Gentlemen:
We hereby establish our Irrevocable Letter of Credit #M-8830 in your favor
and authorize you to draw upon this Bank up to an aggregate amount of One
Hundred Four Thousand Five Hundred and NO/100 ($104,500.00) U.S. Dollars.
Said monies to the extent necessary to complete the improvements
hereinafter set forth and referred to herein shall be paid upon demand by
the Town Board to complete improvements to the subdivision known as
Grandvtew Estates, Orient, Town of Southold, New York.
Funds under this Letter of Credit are available against the Town's draft
on us presented at our office at 9025 Route 25, Mattituck, New York, no
later than January 21st, 1989. All drafts drawn hereunder must all also
be accompanied by the Town's signed statement certifying that the amount
drawn represents sums due under or in connection with the Performance Bond
of Harold Reese Jr., Ronald Reese and Christine Reese.
This Letter of Credit is not transferrable.
This Letter of Credit #M-8830 replaces and supersedes Letter of Credit
#M-8686 dated January 21, 1987.
This credit is subject to the Uniform Customs and Practices for
Documentary Credits (1984 Revision), International Chamber of Commerce
Publication #400, except as expressly provided herein.

Dear Mr. Reese:
The letters of credit for each of the above named
subdivisions expired as of January 21, 1988. Inasmuchas the
outstanding work remains uncompleted, the Planning Board cannot
recommend release of the bond.
The Planning Board has extended the performance guarantee
for one year (see enclosed copies of resolutions). However, this
office has not received the new letters of credit from the North
Fork Bank and Trust Co.
Your cooperation in this matter would be greatly
appreciated.

Attached is a copy of the Planning Board resolution that extended letter
of Credit for Hillcrest Estates, Section I.
However, a new letter of credit has not been received for Grandview
Estates. This matter is being pursued by the Planning Board.

Dear Mrs. Terry:
The following action was taken by the Southold Town Planning
Board on Monday, January 11, 1988.
RESOLVED that the Southold Town Planning Board recommends that
the Town Board renew the Letter of Credit for Hillcrest Estates, Section
I for a one-year period from January 21, 1988 to January 21, 1989.
It is also stipulated that all of the improvements as noted in the bond
estimate must be completed on or before July 21, 1988 failing which the
Planning Board will recommend to the Town Board that the Letter
of Credit be called.

This Letter of Credit is not transferrable.

Reduction of letter of credit
/'he bond estimate dated November 8, 1981 was submitted for $400,000.
$75,000 of this amount (increase costs over a 3 year period) was deleted
provided the work was done in one year. The bond estimate, now a letter of
credit is recorded at $325,000.
Work as shown in the bond estimate has been completed with exception of the
following:
Asphalt top course on all roads.
Asphalt pavement was not estimated fnr this project. It was based on
the Tow~ standard 36 ft. width pulvermix road. Asphalt paving was
not considered in 198~ when the bond estimate was done. The standard
road is shown at $~]1,000. The road as constructed is 28 ft. in width
with an asphalt top and binder course on a pulvermix base. The top
course for the length of 3700 ft. as shown and 28 ft. wide, would be
11,510 S.Y.%12=959 tons.
959 tons at $35/ton amounts to say ......................... $
