Wells SCTM~ 1000-75-7-1.3, 1.4 & 1.5 Dear Mr. Colgrove: The following took place at the meeting of the Southold Town Planning Board on Monday, October 22, 1990. The final public hearing, which was held at 7:35 P.M., was closed. The following resolution was adopted: WHEREAS, Estate of George Jewett Wells, Timothy Wells and Christopher Miceli are the owners of the property known and designated as SCTM#1000-75-7-1.3, 1.4 & 1.5, located at the west side of South Harbor Road; 1248.26 feet south of Main Road in Southold; and WHEREAS, this minor subdivision, to be known as Estate of George Jewett Wells, Timothy Wells & Christopher Miceli, is for 3 lots on 28.653 acres; and WHEREAS, a variance for insufficient area of Lot 1 was granted by the Zoning Board of Appeals on December 19, 1989; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself Lead Agency and issued a Negative Declaration on March 5, 1990; and Page 3 Estate of George J. Wells WHEREAS, a final public hearing was closed on said subdivision application at the Town Hall, Southold, New York on October 22, 1990; and WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold have been met; and be it therefore, RESOLVED, that the Southold Town Planning Board approve and authorize the Chairman to endorse the final survey dated April 28, 1989. Enclosed please find a copy of the map which was endorsed by the Chairman. The mylar maps, which were also endorsed by the Chairman, must be picked up at this office and filed in the office of the County Clerk. At the time of his death, Mr. Wells owned the two parcels on South Harbor Road which are outlined in orange on the enclosed map. He also owned in common with you the parcel/f/~ adjoining to the north and outlined in blue. As you probably are aware, Mr. Wells' two parcels were at one time part of a larger 30 acre parcel. In 1984, Mr. Wells obtained approval from the Southold Planning Board to set off a 80,000 sq. ft. parcel, which parcel was then conveyed to Robert Halsey Pettit. Thereafter on December 15, 1986, Mr. Wells conveyed a 22 acre parcel (outlined in green on the enclosed map) to Hallockville, Inc., who subsequently sold the development rights to this parcel to the Town of $outhold. It has now come to our attention that Mr. Wells' conveyance to Hallockville, Inc., was made without the approval of the Southold Planning Board and as such Mr. Wells two parcels, of which you now own one, as well as the Hallockville parcel are not legal. Furthermore, since your parcel is less than the zoning ordinance's required 80,000 sq. ft., it has merged together with the parcel you owned in common with Mr. Wells to create one parcel which is of legal size. I spoke to the Southold Town Attorney last week and he advised me that to legalize these parcels it will be necessary for a subdivision application to be filed with the Southold Planning Board requesting approval to subdivide the property into three parcels, one consisting of approximately 4.5 acres PAYNE, WOOD ~ LITTLEJOHN which is owned by the Estate, one consisting of some 22 acres which is owned by Hallockville, Inc. and the other being your merged parcel consisting of some 2 acres. We have contacted Roderick Van Tuyl, PoC. to do the surveying work and will prepare the necessary subdivision application papers. Wells, left for me at his death. At that time, no one gave me any reasoning for the Planning Board's action, and I was quite upset. My letter of December 14th, explains what I had planned to do with the 1.4 acre lot. It also gives you what would be the consequences of your decision as it would effect me. My parents, thoughtfully gave me a subscription to the Suffolk Times, and I was reading this week's issue. I ~ow have some idea as to why this merging of the lots was forced. I only spend about 16 days a year in the Town of Southold at present, we have our own well and I wasn't told of a water problem. I knew that Greenport had a problem and needed Southold water, but that was about it. Perhaps the 2 acre minimum would reduce the amount of people per acre? This would reduce water usuage ofcourse. Yet is it people that are using up so much water, or is it the vineyards that have been buying up so much of the farmland? At least now I don't feel like someone was trying to hurt me with intent. That still doesn't help me with my problem of needing to sell the 1.4 acre lot to raise funds to build a home on my half acre lot. That still will not answer the question I have as to what I can do with so much land after I retire and move to Southold? I knew I had to clear my 1/2 acre, since between ragweed, poisen ivy and sumac, anyone who walks on the property is in peril. What do I do with the remaining land? Plant Christmas trees, a garden, or put lawn in?? Wouldn't that use more water? I certainly don't want to cut that much lawn in my old age? Would someone take the time to explain all the facets of this issue? Could you explain how a 2 acre zoning code will solve Southold's water problems. I still need to sell the 1.4 acre lot to be able to build my retirement home without a mortgage, and use the remaining m~nies to protect our beach cabins as my family shrinks through death and distance. There is a question as to whether the Planning Board can declare a subdivision illegal after it has been on the Town's tax assessor's maps for 4 years prior to this "declaration". There is the fact that your decision has forced Hallockville into a difficult position too. December 18th, 1988 Page 2. You see, Hallockville had a potential buyer for the 22 acres, Mr. Coffey, and I'm sure this decision has put that sale into a "holding position".. Then there is the fact that I just don't want that much land for my home. All the other lots going to the main road are the same size as mine, 1/2 acre, with some variances in feet. It is going to look kind of strange seeing a small house placed on the "L" in the right corner, with grass going back 100 feet, next to a