Dear Ms. Wesnofske:
The Southold Town Board of Trustees reviewed the survey prepared by Keyspan
Engineering & Survey, Inc. last dated May 24, 2004 and determined the proposed
subdivison to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland
Code and Chapter 37 of the Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above, without a permit. It is your responsibility to ensure that
all necessary precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and
Coastal Erosion Hazard Area, which may result from your project. Such precautions
may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and the coastal erosion hazard area and your project or erecting a temporary
fence, barrier, or hay bale berm.
However, any activity within 100' of a Wetland line 0¢ seaward of the Coastal Erosion
Hazard Area would require permits from this office.
This determination is not a determination from any other agency.

Dear Mr. Krupski:
The Peconic Land Trust is currently in the process of subdividing the former Keyspan
property in Jamesport. The Town of Riverhead will take the lead in reviexving and issuing
approval to the subdivision. However, a small portion of the 513-acre site lies within the
Town of Southold. There is a 1.75-acre freshwater wetland on the portion of the property
located in Southold Town as well as frontage on Long Island Sound.
No improvements are proposed on the property. We are merely subdividing the
parcels into individual farms. Thus, we respectfully request a letter of non-jurisdiction fro
your agency. Please let us know if you require any additional information.
