Box 244 Wading River, NY 11792 RE: WALTER & MARILYN GATZ SCTM#121-4-8.4 Dear Mr. Pfennig: The Southold Town Board of Trustees reviewed the survey dated December 12, 2000 and last revised January 6, 2001 and determined the construction of single-family dwelling, pool, and garage, to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code. However, any activity within 100' of the Wetland line would require a permit from this office. This determination is not a determination fcom any other agency. A no jurisdiction letter was issued by the Trustees, with the requirement of no clearing within 100' of the wetland and pond. SCTM 121-4-8.4 Laurel Lake Rd, Mattituck Complaint was there was clearing. There was a Building Dept permit issued. Would you please check that the clearing is not within 100' of the wetland/pond area and let us know if haybales are needed to protect that area; it is a steep slope. Thanks. PO Box 244 Wading River, NY 11792 May 29, 2001 Re: Application #1-4738-02817/00001 Dear Mr. Pfennig: Based on the information you have submitted, the New York State Department of Environmental Conservation has determined that: Your proposed project to construct a single family dwelling, septic system, swimming pool, gara~le, driveway and associated clearing, grading and ground disturbance at Laurel Lake Read Mattituck, NY, SCTM #1000-121-04-8.4, as shown on the survey by Joseph A. Ingegno last revised 5/7/01, is more than 100 feet from regulated freshwater wetlands. Therefore, no permit is required under the Freshwater Wetlands Act (Article 24 of the Environmental Conservation Law). Be advised, that all construction, clearing, and/or ground disturbance must remain more than 100 feet from the freshwater wetland boundary. In addition, any additional work, or modification to the project as described, may require authorization by this Department. Please contact this office if such are contemplated.
