(631) 765-1809•Fax 1631) 765-9064 APR 1 22005 �t-/ FINDINGS, DELIBERATIONS AND DETERMINATION I.`f _ _— MEETING OF MARCH 10, 2005 Southold Town Clerk ZB Ref. 5646 —ANTHONY AND MARIA KOSTOULAS Property Location: 1035 Aquaview Avenue, East Marion CTM 21-2-13 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' 10,872 sq. ft. parcel has 60 feet along the north side of Aquaview Avenue, East Marion, and is improved with a two-story frame house as shown on the November 2, 2004 survey, amended November 18, 2004 by John T. Metzger, L.S. BASIS OF APPLICATION: Building Department's September 2, 2004 Notice of Disapproval, amended December 7, 2004, citing Sections 100-242A and 100-244B, in its denial of a building permit to construct additions with alterations to the existing single-family dwelling. The reasons stated for disapproving the application are that the addition as proposed at less than 10 feet on a single side yard and less than 25 feet total side yards, which will be an increase in the degree of the existing nonconformance. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 20, 2005 and March 3, 2005, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct a 5' x 30' porch addition, and to extend a 3 ft. (wrap) at both corners, after removing the existing masonry entry porch. The side yards are proposed at 3.6' and 8.7' for a total of 12.3' for both side setbacks, as shown on the diagram date-stamped 11/30/04, with lot coverage calculations, and survey revised November 18, 2004 prepared by Peconic Surveyors, P.C. ADDITIONAL INFORMATION: The lot coverage has been recalculated and included in this review determination, at a total of 20.33% (without the 64 sq. ft. brick platform and 35 sq. ft. platform on stairs). Kostoulas CTM ID: 21.-2-13 REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The alternative relief increases both side yards from their original request from 3.6 feet to 8.9 feet on the west side and from 8.7 feet on the east side to 13.5 feet, while allowing a two-story porch addition to be placed at the front of their home, with 20.3% lot coverage 2. The benefit sought by the applicants cannot be achieved by some method, feasible for the applicants to pursue, other than an area variance, and is related to the dimensions of the lot with a narrow width, varying between 40.16 feet at the north end to 60 feet wide at the southerly end adjacent to the road, and with the layout and location of the dwelling in an existing nonconforming footprint. 3. The alternative relief granted is substantial. The code requires a minimum of 25 feet for both side yards and lot coverage not exceeding 20%. The alternative relief for the porch addition, after removing the proposed extended 3 ft. wraps at both ends, results in setbacks at 13.5+- feet at the south/east side, 8.9 feet at the south/west side, for a total of 22.4+- feet for both yards at the southerly corners, and lot coverage at 20.3. 4. The difficulty has been self-created. For the record, the Board has considered relief under Appeals 4248 and 4098 concerning this property and allowing side yard relief for extended decks from the existing glass sliding doors that overlook the rear yard toward the waterfront (sound). The applicants are aware of the code's limitations on the side yard setbacks and lot coverage maximum for new construction. 5. No evidence has been submitted to suggest that alternative relief (area variance) in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of alternative relief is the minimum action necessary and adequate to enable the applicants to enjoy the benefit of a porch addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Chairwoman Oliva, and duly carried, to DENY the relief requested, and to GRANT alternative relief for an open two-story ft, x porch addition and 6x6' step entry at the front of the existing dwelling, after removing both ends of the porch addition that wrap (removing these encroachments into both side yards, with porch construction open on three sides, as proposed and shown on the rough diagrams #7 and #8, prepared by Regi Weile, R.A. and date stamped by • •Page 3—March 10, 2005 • ZB Ref. No.5646—A.and M. Kos oulas CTM ID: 21.-2-13 ZBA November 30, 2004, subject to the following conditions: 1. The applicant shall provide the Board with a new survey, or map updated by a licensed surveyor, prior to issuance of a certificate of occupancy, confirming the lot coverage details for all raised decks, shed and other building areas (accessory and principal structures) as required by code, including the proposed addition shown on the 11/2/04 survey prepared by Peconic Surveyors, P.C.; 2. The lot coverage shall not exceed the 20.3% for the building area (re-calculated using the information shown on the 11/2/04 survey, including the proposed 30.3 ft. by 5 ft. porch with 6 ft. x 6 ft. entry stoop at the front of the house). This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Kos,toulas#5646 1035 Aquaview Avenue East Marion, New York Dear Chairwoman Oliva, After the.inconclusive Hearing regarding the above Property, last Thursday, I would like to take the opportunity to re-iterate my responses to questions posed by the Board Of Appeals: The responses to the Boards Questions are as follows: 1. Request for Lot Coverage Calculations which include Rear Deck area as Lot Coverage. I have sent revised calculations, as requested, under separate cover. The additional Lot coverage area results in a 17.3%coverage which is less than the 20% permissible. 2. Fire truck access to side and back yard area. Fire Truck access has not been altered under this proposed addition. The existing shed extends 5'0" from the structure on the wesnd basement access 5'-0"on the east. I do not believe fire trucks would attempt to reach the unstable ground at the rear of the structure at the 70'cliff. 