large lot going back 200 feet?? This property is not yet in my possession, and is still held in my Uncle's estate. The 1/2 acre is now mine, legally. I still don't see how you can force this merger, when two separate owners are in place? I wish I could take the time off to drive out and sit down and talk to all of you. I just started a new job and I'm the "key" man, so I can't. So, could you write to me here, or have someone call my home after 7pm. I really don't want to have to argue these issues in court! Then only the lawyers profit. I still plead with you to let my Uncle's subdivision stand. He has done enough for Southold to deserve the consideration. I want to live in Southold as soon as my mother passes on, and perhaps sooner, since she has said that she'll try to move to Southold as soon as my Dad passes away. He is the oldest of all the Wells brothers, and is the last one alive. Yet, my Mom wants a house close to town, and doesn't want the 1.4 acre lot. There is proof of my family's intent on moving to Southold, my mother tried to buy a home last year that fell through when a "bridge loan" proved to be much more involved than what the real estate broker led my parents to know. Don't think I don't understand that family desires and emotions can't be the basis for your changing your minds, but they do reflect our sincerity. At this time, I have to wait for the 1.4 acre lot to be released from my Uncle's estate, before being forced to seek any decision in the courts. I have discussed your "merger" with my parents, and they also hope that you will change your minds and let me proceed with my plans. Then they also express their concern that your actions may jeopardise Hallockville. They would also like you to reconsider your decision. They wonder why you never contacted me and I had to find out about all this on a second hand basis from a lawyer for my Uncle's estate??? If you must meet with all of us, let me know. It is important enough to take a day to drive out and meet with you. If we can talk on the phone, you can call my home number at night on a collect basis. I want to work this out. Would you let me build on my half acre if Hallockville gave .6 acres back to me to permit the sale of the 1.4 acre lot? That is the only other possible way I could see to resolve this. Yet I'm sure Hallockville would not want to do this? I would also like information on how this 2 acre minimum can resolve the town's water problems. Wells' estate. This letter reflects a decision made by all of you. Also review the copy of the town map that I was given when the deed for Lot 15, was transferred to me in the form of tenants in common, by my Uncle, who wished to remain listed to pay the taxes of the property. SO... now that we have all read the lawyer's letter, and have seen the map that was issued by the assessor's office, I'd like to have you grant me the time to make you understand what your decision has done to me. For starters, the 1/2 acre lot #15, was given to me as a result of a conversation that took place driving back from closing our beach cabins that are off Old Wood Path. The properties are held under the name of The Wells South Harbor Corporation. I am the only member of my generation of the Wells family that is a stockholder, and I'm also the only member who is an officer of this Corporation. I'm the Secretary/ Ass't Treasurer. The reason the land was given to me, was my expressing my concern as to who would care for the cabins after my Uncle passed away. He had said that he had purchased this lot and since I said I'd like to retire on a small piece of property, he would list me as joint owner, but would pay the taxes until he died. You see, I was closer to my Uncle George Wells, than most of the family. For years I had opened and closed the cabins with him, and spent my vacations doing maintenance on the property. I had earned his respect and shared his love for our beach cabins. At the time the land was given to me, the zoning board required a minimum 80' x 100' for a single family residence. I have a copy of the Town of Southold zoning regulations for that period. The Lot #15, was 108' x 105', and fully complied with the zoning regulations of that time. My parents were always the Executors of Uncle George's estate. At the time the 1/2 acre lot was given to me, I was to receive over $50,000. in bonds at the time of George J. Wells' death. These bonds would allow me money for the purpose of building a small home. Yet.. when my Uncle saw the opportunity to obtain the "Village Green" for the Town of Southold, he had to raise cash very quickly, and those bonds had to be sold. Town of Southold Planning Board Page 2. December 14th, 1988 So, in his effort to do something good for the Town of Southold, my inheritance had to be sacrificed. Anyone who has known George J. Wells, knows that he had stood for the benefit of all people. His gift of land to Hallockville, and his gift of the Village Green to the Town of Southold are only part of the proof of this. If you could see his last will, there are many other areas that his genero~sity will touch. The 1.4 acre lot was taxed separately by the town since 1984. My lot #15, is taxed separately. I'm sure that my Uncle left me the 1.4 acre lot as a means of replacing the lost bonds I was due to inherit. You see~ was devastated by a divorce in 1981. My crime? I worked 80 hour§-~o build a business, which are hours my Uncle has put it as well. Yet, between the loss of all my assets, and a monthly support payment in excess of $650.00 a month, my Uncle knew I was crippled in a financial sense. Yet.. after being forced to live in a room for five years, I have started to recover. I have met another woman who my Uncle liked alot, and together, both being divorcees, we have started to rebuild. Still, I only have about 50K, with the b~lk of it in retirement vehicles. I will not have the money to build my house in Southold. The appraised value of the 1.4 acre lot is $110,000. When I was told that I inherited it, I talked to my mother and father, and we all agreed that I should sell it for as close a figure to the one above, that I could get. My brother Deter, and sister, Cara, each got $25,000. from my Uncle. I would invest the money, and use the interest for two purposes. 