Board, Monday, August 25, 1986.
RESOLVED that the Southold Town Planning Board approve the
set-off for Rosalie Gowen located at Zena Road between Central
Drive and Capt. Kidd Drive, Mattituck for two lots on 31,740
square feet (tax map no. 1000-106-2-32 and 43, subject to:
1. Receipt of approval from the Suffolk County Department
of Health Services pursuant to Article 6.
2. Receipt of amended surveys stating "set-off" rather than
"lot-line change".

Dear Ms. Gowen:
This Department is in receipt of a realty subdivision
application for the above referenced property.
Under Article 6 of our Sanitary Code, subdivision maps
previously apprqved by the Health Department and filed with the
County Clerk are exempt from the new density standards of one
dwelling (one subsurface sewage disposal system) per acre/~ acre
provided the map is not abandoned. The subject property appears
on a Health Department approved map as three parcel(s).
The proposal for two parcel(s) does not constitute an
increase in density and, therefore, individual applications for
each lot as shown will be accepted.

Department of Health Services is necessary prl~or to
advertising this matter for a public hearing.

The Board has concerns with regard to the lot which
is proposed, since it is obvious from the original 6ons~ructiOn
that the owner did not have any intent to make two lots.
The Board recommends that the parcel remain as one
building lot.

Dear Gail:
This letter will acknowledge receipt of the above variance
application and is to advise you that the board members will be
conducting field inspections and environmental reviews as may
be required by State and local laws prior to scheduling this
application for a public hearing.
In reviewing the survey map as amended August 16, 1985, it
is noted that proposed Parcel #2 may require an additional
variance for excessive lot coverage for all existing structures.
We ask that you contact the building inspector for his determina-
tion in this regard, and then furnish us with a copy of same
together with the total area for each parcel as proposed.
In the interim, please proceed with the Planning Board in
order that they may submit their written comments and/or action
to our office as early as possible.
Please don't hesitate to call our office if you have any

WHEREAS, a public hearing was held and concluded on March 13, 1986,

WHEREAS, the board members have personally viewed and are familiar
with the premises in question, its present use and classification in the
"A" Residential and Agricultural Zoning Distr;ct, and
WHEREAS, the board has considered all testimony and documentation
submitted concerning this application; and
WHEREAS, the board made the following findings of fact:
1. By this application, appellant requests a Variance from the
provisions of Article III, Section 100-31, Bulk Schedule of the Zoning
Code for insufficient area, width and depth of two parcels proposed
on this 31,740 sq. ft. tract of land, of: (a) 13,824 sq. ft. in
area, 106.65 frontage along Zena Road, and depth of 133.59 feet for
proposed Parcel #1 (to the south), and (b) 17,916 sq. ft. in
area, 135.77' frontage along Central Drive and 91.67' along Zena
Road, and depth of 133.59 feet.
2. The premises in question consists of an area of 31,740 sq.
ft. with 198.23' frontage along Zena Road and average lot depth of
107.52 feet.

familiar with the premises in question, its present zoning, and

WHEREAS, at said hearing all those who desired to be heard
were heard, and their testimony was recorded; and
WHEREAS, the board has ~arefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the board made the following findings of fact:
1. By this application, appellant requests reconsideration
of a recent decision rendered by ~his board under Appeal No. 3450
for a Variance from the Provisions of Article III, Section lO0-31,
Bulk Schedul6, of the Zoning Code, for approval of' insufficient
area, width and depth of two parcels proposed on this 31,740 sq.
ft. tract of land, as follows: (a) 13,824 sq. ft. in lot area,
106.65 frontage along Zena'Road, and depth of 133.59 feet for
proposed Parcel ~1 (to the south), and (b) 17,916 sq. ft. in
lot area, 135.77 ft. frontage along Cedar Drive, and 91.67 ft.
along Zena Road, and depth of 1.33.59 feet.
2. The subject premises is identified on the Suffolk County
Tax Maps as District 1000, Section 106, Block 2, Lots 32 and 43,

