(631) 765-1809• Fax (631)765-9064 UG 2/3 205 FINDINGS, DELIBERATIONS AND DETERMINATION SOU Old TO1N' rk MEETING OF JULY 21, 2005 ZB Ref. 5723 — HOWARD WALDMAN Property Location: 95 Arrowhead Lane, Peconic; CTM 98-3-1 + 2 (combined as one lot) SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 46,029 sq. ft. parcel has 113.84 feet along Indian Neck Road and 393.23 feet along Arrowhead Lane, and is improved with two, single-story buildings at the north as shown on the March 17, 1999 survey prepared by Stanley J. Isaksen, Jr. BASIS OF APPLICATION: Building Department's April 14, 2005 Notice of Disapproval, citing Sections 100-33 and 100-30A.3 in its denial of an application for a building permit to construct a proposed single-family dwelling in a new location, replacing the most northerly existing dwelling. The reason stated for disapproving the application is that, as a result of the conversion of the existing dwelling to an accessory building and the construction of a new single-family dwelling, two accessory buildings will be located in the front yard. In addition, the disapproval indicates that the new dwelling is required to be 50 feet from the front lot line adjacent to Arrowhead Lane, and the setback is proposed at 32 feet. (Upon information provided, the new accessory garage is proposed to meet the code's yard and minimum setback requirements as proposed in the southerly rear yard.) FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on July 7, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct a new, single-family dwelling at the southerly portion of the property, 32 feet from the westerly side of Arrowhead Lane and 120 feet from the southerly property line, as shown on the amended March 28, 2005 survey prepared by Stanley J. Isaksen, Jr. The height to the top of the ridge of the new dwelling is proposed at a maximum of 30.7 feet. (Also in the original application, the applicant requested a variance to convert the existing dilapidated dwelling structure to an accessory building, in a Pagq 2—July 21, 2005 • ZB File Ref. 5723—Howard Weidman CTM 98-3-1 & 2 (as one lot) nonconforming existing yard location, and to keep the 18 x 18 one-story shed. Please see Amended Relief, noted below.) AMENDED RELIEF REQUEST: During the July 7, 2005 hearing and receiving testimony from the applicant and from nearby landowners, the application was amended by the applicants to: (1) withdraw their request to keep the 18' x 18' shed in a nonconforming location, and (2) withdraw their request to convert the existing residence from a principal building to an accessory building, because they intend to remove the former dwelling structure entirely, instead of converting the same to an accessory building. Information was also furnished that the sanitary system that existed in the northerly yard was no longer functional and that it will be filled (if not already filled). REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The property is long and narrow with two front yards (street frontages). The proposed location, with a minimum 32 feet from the westerly front lot line, gives the appearance of a greater setback due to the fact that the private road (Arrowhead Lane) is not fully developed at its maximum easement width. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's attorney confirmed the applicant's desire to build on this larger parcel consisting of a total area of 46,029 sq. ft. and preserving the privacy with a location almost centered between Arrowhead Lane and the easterly property line. 3. The variance granted is the minimum necessary, representing an 18 ft. reduction from the code required 50 ft. front yard setback from the westerly lot line. 4. The difficulty has been self-created when the applicant chose to build on this 46,029 sq. ft. lot with a new house 48 feet deep by 40 ft. wide. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling on their property, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Chairwoman Oliva, and duly carried, to GRANT the variance, as amended on the 7/28/2005 survey prepared by Stanley J. Isaksen, Jr., date-stamped by the ZBA August 2, 2005, and shown on the Jan 2005 diagrams prepared by Charles M. Thomas, Architect, SUBJECT TO THE FOLLOWING CONDITIONS: 1. No Certificate of Occupancy shall be issued for the new house until the former dwelling structure has been demolished or removed from the property. 3. This variance shall become null and void by July 31, 2007 if a Certificate of Occupancy is not obtained for the new single-family dwelling. 4. An updated, corrected survey or site map showing applicant's amended requests shall be submitted to the Office of the Zoning Board of Appeals, confirming removal of the buildings, cesspools emptied and backfilled before this variance is signed and issued. Additional amended maps accurately showing amendments hall be furnished by applicant to the Building Department at the time of obtaining permits and CO's. (Office Note: Amended survey was received 8/2/05 as noted in the above Resolution.) This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The development on Arrow Lane is less intensive then the homes on 1 /8th acre on the adjacent development of Indian Neck • • Park. This home will be developed in conformity with the three new homes to the south of his property. 5 . The alleged difficulty was not self-created. The lots were created in 1963 , and the lot predates current zoning setbacks . The existing residence does not conform to the zoning or the state building code. The degree of improvements required to make the structure meet current state building codes is extensive, therefore, conversion to an accessory building was recommended 6 . The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant .
