The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, January 23, 2002.
RESOLVED, that the Southold Town Board of Trustees grant an Amendment to Permit #5084
to allow extent of work as per plan submitted 1/23/02 for the restoration of the wetland plan of
the disturbed areas - approved plan to be restored by planting and with the addition of a 12 inch
culvert underneath the driveway to allow water flow in either direction, there should be no new
fill brought into this project and no regrading of the existing fill on this site.

I am writing to you as president of the Westend Properties Association of Camp Mineola,
Inc. As you may be aware, we are an association of 27 property owners located directly east of
James Creek along the Peconic Bay on Camp Mineola Road, Mattituck. It is my understanding
that our association's Secretary, Mr. Norman Womback, has spoken with Mr. Krupski recently
concerning the issue of the improper importing of fill by the property owner of land known as tax
map no. 1000-122-09-9.4. I believe the land owner's name is Mr. Edward Fox. Mr. Fox is
currently constructing a new home on the site, together with certain outbuildings, including a
built-in swimming pool. Mr. Fox's property boarders the Peconic Bay as well.
With regard thereto, we are writing to alert the Board of Trustees to the extreme
environmentally sensitive nature of this area. The location of Mr. Fox's property and the
importing of excess fill to raise the topography of his land has the potential to cause grave flood
damage to the existing homes within the Association following any significant rainfall or in the
event of the overflow of James Creek. In addition, given the vast experience of the existing
home owners in the Association, it is our opinion that the construction of a cement retaining wall
by Mr. Fox which apparently was no longer needed following modification of his building plans
and the relocation of the septic system, will likely serve to exacerbate the flooding problems in
this area unless certain modification to the wall are undertaken.
Accordingly, anything short of requiring Mr. Fox to remove any tilt brought onto his
property in violation of any Town or other applicable law, regulation or rule will likely result in
severe damage to the surrounding homes, including those within the Association, due to the
inability of the surrounding waters to properly drain. We urge you to require Mr. Fox to remove
all excess fill and not simply require a fine and we further request that you cause the inspectors at
the Town's building department to inspect the construction of the cement retaining wall erected
by Mr. Fox (which exceeds 3 feet in height) to hopefully cause certain drains to be incorporated
into the construction of the wall to allow for rain water and ground water that over flows from
the Creek to pass through the wall to properly drain.
I ta'ust that you will take all steps necessary to insure that the potential dire situation
created by Mr. Fox is properly remedied. Thank you in anticipation of your assistance in this

Dear Trustees,
The purpose of this letter is to request a re-evaluation of the above
referenced Building Permit which I believe to be defective. The basis for this
request is that substantial errors exist in the indicated location of the wetlands
boundaries as represented on the application Map. I have attached a report from
First Coastal (environmental consulting) whose conclusions support the points
listed below.
Point #1: Edge of the wetlands to the south of the subject property is
marked at the same point as the "High Water Mark". However, in this High Marsh
area, "Spartina Patens" is the dominant vegetation at a distance of at least 100'
north of the "high water mark". As a result, wetlands set-back line should be
located 175' north of the high water marl(.
Point~2: Based on information and belief, on or about 1994, the D.E.C.
surveyed the subject property for the purpose of issuing a building permit, and
determined the wetlands boundary to be consistent with the statement in point~l
above. We have requested relative documentation from the D.E.C through the
F.O.I.L., and will provide it as soon as it is available.
Point~3: The location of the wetlands to the north of the subject property
is indicated on the application map to be at or along the paved road which forms
the northern border of the property. Phragmites and various upland vegetation is
obviously the dominant vegetation in this area which suggests an inconsistent
standard was used to delineate wetland borders on opposing sides of the subject
property,
It also suggests that no wetland setback requirements exist on the
northern border of the property.