1. Neither my brother or sister, or Billy R. Wells, the next generation of my family, are successful or financially secure. I would use the interest to offset the lack of usuage that is currently fine with my Aunt Fran and parents being alive. We charge eachother $20.00 a day to stay at our cabins, to pay the expenses. With the next generation being primarily on the West Coast, ( California and Washington ), the problem of lack of usuage will either force the future stockholders to pay over $1,000. a year for something that they can't enjoy, or we must rent out the cabins for two months of the season. I would use the interest to keep the annual assessment affordable. 2. I must stay here until my mother passes away, as I'm the only son who is responsible and living here. When she does pass away, I want to leave my "rat race life" of 14-16 hour work days and move to Southold. I have a daughter in college now too, and need to earn the 40-50K a year I do by staying in the "rat race". I have another daughter who will enter college one year after the older daughter finishes. I should be able to come to Southold when I'm 45, and still young enough to build an income there. I would have had the money from the sale of the 1.4 acre lot, and any interest, to build my house. With my home paid for, and only taxes and living expenses, I could do just about anything. YET... These plans are now all in serious jeopardy! As a result of my Uncle's generosity to the Town of Southotd, and the Town's Planning Board trying to force me to accept a 2 acre lot by merging the two properties, I will probably never be ~able to come home to Southold or fulfill the plans I have made for my future! December 14th, 1988 Page 3. Town of Southold Planning Board. I'm sure the Town will raise taxes and increase the cost of $745.46 I would pay for the combined taxes of my two properties. The tax on the 1/2 acre lot is only $248.81 a year. I will be hard pressed to pay those taxes with a daughter in college for the next eight - nine years? Since I must protect the beach cabins at all costs, you will force me to sell the 1.9 acre lot you propose! At least then, I will have money to keep the cabins in the family. YET.. I may never be able to come home to Southold? I may die here, since I recently had to quit a job where my time demands were 6:30 am til 9 pm five days a week. The stress was bad.. but when I lost Uncles George, Dick, and Bob Vroom in just six months., and Aunt Fran almost died about a month ago.. I just couldn't take it. I have been at the job who's number is on the first page, since October 17th. You can call there and confirm it. You have hurt me terribly., can you see it now. I don't want to come to Southold with a mortgage. There is not the kind of work that I do there. I'm an expert in high frequency welding of plastics, I work in factories. Just how many factories do you have in town that use my expertise? I may have to go back to fixing cars., like I did when I worked my way through college. So.. I guess you can see I'm not a lawyer? I wanted to share the personal crisis of your decision with you. I wanted you to see that I must fight your decision and call my parents for any financial help needed to take you to court. Jesus! My Uncle gave you so much and this is the way you return your gratitude? I lost my inheritance on that Village Green! Yet I was so happy that you celebrated my Uncle's generosity as I stood by and watched the celebration. I took him to dinner at the Chinese place and that was the last time I saw my Uncle alive. He was a quiet man who did big things, and I guess after you held your celebra- tion, he felt it was time to die. He WORKED himself to death in the awful July heat, dieing yarn for his rugs. So.. I'm begging you.. before I have to exercise the courts and waste money fighting your decision, please change your minds... A. Let me sell the 1.4 acre lot, both Mr. Coffey, the landscaper, and a friend of Skip Pettit, Robert Pettit's son, have expressed interest in buying it. This will allow me to protect the next generation. B. Let me build my little house on my 1/2 acre, just the way Uncle George and I planned it. It will be two bedrooms, with a large garage for a workshop. C. Let Hallockville have its 22 acres, since it was my Uncle's dream that a working early 1900s farm could be made, and the Southold Historical Society didn't want to do it. It has now come to our attention that Mr. Wells' conveyance to Hallockville, Inc., was made without the approval of the Southold Planning Board and as such Mr. Wells two parcels, of which you now own one, as well as the Hallockville parcel are not legal. Furthermore, since your parcel is less than the zoning ordinance's required 80,000 sq. ft., it has merged together with the parcel you owned in common with Mr. Wells to create one parcel which is of legal size. I spoke to the Southold Town Attorney last week and he advised me that to legalize these parcels it will be necessary for a subdivision application to be filed with the Southold Planning Board requesting approval to subdivide the property into three parcels, one consisting of approximately 4.5 acres PAYNE, WOOD ~3, LITTLE,JOHN which is owned by the Estate, one consisting of some 22 acres which is owned by Hallockville, Inc. and the other being your merged parcel consisting of some 2 acres. We have contacted Roderick Van Tuyl, P.C. to do the surveying work and will prepare the necessary subdivision application papers. Because you and Hallockville, Inc. own part of the property which is the subject of this application, we will need both of you to join in the application.
