No. 4627. - BARRY CHARLES PARCEL 1000-63-7-14 STREET & LOCALITY: 365 Peck Place, Southold DATE OF PUBLIC HEARING: November 19, 1998; January 21, 1999 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The applicant's property is located along the northerly side of Peck Place, Southold. The property consists of a total area of 23,625 sq. ft., with 175 ft. frontage along Peck Lane. The lot is referred to as Lot No. 14 on the Map of Harbor Homes Estates, Sec. One filed July 18, 1969 with the Suffolk County Clerk. The March 8, 1998 survey prepared by Harold F. Tranchon, Jr., P.c. shows a single-family under construction, with setbacks approved at 40.2 ft. from the southerly front property line, 35 ft. from the westerly side property line, is in excess of 35 feet from the easterly side property line, and 50.3 feet from the rear property line (at its closest points). BASIS OF APPLICATION: Building Inspector's September 10, 1998 Notice of Disapproval, which reads as follows: "the proposed addition being located on a non- conforming lot of approXimately 23,625 sq. ft. in an R-40 District is required to have a rear yard setback of 50 feet, Article XXIV, 100-244B. AREA VARIANCE RELIEF REOUESTED: Applicant is requesting a 44.3 ft. rear yard setback for a proposed 20 ft. by 16 ft. open, unroofed deck ("open to the sky") six feet past the 50.3 ft. setback of the house. No other reasons for disapproval of a building permit for the deck addition were noted. REASONS FOR BOARD ACTION, DESCRIBED BELOW: (1) The granting of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because the deck addition would extend only 5.7 feet beyond the existing 50.3 feet of the dwelling. The appliamt's property is a vacant lot bounded on the north and east by an unpaved, traveled road off Wiggins Lane, Greenport, and bounded on the west bya dredged canal (without bulkheading or other type of seawall). The lot is 13,'789 sq. ft. in area. BASIS OF APPEAL: Building Inspector's. August 26, 1998 Notice of Disapproval citing Section 100-244B. . Applicant applied for a building permit to construct a single-family dwelling with a front yard setback at less than the required 35 feet. REUEF REOUESTED BY APPUCANT: Applicant requests a reduction in the northerly front yard setback from 35 feet to 24.4 feet at its closest point. REASONS FOR BOARD ACTION. DESCRIBED BELOW: On the basis of testimony presented and personal inspection, the Board makes the following findings: (1) Applicant proposes to build a house which front will face east. The northerly side of the house will be 24.4 feet from the front property line abutting the private roadway. Because the northerly yard abuts the private road and is treated as a front yard, a setback of 35 feet is required. The setback requirements are satisfied on the easterly (35.5 feet) yard and southerly (10 feet) side. Given the size and shape of the lot, and applicant's desire to place the house above the 10-foot contour line, a variiilOce. for the northern . setback is needed in order for applicant to build a house of rea~onable size. (2) . Although the private road is shown on the survey as 50 feet wide, the lane actually traveled is about 10 feet wide. Consequently, the distance from the northerly side: of the proposed house to the traveled lane is more than 45 feet. The roadway serves two properties to the south of applicant's lot, and then ends. AREA VARIANCE RELIEF REOUESTED: Applicant is requesting a rear yard setback from a corner of the dwelling at 32.1 feet, at its closest point to the rear property line. The remaining corners of the dwelling are shown to be a minimum of 35 feet from the rear property line. REASONS FOR BOARD ACTION, DESCRIBED BELOW: (1) The granting of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because the amount of relief requested is due to construction under a building permit. (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance. FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The subject lot is 90. ft. by 165 ft., or a total of 14,850 sq. ft. in area. The property is improved with a single-family frame dwelling located 47+- feet from the westerly front property line. Since the March 31, 1992 survey, repair/renovation work was completed on the dwelling as noted on the Certificate of Occupancy No. Z-21183. BASIS OF APPLICATION: Building Inspector's October 8, 1998 Notice of Disapproval, regarding ArtideIIIA, Section l00-30AA for the reason that this accessory (shed) building is proposed to be located in an area other than the required rear yard. (No other areas of the zoning code were addressed.) AREA VARIANCE RELIEF REOUESTED: To locate an 18 ft. wide by 12 ft. deep accessory shed at five (5) feet from the easterly front property line, at its closest point. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented and personal inspection, the Board makes the following findings: (1) The lot size and shape are typical of the neighborhood. All of the lots on the easterly side of Oak Drive and on the westerly side of Reydon Drive back up on the 25-foot unnamed private road (of which the paved width is about 10 feet). That road is used as a sort of alley for vehicular access to the houses abutting it, and many of those houses have garages facing on the private road.