Dear Ms. Lachenmeyer:
The following action was taken by the Board of Town Trustees
during its regular meeting held on October 27, 1999 regarding
the above matter:
WHEREAS, Land Use Ecological Services, Inc. on behalf of EDWARD
FOX applied to the Southold Town Trustees for a'permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated August 12, 1999, and,
WHEREAS, said application was
Conservation Advisory Council
recommendations, and,
referred to the Southold Town
for their findings and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on October 27, 1999, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of
EDWARD FOX to construct a single-family dwelling, deck and pool,
and approx. 125 c.y. of clean fill required for proposed septic
system with the condition that there be haybales at 55' .except
for the driveway, before construction and shown on a new,set of
plans. ~
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

At the meeting of the $outhold Town Conservation Advisory Council held Monday, September
20, 1999, the following recommendation was made:
Moved by Melvyn Morris, seconded by Richard Smith, it was
RESOLVED to recommend to the Southold Town Board of Trustees DI~APPI~OYAL of the
Wetland Permit Application of EDWARD FOX 1122-9-9.4 to construct a single-family
dwelling (3,000 sq.fi, footprint), deck (1,497 sq.fi. +/-) and swimming pool (800 sq.fi.) a
minimum of 82' landward of the tidal wetlands boundary located to the north of the subject lot.
The proposed septic system will be located a minimum of 155' landward of said tidal wetlands
boundary and will be enclosed by a proposed concrete retaining wall (top of wall = e. 9.0)
Approx. 125 c.y. of clean fill will be required for the proposed sanitary system.

Dear Trustees,
The purpose of this letter is to request a re-evaluation of the above
referenced Building Permit which I believe to be defective. The basis for this
request is that substantial errors exist in the indicated location of the wetlands
boundaries as represented on the application Map. I have attached a report from
First Coastal (environmental consulting) whose conclusions support the points
listed below.
Point #1: Edge of the wetlands to the south of the subject property is
marked at the same point as the "High Water Mark". However, in this High Marsh
area, "Spartina Patens" is the dominant vegetation at a distance of at least 100'
north of the "high water mark". As a result, wetlands set-back line should be
located 175' north of the high water mark.
Point~2: Based on information and belief, on or about 1994, the D.E.C.
surveyed the subject property for the purpose of issuing a building permit, and
determined the wetlands boundary to be consistent with the statement in point/C1
above. We have requested relative documentation from the D.E.C through the
F.O.I.L., and will provide it as soon as it is available.
Point/C3: The location of the wetlands to the north of the subject property
is indicated on the application map to be at or along the paved road which forms
the northern border of the property. Phragmites and various upland vegetation is
obviously the dominant vegetation in this area which suggests an inconsistent
standard was used to delineate wetland borders on opposing sides of the subject
property.
It also suggests that no wetland setback requirements exist on the
northern border of the property.

Dear Mr. Pymm:
I enjoyed meeting with you on Sunday March 13th at approximately 3:30 p.m. to review
the site conditions in the vicinity of your property in Maffituck, New York. As per your
request, I inspected your properly and I inspected the property adjacent to yours on the
east with respect to the identification of wetland species.
Regarding the property adjacent to yours on the east, I noticed a stand of SDartina
patens on the south side of the property in the intertidal area approximately 100 feet
landward of the existing apparent high water mark. This stand of S~)artina patens
extends from the east to the west side of the property and continued across to your
property and lhe existing timber jetty structures. Although beach grass and other
upland species are also present in the area, there were significant stands of Spartina
patens in the area.
I also inspected the nodhern boundary of the property and the propedy to the north of
the right of way off of Camp Mineola Road. The boundary of the road/right of way was
flagged as wetlands and I did find some wetland indicator species including Baccharis
halimifolia and Phraclmites communis. However, I also noticed a large number of
upland species including Autumn olive, wild cherry, rosa ragosa, eastern red cedar,
and others. Moreover, the present tidal wetlands line from the prevailing tidal wetlands
map indicates that the tidal wetlands boundary is along the shoreline well to the north
of the right of way. The abundance and diversity of wetland plants along the flagged
boundaries was significantly less than lhe S~arfina oatens area on the south side of the
property.

& swimming pool (800 s.f) a minimum of 82' landward of the tidal wetlands boundary located to the north
of the subject lot. The proposed septic system will be located a minimum of 155' landward of said tidal
wetlands boundary and will be enclosed by a proposed concrete retaining wall (top of wall = el. 9.0).
Approximately 125 c.yds, of clean fill will be required for the proposed sanitary system.