3. The Residence is surrounded by one story Ranch Type structures. • As per attached SKA-1, please note that a majority of Structures on this Street are one and one-half to two stories in height.The exception only being to the immediate east and west of the Kostoulas . Residence. This Residence, with the additional front porch addition, will, if anything, bring itself into scale with the two adjacent structures as its facade will not be as massively,imposing as its current post modern elevation now presents. The proposed porch and pergola will in fact give the Structure a scale that is more in keeping with the smaller structures. We request favorable consideration for this proposal as it adds to the character of this Residential Street • even if in a non-conventional manner. The additional Lot coverage area results in a 17.3%coverage Which is less than the 20% permissible. 2. Fire truck access to side and,back yard area. • Fire Truck access has not been altered under this•proposed addition. The existing shed extends 5'0" from the structure on the west„and basement access 5'-O"on the east. I do not believe fire trucks would attempt to reach the unstable ground at the rear of the structure at the 70'cliff. 3. The Residence is surrounded by one story Ranch Type structures. As per attached SKA-1, please,note that a majority of Structures on this Street are one and one-half to two stories in height. The exception only being to the immediate east and west of the Kostoulas Residence. This Residence, with the,additionat front porch addition,will, if anything, bring itself into scale with the two adjacent structures as its facade will not be as massively imposing as its current post modem elevation now presents. The proposed porch and pergola will in fact give the Structure a scale that is more in keeping with the smaller structures. WEILE: It will be 8'7" on the east side, and actually 3' 6" on the west side, but 5 actually it's 8 ' 9" to the house because the bottom of the porch is actually built as -- the first 6 floor porch is built as landscaping. That will be a stone wall around and that will be open then a 7 pergola on top as it turns, and they wanted the house to be symmetrical. They will also be 8 changing the siding and put cedar on it to make it look better on that block. 9 BOARD MEMBER GOEHRINGER: Can I make a statement? 10 CHAIRWOMAN OLIVA: Go ahead, Jerry. BOARD MEMBER GOEHRINGER: We agonized over 11 this property, I have to tell you, five hours in 1992. It may not read it in the minutes, over the 12 lot coverage the amount of decks, close to the SCZM line. It's a beautiful house. It's a 13 wonderful neighborhood, and the bluff appears to be moderately stable at this time. And I realize 14 the construction that your client is anticipating in a proposed manner adds to the ambiance of the 15 house and the overall decor of the house. It's a beautifully done piece on a very small piece of 16 property. My concern has always been fire rescue and emergency. The closing up of any side yards 17 are tantamount to my thoughts, my concerns and I would be opposed to any turns. I'm not positive 18 that I'm enthralled with any additional lot coverage and with the two-story aspect of this 19 proposal, however I can find that much more palatable than I can see with these turns, which 20 encroach further into the side yards. Your client has encroached with the decks into the side 21 yards. I realize they are close to ground level -- and meaning the walkways, I'm not 22 referring to the decks, excuse me -- and which are okay, but I think there's a maximum that I can 23 vote for, and I think the turns are just substantial overkill. As I said, I'm still trying 24 to get the feeling for the second story aspect of it. If your client had 30 feet more, I don't 25 think there would be any question in reference of width of the property from my standpoint. But January 20, 2005 7 1 2 it's very, very difficult. Again, it just further exacerbates the ability to get into the rear yard 3 and that's just my opinion. MS. WEILE: Which is the problem that's 4 existing because on one side you have the shed and the other side you have the gate and the stair 5 down to the basement. So you really are not encroaching on anything that was available before. 6 BOARD MEMBER GOEHRINGER: I understand that but it's construction, and that's the issue. 7 There's no question about it. As I said, it's a beautifully done house, there's no question about 8 it. Mainly because this Board allowed that to happen in 1992, based upon working with the 9 client, and we really thought in 1992 that that was the end of it, and it appears that -- 10 MS. WEILE: I wasn't here. BOARD MEMBER GOEHRINGER: -- and it 11 appears that that was not the end of it. That's just my opinion. We don't have a total lot 12 coverage issue here, do we? CHAIRWOMAN OLIVA: Doesn't say anything. 13 BOARD MEMBER GOEHRINGER: I think we need to look at it from a lot coverage standpoint. 14 BOARD MEMBER ORLANDO: It's a big piece MS. WEILE: The lot coverage is not a 15 problem on the calculations, like all the properties on that side they own the cliff and the 16 beach up to the high water mark, so the lot is very long. 17 BOARD MEMBER GOEHRINGER: I understand that but I don't think the decks were taken into 18 consideration when the lot coverage was determined. I think what we need is an analysis 19 of lot coverage so we know we're under if we're under. 