SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 33,806 sq. ft. parcel has 185.35 feet along the easterly side of Love Lane and is improved with a single-story frame house and concrete-block garage as shown on the May 14, 2004 survey, amended June 24, 2005 by John C. Ehlers. BASIS OF APPLICATION: Building Department's August 25, 2005 Notice of Disapproval, citing Sections 100-242A and 100-244 in its denial of an application for a building permit to construct a proposed addition with alterations to the existing dwelling which is less than 50 feet from the rear lot line. The reason stated in the building Inspector's denial is that the proposed addition will constitute an increase in the degree of nonconformance when constructed at less than 50 feet from the rear property line. The deck area shown on the applicant's diagram is not requested by applicant under the August 25, 2005 Notice of Disapproval or part of this variance application; either a building permit for the deck, removal of the structure, or a separate review by the Building Inspector may apply (or Notice of Disapproval and variance submission). FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 20, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct roof reconstruction with partial storage for attic storage over the existing first-story (40' x 24') of the dwelling. Also shown on the June 24, 2005 site survey are a proposed 6' x 12' entry, plus steps, at the front of the dwelling, removal of a deck, a existing deck to be reconstructed. Page 2-October 27,2005 • ZB File Ref.5782-Thomas Anders CTM 140-1-23.1 (The proposed new 14' x 24' deck area that is shown on the June 24, 2005 site survey was confirmed to the ZBA staff to be removed from their proposal, and there is not part of the building inspector's building permit disapproval, or this variance application.) REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. The proposed addition with alterations, which involves the replacement of an existing roof and adding an attic area for storage, will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The footprint will remain the same, and the house is more than 50+- feet from the nearest neighboring building to the east and more than 200+- feet from the neighboring building to the south. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The house has been in its present location for over 20 years, and it would not be reasonable to require its relocation to conform with the current setback requirements. 3. The variance granted herein is not substantial, as the footprint will not be changed. The addition will increase the degree of nonconformity with respect to the rear setback only, and to the extent that it increases the height of the roof ridge from 15 feet to 24.7 feet. 4. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 5. Grant of the requested relief is the minimum action necessary that will adequately enable the applicant to enjoy the benefit of an addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Goehringer, and duly carried, to GRANT the variance as applied for, as shown on the survey dated May 14, 2004, amended June 24, 2005, by John C. Ehlers, Land Surveyor, and 7/26/05 elevation diagrams prepared by Penny Lumber, subject to the following Condition: That dwells with a roof gutter system be maintained in good condition at all times for containment of rainwater runoff. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant requests an area variance for the location of- a rehabilitated garage located 1.3 feet from the rear lot line. T , , Page 2—July 10,2003 " • Appl.No.5335—Bluepoints Co.,Inc. 140-1-23.1 at Mattituck • • REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The reconstruction and rehabilitation of the garage, as an accessory structure in the existing nonconforming location was necessary for storage uses related to the existing dwelling. The property is located in the Marine-ll Zone District. The 1.3 ft. setback from the rear line is maintained in a preexisting footprint. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The lot contains 38,498 sq. ft. to a tie line along the high water line of Mattituck Creek. The building is existed for many years in this location with a 1.3 ft. rear setback at its closest point. 3. The variance requested is not substantial, resulting in a 3.7 ft. reduction of the code requirement. 4. The difficulty was self-created when the property was purchased in 1994 with a garage in a location which did not conform to the current Town Code requirements. 5. No evidence has been submitted to suggest that the grant of the requested variance will have an adverse effect or impact on physical or environmental conditions in the neighborhood or district. 6. Grant of the relief requested is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of garage reconstruction, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
