TERMS end CONDITIONS
The Permirtee RICHARD O'TOOLE
residing at 55 Locust Street. Floral Park. NY il001 N.Y. as
part of the comideration for the issuance of the Permit does understand and prescribe to the fol-
lowing:
1. That hhe said Board of Trustees and the Town of Southuld are released from any and
all damages, or claims for d~m~ges, of suits arising directly or indirectly as a result of any oper~
ation perfotmed pursuant to this permit, and the said Permit~ee will, at his or her own expense,
defend any and ail such suits'initiated by third pm~ies, and the said Permittee assum*s full liability
with respect thereto, to the complete exclusion of the Board of Trustees of the Town of
2. That this Pem~it is valid for a period of 24 mos. which is considemt to be the
estimated time required to complete the work involved, but should dxctmmances watrang request
for an extemion may be made to the Board at a later date.
3. That this Permit should be re~lned indefinitely, or as loag as the ~id Permit~e wishes
to maintain the strucmce or proiect involved, to provide evidence m anyone concerned that auth-
orization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or
its agents, and non-compliance with the provisions of the originating application, may be cause for
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interfeceace with navigation as a result of the work
herein au'tl~tized.
6. That there shall be no interference with the fight of the public to pass and repass dong
the beach between high and low water marks.
7. That if future opa'adons of the Town of So~thold requLre the mm~al and/or alteradom
in the locadon of the work herein ~mthorlzed, or if~ in the opinion of the Board of Tsu~ee~ the
work shall cause unreasonable obstroeaon to free navigation, the said Pemaittee will be requh~
upon due notice, to remove or alter this work or project herein stated without elrpemes to the Town
of 5outhold.
8. That the said Board will be notified by the Permittee ot the completion of the work auth-

WHEREAS, RICHARD O'TOOLE, applied to the Southold Town Trustees
for a permit under the provisions of the Wetland Ordinance of
the Town of Southold, application dated June 29, 1999 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on July 21, 1999, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members
familiar with the premises
and,
have personally viewed and are
in question and the surrounding area,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
RICHARD O'TOOLE to construct a 20' X 40' inground pool subject
to receiving a new survey showing drywell on landward side of
pool, and a non-turf/non-fertilized buffer along bulkhead, &
between pool and bulkhead
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

and permit issued within six months of the date of this
notification.
Two inspections are ~equired and the Trustees are to be notified

CONSERVATION ADVISORY COUNCIL
At the meeting of the Southold Town Conservation Advisory Council held Monday, July 19,
1999, the following recommendation was made:
Moved by Bret Hedges, seconded by Richard Smith, it was
RESOL YED to recommend to the Southold Town Board of Trustees APPROVAL WITH
STIPULATIONS the Wetland Permit Application of RICHARD O'TOOLE 122-4-10 to
construct a 20'X 40' in-ground pool.

Although the pool was not staked, the CAC recommends Approval with the Stipulation that the
pool be moved back as close to the house as possible and drywells be installed.
