(631) 765-1809• Fax(631) 765-9064 u DEC 2 2 42 5 FINDINGS, DELIBERATIONS AND DETERMINATION SOU hold Town Clerk MEETING OF DECEMBER 1, 2005 ZB File No. 5734 —John and Jane Ann Ingrilli Property Location: 10375 Nassau Point Road, Cutchogue CTM 119-1-15 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 1.04 acre parcel has 219 feet along Smith Road in Cutchogue, and a survey dated March 2, 2001, amended March 17, 2005 by Peconic Surveyors indicates a dwelling and accessory building. BASIS OF APPLICATION: Building Department's April 12, 2005 Notice of Disapproval, citing Sections 100- 33C and 100-244B, in its denial of an application for a building permit for additions and to create a workshop in an existing accessory garage second-story for private use by the owners. The reasons stated by the Building Inspector in the disapproval are that a workshop is not a permitted accessory use and that the principal setback will be less than 50 feet from the front property line. On October 24, 2005, the Building Inspector issued an amended Notice of Disapproval concerning recent changes in the scope of work, for a permit to demolish the existing accessory garage and construct a new accessory garage building to be used as a workshop. The same Sections of the Zoning Code were cited in the amended Notice of Disapproval concerning the setback and workshop as a non-permitted use. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on November 17, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct a 26' by 34' accessory garage building with a setback measured at 23.3 feet from the front lot line along Smith Road shown on Site Sheet S-1 dated 4-26-05 prepared by Mark K. Schwartz, A.I.A. The new height of the accessory building is proposed to conform to the code, with the revised plans showing a maximum height of 22 feet 9.25 inches to the top of the ridge, and a required maximum mean height of 18 feet, measured from ground. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Continued maintenance of the existing landscaping and screening ensures Page 2-December 1, 2005 • ZB File Ref. 5734-J. and A. Ingri• CTM 119-1-15 that the character of the neighborhood will continue without an undesirable change as a result of the setback location of the garage reconstruction. Any effect by this reduction of the front yard setback will be sufficiently mitigated by two retaining walls between the garage and the property line. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. A private workshop for the owner's own use is not uncommon and has been a permitted accessory use. The location is similar to the nonconforming location of the former accessory garage. 3. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 4. The relief requested is not substantial because a garage is permitted to be used as a private workshop by the owner as an accessory use. 5. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a private workshop area in a new garage, after removing the existing garage, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Goehringer, and duly carried, to GRANT the variance as applied for, as shown on the first floor plan dated 4-26-05 and second-floor plan with a ZBA date stamp of July 27, 2005, and as shown on Site Map S-1, prepared by Mark Schwartz, A.I.A., SUBJECT TO THE FOLLOWING CONDITIONS: 1. That the workshop area over the first floor of this garage shall be non-commercial and non- habitable. 2. That plumbing for heating and air-conditioning for a climate controlled area related to the owner's private workshop use, and half bath (sink and toilet), shall be permitted. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : 1 . No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. The parcel is unique in that it is almost at the end of Nassau Point Road, the parcel is elevated approximately 15 feet above Nassau Point Road. The rear yard abuts a private dirt Road (Smith Road) , Smith Road is elevated another 15 feet above the subject property. The rear yard is surrounded by a stone retaining wall . The existing garage is to be replaced with a new garage that matches the architectural style of the proposed renovations to the house. The proposed garage will accommodate the owner' s classic vehicles (antique motorcycle, 1953 pickup truck, 1952 Good Humor truck) and his duck decoy carving hobby, as well as provide winter storage. The garage is used as a typical accessory garage- some day in the future a toilet and sink may be added for convenience. This garage is not intended or will be used as sleeping quarters . The improvements will match the character of the neighborhood in that the garage and house are to be renovated in keeping with the Nassau Point community. There are no nearby properties which are impacted by the proposed plan. To the north and west is a long dirt road (Smith Road) which ends at two hill top homes . The view of the garage from Smith Road is limited to the top of the garage, the roof of the garage may be visible through the existing natural vegetation. To the east is the Bay and to the south is Nassau Point Road. Neither the home or garage can be seen from Nassau Point Road due to the difference in the elevation between the property and Nassau Point Road. 