SCTM#122-3-12&13 The in-kind replacement of existing floating dock and replacement with a catwalk is an exempt Minor Action and not subject to LWRP review pursuant to Chapter 268-3; Items A and B of the Town of Southold Town Code. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Southampton, NY 11968 RE: GRACE & JOSPEH FINORA 45 & 135 EAST LEGION AVE., MATTITUCK SCTM#122-3-12&13 Dear Mr. Herrmann: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, September 22, 2004 regarding the above matter: WHEREAS, En-Consultants, Inc. on behalf of GRACE & JOSEPH FINORA applied to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated September 1, 2004, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on September 22, 2004, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, z WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of JOSEPH & GRACE FINORA to construct slow-sill bulkhead to tie into southeasterly extent of rip-rap placed by NY State Dept. of Transportation, to be constructed with vinyl sheathing and all timber to be CCA-treated). Approx. 10'X 87' area seaward of proposed low-sill bulkhead to be dredged via excavator or clamshell bucket crane to a max. depth of -2' ALW in order to reclaim approx. 35 cy. of sand/silt spoil, which is to be immediately returned to unvegetated inter-tidal area landward of low-sill bulkhead and seaward of existing wetland vegetation for purposes of re-establishment and restoration of vegetated inter- tidal marsh. Spoil backfill to be planted with Spartina Alterniflora (12" on center). Existing dock to be temporarily removed and replaced (inkind/inplace) for purposes of bulkhead installation. Similar stone rip-rap (10-15 lbs.) to be used to fill any gap between existing NYS rip-rap and proposed bulkhead (+/-30 sf.), and all as depicted on the plan prepared by En-Consultants, Inc. last dated November 2, 2004. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) Therefore, we have revised the project plan to shorten the proposed easterly section of bulkhead from ±90' to +52 feet and construct an obliquely angled 10-foot easterly return that will allow the low-sill bulkhead to transition landwazd into the area of existing wetland vegetation. Consistent with the notion of not disturbing this most easterly wetland area, we have also modified the proposed dredge area by translating it to the northwest, and due to the mazginally reduced backfill area, it was also possible to mazginally reduce the dredge area from 10' x 90' to 10' x 8T. Please also note that while the proposed bulkhead construction will no longer require the removal and replacement of the existing dock, the applicants would still like to repair and/or replace the dock as necessary, in-kind and in-place. Therefore, 1 have not eliminated Note #7, which references the replacement of the dock. As Ms. Graulich advised me that she was able to locate the dock on the Department's pre-1977 remote imagery, I assume that there will be no objection to this aspect of the project. By copy of this letter and revised plans, I am similazly notifying the Town of Southold Trustees of the described changes so that their permit can be issued.
