SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions, without an adverse effect on the environment if the project is implemented
as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 3.8-acre parcel has 264 feet along Park
Avenue, and is improved with a single-family dwelling and five accessory buildings as shown on the
4/26.05 site map prepared by Samuels & Steelman, Architects and 3/22/04 survey prepared by John
C. Ehlers.
BASIS OF APPLICATION: Building Department's April 13, 2005 Notice of Disapproval, amended
April 22, 2005, April 29, 2005, and May 3, 2005, citing Sections 100-33 and 100-242A, in its denial
of an application for a building permit concerning proposed alterations to nonconforming accessory
buildings The reasons stated for disapproving the application are: (a) the alterations to the
existing accessory water tower structure will increase the degree of nonconformance with regard to
the existing number of stories (three stories), its existing height at 44'3", and located in a front yard
at 26 feet from the front lot line, for the proposed conversion to an accessory
gardenhouse/playhouse; (b) the alterations to the existing accessory barn/garage will increase the
degree of nonconformance with regard to its existing front yard setback at 18 feet from the front lot
line. The Code requires a minimum of 50 feet from the front lot line under Section 100-33B, and a
limits the height of accessory buildings to 18 feet under Section 100-33A.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on June 2, 2005 at which time
written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicants wish to restore the existing accessory
buildings and to make minor improvements, retaining the seasonal accessory uses. The existing
garage will be converted into a 'pool house' with a small toilet room (sink and toilet only) and a wet

bar. The existing water tower will be used as a garden room on the first floor, and toilet room and
landing on the second floor, and third floor as a study, retaining the accessory use for the owner and
his family.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The applicants wish to convert the
tower/accessory building to a gardenhouse/playhouse with half bathroom (sink and toilet). The barn
will be converted to a playhouse with a wet bar and half bathroom (sink and toilet), and outside
shower. Both structures have been in existence for more than 75 years in the same locations at 18
and 26 feet from the front yard lines, at its closest points. The water tower structure contains a cellar
and has been a visual landmark to the area, although without modern function. The alterations
involve interior restoration without adding heat and without sleeping quarters. The alterations of
these accessory buildings will allow a functional accessory use by the current owner and her family.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance. The applicant has no alternative but to request
area variances for both structures due to the existing nonconforming setbacks, and existing height of
the tower structure exceeding the 18 ft. height limitations of the codes. The relief is the maximum
the Board would approve, requiring conditions in the grant of the variances, noted further below.
3. The difficulties have been self-created in that the structures have always encroached within the
restricted front yard area.
4. No evidence has been submitted to suggest that variances in this residential community will have
an adverse impact on the physical or environmental conditions in the neighborhood.
6. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of interior alterations to the accessory garage and water tower, while
preserving and protecting the character of the neighborhood and the health, safety and welfare of
the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by
Member Orlando, and duly carried, to
GRANT the variances as applied for, as shown on the 4/26/05 site and elevation maps
prepared by Samuels & Steelman, Architects, SUBJECT TO THE FOLLOWING
CONDITIONS:
1. Each structure shall have only one lavatory or half bathroom (sink and toilet).
2. Each structure shall not be used as sleeping quarters at any time.
3. Each structure shall not be heated for year-round use.
4. That each structure shall be used as an accessory use, customary and incidental to the
principal dwelling structure.
5. Only the barn (garage) shall contain an outside shower and wet bar.

6. The renovations/alterations shall be in accordance with the requirements of the Town of
Southold and N.Y.S. building codes.
7. The use of each structure shall be limited to residential storage of goods and equipment.
8. The Zoning Board of Appeals or its legal representative(s), reserves the right to inspect
both structures prior to the issuance of a Certificate of Occupancy.
9. When the above conditions are met, the Board will determine that the granting of this
application will not impact either the physical or environmental characteristics of the district.
This action does not authorize or condone any current or future use, setback or other feature of the
subject property that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action.

and Chapter 100 (Zoning), Code of the Town of Southold, the following public
hearing will be held by the SOUTHOLD TOWN BOARD OF APPEALS at the

on THURSDAY, JUNE 2, 2005:

100-242A and 100-33, based on the Building Department's April 13, 2005 Notice
of Disapproval, amended May 3, 2005, concerning structural alterations to an
existing accessory water tower and accessory garage. The reasons stated in the
disapproval are: (a) the alterations change the intensity of use of these
nonconforming accessory buildings, constituting an increase in nonconformity;
(b) the existing nonconforming yard location does not meet the code required
rear yard or front yard, for waterfront properties; (c) the existing nonconforming
height of the tower exceeds the 18 ft. height limitation of the code. Location of

Is returned herewith and disapproved on the following grounds:
The existing accessory three-story tower, located in the front yard, will be converted to a garden house
and playhouse, with bathroom. The existing accessory barn will be converted to a playhouse with
bathroom and wet bar.
The proposed alterations to these nonconforming accessory buildings, are not permitted pursuant to
Article XXIV, Section 100-242A, which states-
"Nothing in this Article shall be deemed to prevent the remodeling, reconstruction or
enlargement of a nonconforming building containinga conforming use, provided that such
action does not create any new nonconformance or increase the degree of nonconformance with
regard to the regulations pertaining to such buildings."
The existing three-story tower measures +1- 44 feet in total height and is located in the front yard, with
setbacks of 26 feet (tower) and 18 feet (barn) respectively. The existing accessory barn is also located
in the front yard.
Therefore, the proposed alterations are not permitted pursuant to Article III, Section 100-33, which
states,
"In the Agricultural-Conservation District and Low-Density Residential R-80, R-120, R-200
and R-400 Districts, accessory buildings and structures or other accessory uses shall be located
in the required rear yard, subject to the following requirements:
A. Such buildings shall not exceed eighteen (18) feet in height.
B. In the case of a waterfront parcel, accessory buildings and structures may be located
in the front yard, provided that such buildings and structures meet the front-yard
setback requirements as set forth by this Code."