and is shown on a Map of "Cpt. Kidd Estates" filed January 19,
1949 as Lots #134, #154 and #153. The northerly half of the
subject premises is improved with a single-family dwelling set
back 35 feet from Zena Road at its nearest point, 37 feet from
Central Drive, 22 feet from the proposed division line, and
with an accessory garage.
3. Submitted for the record is communications from the
Suffolk County Department of Health Services indicating that
the proposal does not constitute an increase in density since
the 1949 Map filed with the County Clerk are exempt from new
density standards provided the map is not abandoned. It is also
noted that the Captain Kidd Estates Map was approved on Novem-
ber 3, 1948 by the Southold Town Board.
4. Also submitted for the record is communications dated
May 2, 1986 from Captain Kidd Water Company, Inc. indicating
that water service can and will be from an existing water main
for the two lots.
5. In viewing the immediate area, the board finds all
of the lots on this block to be of a size similar to that
proposed by this re-division, and the existing dwellings are
serviced by a community water system (Captain Kidd Water Company,
Inc.).
In considering this appeal, the board finds and determines:
(a) the lots as proposed are similar in size to those existing
in the block and therefore there will be no substantial change
in the character of the immediate area; (b) the circumstances
are unique; (c) the practical difficulties are sufficient to
warrant the granting of this variance; (d) there is no other
method feasible for appellant to pursue; (e) there will be
no effect on available governmental facilities; (f) in view
of the manner in which the difficulties arose and in consider-
ing all the above factors, the interests of justice will best
be serv6d by allowing the variance, as noted below.
Accordingly, on motion by Mr. Sawicki, seconded by
Mr. Doyen, it was_
RESOLVED, that the relief requested under Appeal No. 3517
in the Matter of the Application of ROSALIE GOWEN for approval
of insufficient lot area, width and depth of Parcels #1 and
#2, as shown by survey map amended August 16, 1985, prepared
by Roderick VanTuyl, P.C., SUBJECT TO THE FOLLOWING CONDITIONS:
1. No setback reductions to less than that permitted by
Column "A" of the Bulk Schedule of the Zoning Code;
2. Water service must be supplied and serviced by the
public water utility company (presently Captain Kidd Water
Company, Inc.) for proposed Parcel #1.

3. The subject premises also consists of Lots #134, #154, and
#153 as shown on a Map of Cpt. Kidd Estates which was filed January 19,
1949, prior to the enactment of the zoning code. The northerly half
of the premises is improved with an accessory garage and one-story
single family dwelling set back 35' from Zena Road at its nearest
point, 37' from Central Drive, and 22' from the proposed division line.
4. For the record, it is noted that a Certificate of Occu-
pancy #Z-5687 for the accessory garage was issued December 10, 1973
and Certificate of Occupancy #Z-1100 for an easterly 16' addition
was issued during June of 1960. It is the board's belief that the
dwelling as constructed over the old subdivision line between Lots
#134 and #154 preexists the enactment of zoning in 1957.
5. It is the opinion of the board that this congested area
is a very fragile and environmentally sensitive area, and without
proof as to the availability of a public/community water-supply
system and appropriate approvals from the Suffolk County Department
of Health Services, including but not limited to Article VI, a
variance is not warranted.
6. It is also the opinion of the board that although the
area consists of lots similar in size, the existing dwellings have
been serviced by a community water system since on or about the
time of their construction.
In considering this appeal, the board finds and determines:
(a) that the relief requested is substantial in relation to the
zoning requirements, meeting less than 20% of the lot area require-
ment of 80,000 sq. ft.; (b) that the circumstances are not unique
except that the subdivision pre-dates the zoning ordinances; (c)
the granting of the variance would amount to "ad hoc" planning and
create a precedent for the entire town which could well lead to
further substandard parcels and would in turn cause a substantial
efect of increased population density and be adverse to the safety,
health, welfare, comfort, convenience and order of the town; (d)
that the practical difficulties shown are not sufficient as applied~
(e) that the interests of justice will be served by denying the
variance as applied.
Accordingly, on motion by Mr. Grigonis, seconded by
Mr. Douglass, it was
RESOLVED, that the relief requested under Appeal No. 3450
in the Matter of the Application of ROSALIE GOWEN for approval
of insufficient area, width and depth, BE AND HEREBY IS DENIED
WITHOUT PREJUDICE, as applied.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis, Doyen,
and Douglass. (Absent was: Member Sawicki.) This resolution was
duly adopted.