20 MS. WEILE: That's on the architectural site plan, there's a table of lot coverage. /- 21 BOARD MEMBER GOEHRINGER: Do we have a copy of that? I don't think that takes into 22 consideration all the decking on the north side. MS. WEILE: I think it will still be under 23 the -- BOARD MEMBER GOEHRINGER: This Board 24 granted in 1992 a substantial amount of decking and the majority and the reason for that decking 25 was basically aesthetics for your client and the ability to -- what we thought at that particular January 20, 2005 , y 8 1 2 time, or what I thought at that particular time -- I'm not speaking for the Board -- was erosion 3 control. And it was probably the first step in erosion control that we've ever done, but because 4 of the uniqueness of the area that was the reason why we dealt with it. I'm just telling you. 5 CHAIRWOMAN OLIVA: Jerry, it says here that the existing lot coverage now is 9.97 percent 6 and the existing plus the proposed porch is 11.5 percent lot coverage. 7 BOARD MEMBER GOEHRINGER: Ruth, I'm not questioning anything you're saying to me. The 8 two-tiered deck encompasses the entire rear yard of this property, and I can tell you that deck was 9 not taken into consideration with that lot coverage. 10 MS. WEILE: I think we'd still be under the 20 percent. 11 BOARD MEMBER GOEHRINGER:' At least we know what it is from now on and for future to go. As I 12 said, the turns are the only questions that I have at this particular time. I think it's nicely 13 done, but I think the turns are overkill. BOARD SECY. KOWALSKI: You're talking 14 about the sides on the closest point on the corner? 15 BOARD MEMBER GOEHRINGER: I'm talking about these entire corners on both sides. They 16 only further exacerbate the nonconforming side yard setbacks. 17 BOARD SECY. KOWALSKI: The two extensions? Vincent? 19 BOARD MEMBER ORLANDO: As you're aware, both houses adjacent to this property are 20 single-story ranches, so already this house is very large compared to that, and this would just r , 21 dwarf the other ones. MS. WEILE: Yes. But then there's one 22 down on the other side of the next door house is just as high. . 23 BOARD MEMBER ORLANDO: That's one down the road, second removed from the cousin. These are 24 adjacent properties. I agree with Mr. Goehringer, I wouldn't have the problem with your 25 double-tiered front porch, but it would have to be the width of the house, not including the shed, January 20, 2005 9 1 2 the width of the house, which is 30'3" because it's already both variances for total and single 3 are over 60 percent reduction in the code, which is substantial. I don't know how your clients 4 would feel about having it that way. You'd still need a variance because it's -nonconforming to the 5 side yard setback, even if you went with the width of the house. I would be in favor of that. 6 CHAIRWOMAN OLIVA: Taking the turns off? BOARD MEMBER ORLANDO: The width of the 7 house, pretty much the turns off. CHAIRWOMAN OLIVA: How wide were those 8 turns? MS. Location of Property: 1035 Aquaview Avenue, East Marion, NY; County Tax Map District 1000, Section 21, Block 02, Lot 013. WHEREAS, a public hearing was held on March 22, 1991, and continued on April 5, 1991; and' WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. By this application, appellants originally, upon filing the variance application on February 12, 1991, requested - permission- to square off the two northerly corners of the existing dwelling in addition to renovations/reconstruction shown on the plans prepared by Miller Associates, Project #9037 dated Janu- ary 4, 1991. All construction will be within 100 feet of the Sound bluff. - 2. The premises in question is a described parcel of land having a frontage along the north side of Aquaview Avenue of 60.0 • feet and frontage along the Long Island Sound of 434-- feet. The ' 'subject parcel is substandard, having a lot area of. approximately 11,330 sq., ft. 3. The subject parcel is unique, being quite narrow and with limited (upland) building area, * which lends to the practical difficulties. . 4. Article XXIV, Section 100-244B of the Zoning Code permits relief to lots containing less than 20,000 sq. ft. in the front - - - - - f ./ • n Page 2 • April 10 , 1991 Special Meeting Southold Town Board of Appeals • (Appl . The minimum rearyard• setback is permitted to be reduced under this provision to 35 feet. The code does not specifically permit relief to substandard parcels for bluff setbacks, except as may be permitted by the Board of Appeals. 5. During the processing of this application, opposition was received from the landowners immediately abutting this parcel on the easterly side. Upon learning of the objections raised by the adjoining. landowners, the applicants have alternatively requested permission to construct a 10 to 12 ft. addition along the southerly side of the house, meeting the'required setbacks as limited. by Section 100-244B of the code. Although the addition along the southerly portion is "landward" of the dwelling structure, this. alternative would be within 100 of the bluff, also necessitating relief by this board. 6. It is the position of this board that in considering this application, as amended, for an addition along the southerly portion of the dwelling structure: (a) the proposed location of the southerly addition is landward, being 46+- from the bluff at its closest point, of the existing dwelling structure, setback reduction to 24 feet from the westerly (front) property line is substantial in relation to the requirements, however, -there is no alternative available for appellants to pursue except by variance; (b) the alternative relief, as requested, is not substantial in relation. to the existing structures; (c) the difficulties imposed are uniquely related to the property and are not personal in nature; (d) the variance will not adversely effect the essential character of the neighborhood, or be adverse to the safety, health, welfare, comfort, convenience or order of the town and neighboring properties; (e) .there is no other alternative method feasible for appellants to pursue; (f) in view of all the above, the interests of justice will be served by granting conditional alternative relief, as requested and further noted below.
