THIS INDENTURE, made the 22nd day of February, in the year Two
Thousand One,
BETWEEN DEBRA B. ACQUAVIVA ("party of the first part"),
residing at 7~ Juniper Street, Islip, New York 11751, and
CHRISTOPHER J. POPPE, JR. and PATRICIA/%~OP?E, husband and
wife, both residing at 36 Fenimore Street, Lynbrook, New York
11563 ("party of the second part"),
WITNESSETH: THAT the party of the first part, in
consideration of the sum of TEN and 00/100 ($10.00) DOLLARS
and other good and valuable consideration paid by the party of
the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the
party of the second part forever,
ALL THAT certain plot, piece or parcel of land with the
buildings and improvements thereon erected situate, lying and
being at Southold, in the Town of Southold, County of Suffolk
and State of New York, bounded and described as follows:
BEGINNING at 'a point on 'the center line of a 20 foot wide
right of way, distant the following 2 courses and distances
from the corner formed by the intersection of the
southeasterly side of North Sea Drive and the northeasterly
side of Kenney's Road;
1) North 39 degrees 24 minutes East, 283.48 feet along the
southeasterly side of North Sea Drive;
2) Southeasterly 125.00 feet along the center line of a 20
foot wide right of way to the point or place of beginning;
RUNNING THENCE from said point
land now or formerly of Malone,
East, 150.00 feet;
and place of beginning along
South 50 degrees 36 minutes
T~ENCE along land now or formerly of Deustch, South 39 degrees
24 minutes 00 seconds West, 100.00 feet to land now or
formerly of Cunningham;
THENCE along land now or
degrees 36 minutes West,
of Vaccaro;
formerly of Cunningham, North 50
150.00 feet to land now or formerly
THENCE along land now or formerly of Vaccaro North 39 degrees
24 minutes East, 100.00 feet to the center line of a 20 foot
wide right of way and the point or place of BEGINNING.
TOGETHER with the right to use, in common with others, a 20
feet right of way extending southerly from the southerly side
of North Sea Drive, 125.00 feet to the premises above
described and continuing thence approximately 150.00 feet, the
westerly one-half of which comprises the easterly 10 foot of
the premises above described.
~ING AND INTENDED to be the same premises conveyed to the
party of the first part by deed recorded in Liber 11644 at
Page 141 and known as and by street address 282 North Sea
Drive, Southold, New York.
TOGETHER with all right, title and interest, if any, of the
party of the first part in and to any streets and roads
abutting the above described premises to the center lines
thereof;
TOGETHER with the appurtenances and all the estate and rights
of the party of the first part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the party
of the second part, the heirs or successors and assigns of the
party of the second part forever.
AND the party of the first part covenants that the party of
the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever, except
as aforesaid.
~ND the party of the first part, in compliance with Section 13
of the Lien Law, covenants that the party of the first part
will receive the consideration for this conveyance and will
hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part
of the total'of the sam~ for any other purpose.
The word "party" shall be construed as if it read "parties"
whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly
executed this deed the day and yea~irst above written.
