chairman
