(631) 765-1809 • Fax(631) 765-9064 /94�LO • Southold Town Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF OCTOBER 27, 2005 ZB File No. 5773—Theodore Harris Property Location: 3805 Alvahs Lane, Cutchogue CTM 101-2-24.4 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 85,685 sq. ft. parcel has 235 feet along Alvah's Lane, rear line of 297.28 feet, and side lines of 312.06 feet and 341.25 feet. The property is improved with a two-story frame home shown on the November 13, 2000 survey, prepared by Joseph A. Ingegno, at 21.4 feet from the front lot line, at its closest point. BASIS OF APPLICATION: Building Department's April 27, 2005 Notice of Disapproval, citing Section 100-32 and 100-242A, in its denial of an application for a building permit to construct additions and alterations to the existing dwelling. The reason stated by the Building Inspector in the denial is that the proposed construction will constitute an increase in the degree of nonconformance when located at less than 60 feet from the front lot line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 20, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to construct a 20 ft. wide single- story addition with roof deck at 21.4 feet from the front lot line adjacent to Alvah's Lane, as shown on the site plan prepared 4/19/05 by Frank Uellendahl and elevation diagram prepared 8/15/05. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's home has an established front yard setback at 21.4 feet which places the dwelling in a significant nonconforming locatioin from the • Page 2-October 27, 2005 • ZB File Ref.5773-Theodore Harris CTM 101-2-24.4 street. The dwelling was constructed prior to the 1957 enactment of zoning. There are many older homes in the neighborhood that have similar nonconforming setbacks. The remaining yard setbacks are all conforming. The new addition is one-story with an open deck above, and is situated along the southeast side of the dwelling which will follow the existing front lines of the dwelling, and sided in red cedar shingles. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The purpose of the requested location is to add a room to the house away from the frequently loud business activities and diesel fumes emanating from the adjacent farm activities to the north and power generator. 3. The variance granted herein is not substantial, resulting in approximately 260 square feet for the addition, which is 0.30% of the total lot size and which does not create any new nonconformance closer to the street than the existing. The footprint of the existing dwelling is only 850+- square feet. 4. The difficulty has been self-created by the nonconformity of the front yard setback, and the current code requirement for a 60 ft. minimum front yard. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairwoman Oliva, seconded by Member Goehringer, and duly carried, to GRANT the variance as applied for, as shown on the site and elevation plans prepared 4/19/05 and 8/15/05 by Frank Uellendahl, subject to the Condition that the deck over the first floor shall remain open to the sky. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The design and scale of the addition will be consistent with the existing farm house. The addition and house will be sided in red cedar shingles, as is the barn on the adjacent property directly to the north. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The entire footprint of the existing house fails to comply with the Town Code's currently required front setback. There is no place to add a conforming addition to any side of the existing structure. Part of the benefit to be obtained from building the proposed addition on the south side where requested is to add a room to the house away from the frequently loud business activities and diesel fumes emanating from the adjacent farm property to the north (in particular the power generator built on the subject property's northern property line). (3) The amount of relief requested is not substantial because: The subject property is 85,685 square fee. The footprint of the existing house is approximately 850 square feet. The proposed addition is approximately 260 square feet. Therefore, the increase in the size of the overall footprint with the addition over the existing building as a percentage of the lot size is 0.30%-an insubstantial increase. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions In the neighborhood or district because: The proposed addition will not decrease or otherwise negatively impact the surrounding farmland. It will be situated behind three trees in the front yard and a large rhododendron. The scale and style of the addition will be the same as the existing house and will be consistent with and complement the rural character of the neighborhood. In addition, the proposed addition is on the south side of the existing house.
