(631) 765-1809• Fax (631) 765-9064 cc.9 ersofrat.1 Southold Town Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF JULY 21, 2005 ZBA File No. 5718: PATRICIA MILONE Property Location: 3500 Nassau Point Road, Cutchogue; CTM 111-4-33. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 35,252 square foot parcel has 106.98 feet along a tie line at Wunneweta Road and 100.25 feet along Nassau Point Road, 375 feet along the northerly side line and 330 feet along the southerly side line, as shown on the June 3, 2004 survey prepared by Peconic Surveyors, P.C. The 2004 survey also shows that the property is improved with a one-story frame house and garage, swimming pool, decks. BASIS OF APPLICATION: Building Department's Notice of Disapproval, amended April 29, 2005, concerning a proposed accessory garage to be located in a yard other than the code- required rear yard. The reason stated in the disapproval is that the accessory garage is proposed to be placed within the footprint of a nonconforming accessory cottage, demolished under building permit #29964Z, and located on a nonconforming lot with two front yards, in the R-40 Zone, is not permitted pursuant to Article IIIA, Section 100-33, which states that such structures are required to be located in the rear yard, and that the proposed garage is noted as being located in the front yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on June 2, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct a 30' x 35'8" x 26' x 11.7' x 24' accessory garage with 1023 sq. ft. of first floor storage/parking area and partial second floor storage area, as shown on the April 21, 2005 plans, sheets 1-6, prepared by M. Hand and the June 3, 2004 survey prepared by Peconic Surveyors, P.C. The applicants' Page2—July 21,2005 • ZB File No. 5718—Patricia Milone CTM 111-4-33 diagrams show a requested height at 26'1" to the top of the ridge for consideration in this variance application. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal inspections, the Board makes the following findings: 1. Grant of the variance as modified and with conditions will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existing house, and the proposed accessory garage, are between two parallel roads with access through only one if the two front yards. A framed accessory garage building exists in the yard area immediately adjacent to this property approximately 14 feet to the south. Also, there was an accessory cottage building existing on applicant's property in the area requested for this new garage. The location for the new accessory garage is reasonable , as proposed, in an area that is wooded, in front of the house. 2. The benefit sought by the applicant of an accessory garage, as modified, cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The Zoning Code defines the yards on the applicant's property as two front yards and two side yards. There is no defined rear yard available to meet the yard requirements of Section 100-33 for placement of an accessory building. 3. The difficulty was not self-created. There was a recently demolished non-conforming structure in that location, which was located in the front yard as shown on the February 16, 2000 survey prepared by Stanley J. Isaksen, Jr. and there is no defined rear yard available to meet the yard requirements of Section 100-33. 4. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The character of the neighborhood could be significantly affected by the placing of the accessory garage in the requested location. Any adverse impact on the neighborhood can be avoided if the structure is located 10 feet to the north of the proposed location. 5. Grant of variance relief as modified is the minimum action necessary to enable the applicant to enjoy the benefit of an accessory garage. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Oliva, seconded by Member Goehringer, and duly carried, to RESOLVED, to DENY the variance as applied for, and to GRANT ALTERNATIVE RELIEF for a proposed accessory garage in a location 25 feet from the southerly property line at its closest point (instead of 10 feet as proposed), and at least 65 feet from the westerly front yard line, SUBJECT TO THE FOLLOWING CONDITIONS: 1. The height of the building shall be lowered to 24 ft. to the top of the roof ridge. 3. That the accessory building shall be used as proposed by the owner as her garage and limited to accessory storage purposes. 4. No windows shall be placed on the second floor of the building at the structure's southern side. 5. That mature plantings at a minimum of six feet in height, ten feet apart, for the length of the garage plus an additional length of ten (10) feet to the east, past the garage. Plantings at an alternative height greater than six (6) feet are permitted. All plantings shall be maintained in good condition, and replaced by the owner in the event the plantings become diseased or unhealthy. 6. That the septic system which serviced the former accessory cottage shall be filled in and safely closed and abandoned, if the applicant has not already done so This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
