(631) 765-1809• Fax (631) 765-9064 FINDINGS, DELIBERATIONS AND DETERMINATIQLI old OV iIC MEETING OF APRIL 14, 2005 ZB Ref. 5677 — GREGORY and BARBARA WOOD Property Location: 840 Marlene Lane, Mattituck CTM 143-2-20.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 21,750 sq. ft. parcel has 150 feet along the west side of Marlene Lane, and is improved with a single-story frame dwelling and accessory building, shown on the July 19, 2004 survey, amended August 11, 2004 by Peconic Surveyors, P.C. BASIS OF APPLICATION: Building Department's January 10, 2005 Notice of Disapproval, citing Section 100-244, in its denial of a building permit to construct a new dwelling, after removal of the existing dwelling, in a location at less than 50 feet from the rear lot line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 31, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct a new two-story dwelling with a rear porch and attached garage. The rear of the dwelling will be 41.7 feet, measured from the new porch to the front lot line, and after demolishing the existing one-story home and accessory building. The new construction is shown on the site diagram submitted by Fairweather- Brown Design Associates, Inc. to the ZBA, date-stamped Feb. 2, 2005, and the elevation and floor diagrams dated 2/1/05 prepared by Robert I. Brown, R.A. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicants wish to demolish both the one- story older home and garage, and build a new single-family dwelling, with attached garage. The rear porch of the new house which will be only 41.7 feet at its closest point to the rear lot line is for a • Page 2—April 14, 2005 • • ZB Ref. 5677—G. and B.Wood CTM ID: 143-2-20.1 porch. The code requirement is a minimum of 50 feet for a principal building on this lot, based on the size of the lot at 21,750 sq. ft. (over 20,000 sq. ft. and under 39,999 sq. ft.). In viewing the many homes in the westerly section of this block, and noting that the lot is 145 feet, the Board agrees with the reasoning of the applicants. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The lot is only 145 feet deep. Although the location requires a rear setback reduction, the new dwelling is proposed to meet all other setback requirements of the code. 3. The difficulty was not self-created and is related to the applicant's plan to build a new dwelling on a 150' x 145' lot, and removing the two older buildings presently existing on the property. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Orlando, and duly carried, to GRANT the variance as applied for, as shown on the site diagram submitted by Fairweather- Brown Design Associates, Inc. to the ZBA, date-stamped Feb. 2, 2005. The new dwelling is also shown on the elevation and floor diagrams dated 2/1/05 prepared by Robert I. Brown, R.A. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. PROPERTY FACTS/DESCRIPTION: The applicant's 21,750 sq. ft. parcel has 150 feet along the west side of Marlene Lane, and is improved with a single-story frame dwelling and accessory building, shown on the July 19; 2004 survey, amended August 11, 2004 by Peconic Surveyors, P.C. BASIS OF APPLICATION: Building Department's January 10, 2005 Notice of Disapproval, citing Section 100-244, in its denial of a building permit to construct a new dwelling, after removal of the existing dwelling, in a location at less than 50 feet from the rear lot line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 31, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct a new two-story dwelling with a rear porch and attached garage. The rear of the dwelling will be 41.7 feet, measured from the new porch to the front lot line, and after demolishing the existing one-story home and accessory building. The new construction is shown on the site diagram submitted by Fairweather- Brown Design Associates, Inc. to the ZBA, date-stamped Feb. 2, 2005, and the elevation and floor diagrams dated 2/1/05 prepared by Robert I. Brown, R.A. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicants wish to demolish both the one- story older home and garage, and build a new single-family dwelling, with attached garage. The rear porch of the new house which will be only 41.7 feet at its closest point to the rear lot line is for a Page 2—April 14,2005 ZB Ref. 5677—G. and B.Wood CTM ID: 143-2-20.1 porch. The code requirement is a minimum of 50 feet for a principal building on this lot, based on the size of the lot at 21,750 sq. ft. (over 20,000 sq. ft. and under 39,999 sq. ft.). In viewing the many homes in the westerly section of this block, and noting that the lot is 145 feet, the Board agrees with the reasoning of the applicants. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The lot is only 145 feet deep. Although the location requires a rear setback reduction, the new dwelling is proposed to meet all other setback requirements of the code. 3. The difficulty was not self-created and is related to the applicant's plan to build a new dwelling on a 150' x 145' lot, and removing the two older buildings presently existing on the property. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
