HomeMy WebLinkAboutSunbeau AssociatesThe Nr~th Fork Bank & Trust Co July 24, 1988 Town Board Town of Southold Southold, New York 11971 Re: Performance Bond $169,155.00 Subdivision Map of "Sunbeau Associates" Letter of Credit #M-8861 Dear Board Members: By order of Sunbow Associates, and for account of same, we hereby establish this Irrevocable Letter of Credit in your favor up to the aggregate amount of One Hundred Sixty-nine Thousand One Hundred Fifty-five and NO/100 ($169,155.00) U.S. Dollars available by your drafts at sight accompanied by: A certified copy of the resolution of the Town Board, certified by the Town Clerk which indicates: "Sunbow Associates has failed to complete all of the improvements to be completed by Sunbow Associates with regard to a subdivision map entitled 'Map of Sunbeau Associates', heretofore approved by the Planning Board of the Town of Southold on April 26, 1988, and that as a result of said failure, there is due and owing an amount equal to the face amount of our attached draft. We further certify that the amount drawn hereunder is for the sole purpose of completing those items of improvements which were to have been completed by Sunbow Associates." This Letter of Credit must be presented for payment by the beneficiary at our counters at 9025 Route 25, Mattituck, New York 11952, not earlier than September 1, 1988, nor later than July 31, 1989 and all drafts drawn thereunder must be negotiated on or before that date. Each draft must state that it is "Drawn Under Letter of Credit #M-8861 of The North Fork Bank and Trust Company dated July 24, 1988" and the amount endorsed on this Letter of Credit. We hereby agree with the drawers, endorsers and bona fide holders of drafts drawn under and in compliance with the terms of this Letter of Credit that such drafts will be duly honored upon presentation to the drawee. Except so far as otherwise expressly stated, this Letter of Credit is subject to the Uniform Customs and Practice for Documentary Credits (1983 Revision), International Chamber of Commerce Publication #400. Dear Mrs. Terry: The following actions were taken by the Southold Town Planning Board on Monday, June 19, 1989. RESOLVED that the Southold Town Planning Board recommend the revised Bond Estimate of $99,150.00 for Sunbeau Associates, to the Town Board for their approval. Please note that a Letter of Credit for the amount of the previous bond estimate, $169,155.00, has been submitted to the Town Clerk's office. The applicant has requested that this Letter of Credit be used to cover the revised Bond Estimate. RESOLVED that the Southold Town Planning Board approve this subdivision, map dated May 31, 1989. RESOLVED that the Southold Town Planning Board authorize the Chairman to endorse the maps dated May 31, 1989 upon completion of the following condition: A. Payment of the inspection fee which equals six (6%) percent of the approved bond ($99,150.00). Conditional approval of a final plat shall expire within 180 days after the date of the resolution granting conditional approval, unless such requirements have been certified as completed.
