WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
considerafion paid by the party of the second part, does hereby grant and release unto the party of the
second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being in Peconic, Town of Southold, County of Suffolk and State of New York, bounded and
described as follows:
BEGINNING at a point on the northwesterly side of Main Road S.R. 25 distant 688.18 feet northeasterly as
measured along the northwesterly side of Main Road from the comer formed by the intersecfion of the
northwesterly side of Main Road and the northeasterly side of Peconic Lane; RUNNING THENCE North
43° 43' 22" West 247.36 feet; THENCE South 46° 16' 38" West 674.59 feet to the northeasterly side of Peconic
Lane; THENCE North 43° 43' 38" West along the northeasterly side of Peconic Lane 436.35 feet to land now
or formerly of the Town of Southold; THENCE along the last menfioned land the following two (2) courses
and distances:
1. North 37° 48' 22" East 408.00 feet;
2. North 43° 43' 38" West 250.00 feet to land now or formerly of School Dist. No. 5;
THENCE along land now or formerly of School Dist. No. $ the following two (2) courses and distances:
1. North 37° 48' 22" East 80.07 feet;
2. North 43° 49' 20" West 144.20 feet to land now or formerly of James A. Quinn and wife;
THENCE North 38° 00' 44" East along the last mentioned land 279.57 feet to land now or formerly of Frank
Chichanowicz and the Town of Southold; THENCE North 37° 43' 39" East along the last mentioned land
470.42 feet; THENCE South 38° 13' 51" East still along the last menfioned land and along land now or
formerly of Lorraine Dunkhuber 1207.60 feet to the northwesterly side of Main Road; THENCE
southwesterly along the northwesterly side of Main Road along the arc of a curve beating to the right
having a radius of 2265.61 feet a distance along said curve of 360.50 feet to the point or place of
BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the grantor herein by deed dated January
24, 2001, from Reynold Blum, which deed was recorded in the Suffolk County Clerk's Office on February 2,
2001 in Liber D00012100 of Deeds at page 732.
SUBJECT TO a mortgage in the original and current prindpal amount of $1,000,000, dated January 24, 2001,
from Michael Lynne, as Mortgagor, to Reynold, Blum as Mortgagee, which mortgage was recorded in the
Suffolk County Clerk's Office on February 2, 2001 in Liber M00019820 of Mortgages at page 175
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE
AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any whatever, except as aforesaid.
^ND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using a.ny part of the total of
the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
