PROPERTY FACTS/DESCRIPTION: The applicant's 23,500 sq. ft. parcel has 100 feet along the north side of Aquaview Avenue, and 140 feet along the east side of Rocky Point Road (formerly Sound Avenue), in East Marion. The property is improved with a single-family, two-story dwelling as shown on the survey prepared by Kenneth H. Beckman with a ZBA date-stamp August 9, 2005. BASIS OF APPLICATION: Building Department's July 11, 2005 Notice of Disapproval, citing Section 100-239.3 in its denial of an application for a building permit to construct a proposed deck addition at less than the code-required 100 feet from the top of the bluff. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 20, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct an open, one-story deck addition at the north side of their home, facing the Long Island Sound, and furnished two different proposals (site and construction diagrams for Deck #1 at 52.3 feet and 60 feet to the top bluff line, and alternative site and construction diagrams for Deck #2 at 60.8 and 61.4 feet, at its closest points). REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The property contains restricted areas related to the bluff and by the fact the property has two front yards and one side yard. Most of the lots along Page 2—October 27, 2005 • ZB File Ref.5700!-A. and A. Monaco • CTM 21-2-11 the bluff have more side yard area and less front yard, and are not defined as corner lots under the zoning code. A raised deck will require less construction activity and less disturbance than a patio, which is not restricted by setbacks when built at grade level in the ground. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the buildable area of the lot is restricted in the side yard and rear yard due to the bluff and grade of the land. 3. The variance granted herein is not substantial. 4. The difficulty has been self-created. The contours of the lot require mitigation to prevent damage to the bluff as a top priority, and the applicant has proposed to mitigate and prevent damage to the bluff area in this application. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an open deck addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Chairwoman Oliva, and duly carried, to GRANT the variance as applied for, shown on the applicant's survey map prepared by Kenneth H. Beckman, and rough construction diagrams labeled "deck #2", subject to the following condition: That the deck remain open to the sky. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. After fourteen years since we purchased the property, we are 75% constructed, and getting closer to realizing our dream. It has come to my attention that due to the following circumstances we are unable to build a patio on grade and are asking for permission to build a raised deck. The raised deck will allow rain and melting snow to flow under the deck, away from the house and away from the coastal erosion zone to an open grated "on grade basin". The home is currently under construction and this basin and the "grades" were requested by the Town to control rain water flow. If we were to install an on grade patio it would disrupt the flow of water to the basin and cause pooling and flooding against the patio which could lead to water flowing against the house, causing basement leaks and/or water to flow into the coastal erosion zone. Another advantage of the deck versus a patio is that a deck will increase the area of absorption of rain water into the soil whereas a patio would decrease the area of available soil absorption. In our application we have submitted an alternative location and reduced the deck size for your consideration. This would move the deck further away from the top of the bluff, which is to the northwest. Thank you for your help with the application process and your time to take this matter into consideration.