The change in the intensity of use, of these nonconforming buildings, constitutes an increase in
nonconformity and, therefore, requires a variance.
This notice of disapproval was amended on April 22, 2005 for clarification, on April 27, 2005 to
clarify the reasons why these buildings are non-conforming and on April 29, 2005 and May 3,
2005 to lude an omission.

Area Variance Reasons ZONING BOARD OF APPEALS
1. An undesirable change will not be produced in the CHARACTER of the
neighborhood or a detriment to nearby properties if granted, because:
This property consists of 3. 8 acres, is a corner lot with two front yards and is also
waterfront. The property was developed over 100 years ago and over time several
accessory buildings were constructed for various uses including a three car garage(as per
the C.O.) and a three story water tower. Since the development of this property predates
the zoning code, these two buildings were constructed in what is now considered the front
yard along Maratooka Road.
The current proposal is to restore the existing buildings and to make minor improvements
so that the buildings will have a functional use for the current owner. The buildings have
accessory seasonal uses only and will not be heated.
The existing garage will be converted into a Pool House with a small toilet room (sink and
toilet only) and a wet bar. The exterior will not be altered except for new windows and
doors to match the existing.
The existing Water Tower is a visual landmark to the area but has no modern function. The
Water Tower is three storys high with a cellar. The First Floor will be use for a Garden
Room; the Second Floor will be used as a Toilet Room and Landing; the Third Floor will
be used as a Study.
The proposed additions will not create an undesirable change in the character of the
neighborhood because the proposed uses will not alter the existing buildings other than
minor interior changes.
2. The benefit sought by the applicant cannot be achieved by some method feasible
for the applicant to pursue, other that an area variance, because:
The proposed plumbing in each of these accessory buildings is a very minor interior
change. To construct an additional accessory building for these uses that complies with
the front yard setback would be costly and would have greater impact on the property and
the community.
3. The amount of relief requested is not substantial because:
The proposed uses for both these buildings are permitted uses for accessory structures
and
the additions of a wet bar in the Pool House and toilet rooms in each building is not
substantial. These uses are permitted in accessory structures.
4. The variance will NOT have an adverse effect or impact on the physical
environmental conditions in the neighborhood or district because:
The existing Water Tower is located 277 feet from the Peconic Bay and the existing Barn
is located 372 feet from the Peconic Bay. There will not be any adverse environmental
effects on the neighborhood.

a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 3
sets of plans, accurate plot plan to scale. Fee according to schedule.
b.Plot plan showing location of lot and of buildings on premises,relationship to adjoining premises or public streets or
areas, and waterways.
c.The work covered by this application may not be commenced before issuance of Building Permit.
d.Upon approval of this application,the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e.No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim,the Building Inspector may authorize,in writing,the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

The proposed alterations to these nonconforming accessory buildings, are not permitted pursuant to
Article XXIV, Section 100-242A,which states;
"Nothing in this Article shall be deemed to prevent the remodeling, reconstruction or
enlargement of a nonconforming building containing a conforming use,provided that such
action does not create any new nonconformance or increase the degree of nonconformance with
regard to the regulations pertaining to such buildings."
The existing three-story tower measures+1- 44 feet in total height and is located in the front yard. The
existing accessory barn is also located in the front yard.
The change in use, of this nonconforming building with a nonconforming use, constitutes an increase
in nonconfo • and, therefore, requires a variance.

Dear Sir or Madam:
Please find enclosed a copy of the Legal Notice describing your recent application. The Notice
will be published in the next issue of the Times Review newspaper.
1) Before MAY 12tH:
Please send the enclosed Legal Notice, with both a Cover Letter including your telephone
number and a copy of your Survey or Site Plan (filed with this application) which shows the
new construction area or other request, by CERTIFIED MAIL, RETURN RECEIPT
REQUESTED, to all owners of property (tax map with property numbers enclosed), vacant or
improved, which abuts and any property which is across from any public or private street.
Use the current addresses shown on the assessment rolls maintained by the Town Assessors'
Office located at Southold Town Hall (631 765-1937) and the County Real Property Office at the
County Center, Riverhead. If you know of another address for a neighbor, you may want to
send the notice to that address as well. If any letter is returned to you undeliverable, you are
requested to make other attempts to obtain a mailing address or to deliver the letter to the
current owner, to the best of your ability and to confirm this in either a written statement, or at
the hearing, with the returned letter.
AND by MAY 12th: please either mail or deliver to our office your Affidavit of Mailing (form
enclosed) with parcel numbers, names and addresses noted, and return it with the white
receipts postmarked by the Post Office. When the green signature cards are returned to you by
the Post Office, please mail or deliver them to us before the scheduled hearing. If any
signature card is not returned, please advise the Board at the hearing and return it when
available. These will be kept in the permanent record as proof of all Notices.
2) By MAY 25th: Please make arrangements to place the enclosed Poster on a signboard
such as cardboard, plywood or other material, posting it at your property for at least seven (7)
days and kept in place till the hearing date. Securely place the sign on your property facing
the street, no more than 10 feet from the front property line bordering the street. If you border
more than one street or roadway, an extra sign is available for the additional front yard. Please
also deliver your Affidavit of Posting at the meeting (or earlier if possible).
If you are not able to meet the deadlines stated in this letter, please contact us promptly.
