(631) 765-1809• Fax(631) 765-9064 2 3 2406 So .thold.T Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF JULY 21, 2005 ZB Ref. 5716 —DAVID AND LAUREN KOLLEN Property Location: 1095 Track Avenue, Cutchogue CTM 137-1-26 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 16,594 sq. ft. parcel has frontage along two streets, 88.63 feet along Track Avenue to the south and 174.57 feet along Track Avenue to the east, and is improved with a single-family dwelling with two-story frame garage and one-story shed, as shown on the April 2, 1997 survey, amended May 31, 2005 by Peconic Surveyors, P.C. BASIS OF APPLICATION: Building Department's May 5, 2005 amended Notice of Disapproval, citing Section 100-244 in its denial of an application for a building permit to construct a second story over the existing dwelling, an increase in the degree of nonconformance, and proposed new addition, both at less than 35 feet from the front property line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on June 2, 2005 and July 7, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants request setback variances related to a proposed second-story addition over the existing first floor area of the dwelling and a proposed 10 x 26' addition with partial open porch area. AMENDED REQUEST: During the July 7, 2005 hearing, the applicants confirmed their intention to comply with the prior conditions of ZB Variance No. 4510 dated October 23, 1997, concerning the grant of a nonconforming setback for an open deck, and modifying the diagrams to show the deck will remain open and not be converted to a roofed-over porch or enclosure. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: Page 2—July 21,2005 • ZB File Ref. 5716—D.and L. Ko en CTM 137-1-26 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. A variance is necessary because the applicant is forced by the configuration of the existing house to place an addition in the front yard. While there is enough room on the opposite side of the house to add footage to the house without the need for a variance, it would be very costly to reconfigure the existing layout to accommodate the needs of the family. 3. The variance granted herein is substantial. The code requires a minimum of 35 feet, and the applicants are requesting 23.7 feet from the front property line at its closest point. This represents a 33% reduction from the code. The grant of the alternate relief at 27.7 feet from the front lot line will increase the setback by four feet, reducing the overall effects on the neighborhood; the alternative relief represents a 20% reduction from the code required 35 feet. 4. The difficulty has been self-created. As stated previously, the applicants have room on the lot to add to their home without the need for a variance but it would be costly. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of alternative relief is the minimum action necessary and adequate to enable the applicants to enjoy the benefit of an addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Chairwoman Oliva, and duly carried, to GRANT ALTERNATIVE RELIEF for the second-story addition over the existing first floor area of the dwelling, reducing the height of the second-story addition by eight feet for a maximum 25.7 ft. height, and as sited on the rough diagram with ZBA stamp July 6, 2005, and to GRANT ALTERNATIVE RELIEF, reducing by four feet the proposed extension of the one-story addition at the front yard to a 6' x 18' size, instead of 10' x 18', resulting in a setback 27.7' from the front(easterly) lot line adjacent to Track Avenue at its closest point. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The legally required notice and survey sent by registered letter is obviously inaccurate since the garage noted on the supplied diagram is a two story structure not a one story and is sufficiently larger than depicted. A review of registered records detailing the as built existing garage structure should be reviewed for non-conformance to building ---- permits,actual siting and use. 2. Sufficient property exists on the Northeast side of the existing house to build without extending the residence to a second level or further increase the degree of non- conformance on the South West Side or the front property line. Garage structure was only constructed last year and should have been incorporated in the planning and not built to make other plans non-conforming. 3. The survey and hand drawn depiction of the new structure does not give the dimensions of the new structure southwest side of the existing structure. 4. The plans submitted were confusing as to the intent of the structure such as patio doors on rear structure without a deck or patio. 5. Structure is currently non-conforming on three sides and should not be allowed to be further non-conformance. 6. A 2-story structure jammed into the corner of the property will create an esthetic in- balance and will be out of keeping with the area. 7. A non-conforming two story structure with hamper vision of vehicles turning the corner and create a hazard to children in the area. 8.