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance. The Garage is in the front yard of the waterfront property. The garage can not conform to a front yard setback from Smith Road. The existing garage is located at 31 . 4 feet from Smith Road and the proposed garage is 23 . 3 feet from Smith Road. 3 . The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance . Given the unique dimensions of the subject property, the location of the S house and topography of the parcel in relation to the abutting roads, the variance is not substantial . The garage is a standard residential garage. The owner' s hobbies- storage of classic vehicles and decoy carving are customary and ordinary hobbies conducted in residential garages . 4 . The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district . The proposed garage will replace an existing garage which is in poor condition and visually an eyesore. No neighbors will be able to see the garage because of the topography of the roads . The property is landscaped and garage screened from view. 5 . The alleged difficulty was not self-created. The existing garage is nonconforming. A garage could not be placed on the property without violating a front yard setback from Smith Road or Nassau Point Road. The location of the garage is the appropriate location in that it is flat, setback from the house and is in the front yard of a waterfront house . 6 . The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant . The garage can not be moved away from Smith Road without impacting the distance between the house and the garage. It has been located in the desired location and based on recommendations of the design professional . PROPERTY FACTS/DESCRIPTION: The applicant's 1.04 acre parcel has 219 feet along Smith Road in Cutchogue, and a survey dated March 2, 2001, amended March 17, 2005 by Peconic Surveyors indicates a dwelling and accessory building. BASIS OF APPLICATION: Building Department's April 12, 2005 Notice of Disapproval, citing Sections 1'0- 33C and 100-244B, in its denial of an application for a building permit for additions and to create a workshop in an existing accessory garage second-story for private use by the owners. The reasons stated by the Buildi g Inspector in the disapproval are that a workshop is not a permitted accessory use and that the princi•al setback will be less than 50 feet from the front property line. On October 24, 2005, the Building Inspector issued an amended Notice of Disapproval concerning recant changes in the scope of work, for a permit to demolish the existing accessory garage and construct a n:w accessory garage building to be used as a workshop. The same Sections of the Zoning Code were cited in the amended Notice of Disapproval concerning the setback and workshop as a non-permitted use. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on November 17, 2005 at which ti e written and oral evidence were presented. Based upon all testimony, documentation, personal inspection •f the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct a 26' by 34' accessory gara'!e building with a setback measured at 23.3 feet from the front lot line along Smith Road shown on Site Sheet S 1 dated 4-26-05 prepared by Mark K. Schwartz, A.I.A. The new height of the accessory building is proposed o conform to the code, with the revised plans showing a maximum height of 22 feet 9.25 inches to the top of t e ridge, and a required maximum mean height of 18 feet, measured from ground. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and person.) inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Continued maintenance of the existing landscaping and screening ensur:s Page 2—December 1,2005 ZB File Ref.5734—J.and A. Ingrilli CTM 119-1-15 that the character of the neighborhood will continue without an undesirable change as a result of the setback location of the garage reconstruction. Any effect by this reduction of the front yard setback will be sufficiently mitigated by two retaining walls between the garage and the property line. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. A private workshop for the owner's own use is not uncommon and has been a permitted accessory use. The location is similar to the nonconforming location of the former accessory garage. 3. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 4. The relief requested is not substantial because a garage is permitted to be used as a private workshop by the owner as an accessory use. 5. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a private workshop area in a new garage, after removing the existing garage, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Goehringer, and duly carried, to GRANT the variance as applied for, as shown on the first floor plan dated 4-26-05 and second-floor plan with a ZBA date stamp of July 27, 2005, and as shown on Site Map S-1, prepared by Mark Schwartz, A.I.A., SUBJECT TO THE FOLLOWING CONDITIONS: 1. That the workshop area over the first floor of this garage shall be non-commercial and non- habitable. 2.
