NANOP-RE APPLICATION NO. 86-273-L2 PUBLIC NOTICE NO. 12639-86-273-L2 DESCRIPTION OF WORK The applicant, Lagoon Association at Nassau Point, requests Department of the Army authorization to dredge with ten years maintenance with beach disposal in Little Peconic Bay, at Cutchogue, Town of Southold, Suffolk County, New York. The work would involve dredging approximately 300 cubic yards of material from the entrance channel of South Lagoon to a depth of 6 feet below mean low water with disposal of all dredged material on the beach to the north of the lagoon, above the line of mean high water. The applicant estimates that maintenance dredging may be required once a year to remove approximately 200 cubic yards of material, which would also be placed on the northern side of the inlet on the beach above mean high water. Also proposed is to remove, by clam shell crane, approximately 2000 cubic yards of material from the beach on the south side of the inlet above the mean high water line and deposit it at the aforementioned dredged material disposal site, on the north side beach above mean high water. The stated purpose of the proposal is to provide water depths adequate for safe navigation and to transfer littoral sand deposits to a downdrift site. i j . Thurber Senior Environmental Analyst Bldg. #40 SUNY, Room 2191 Re : Permit No. 10-85-0771 Stony Brook, New York 11794 Dear Mr. Thurber: As Chairman of the Waterways Committee, appointed by the Supervisor of Southold Town , I would like to comment on the above permit , application of Lagoon Association, Nassau Point, Cutchogue, N.Y. 11935. There is no object ' to maintenance dredging of the mouth of the lagoon 200' x 3or x 6 ' deep. What we would like to convey to the applicant as well as to your office, is the futility of placing the spoil updrift of the channel that is to be dredged. The littoral drift of sand for centuries has been to the north along the west side of Nassau Point . Evidence of this accumulation of drift can be plainly seen to the north at Meadow Beach, a Nature Conservancy Preserve. Littoral drift is a natural phenomona and part of most of our shore lines . Stopping this littoral drift is robbing the shores downdrift and eventually eroding those shores because of lack of sand. The placement of spoil to the south (updrift) only aggravates the situation by causing a build up of sand along the south side of the entrance jetty . This continual buildup each time the mouth is dredged eventually flows round the jetty and fills the channel causing the need for dredging more often. It would be wiser and more natural to place the spoil down drift to the north. Therefore, we are suggesting that all dredging operations on the entire west side of Nassau Point have the spoil placed to the north so as not to inhibit the natural flow of sand along these beaches . , - t4-12-4(3182) NEW YORK STATE DEPARTMENT OF ENVIRONMENTAL CONSERVATION NOTICE OF COMPLETE APPLICA Applicant: Lar;oon association (ci o George )3arrell) I Date ecemec:'_'TV IL"r, Address: Nassau Point Road E)1 O Cutchorue, '.ew York 11935 Permitsapplied forand application number(s) Tienil 'ietlands Protection nY tdater "wility - aerr i 'To 1^-3 -r)77' Project description and location.TownXity of Southold County of o Frnl k Dredge. entrance channel 200' x 30' to o' below mean low water. Haje, President En-Consultants, Inc. 1329 North Sea Road Southampton, New York 11968 RE: #10-85-0771, LAGOON ASSOC. (BURRELL) Dear Mr. Haje: A letter from a Town official objecting to the proposed spoil site to the south (updrift) of the entrance channel has been submitted regarding this project (see enclosed) . Please submit an explanation as to why the spoil site is proposed to the south. Since the Town of Southold may require that dredging operations on the entire west side of Nassau Point have spoil placed to the north (down drift) of the dredging site (so as not to deplete the natural flow along these beaches) , it is suggested that you contact the Town of Southold to see what needs to be done to comply with Town requirements. Since the Town may call for modifications in this project, DEC is suspending processing of your application. This way we may avoid a need for Hearing and/or need to apply for a Permit Amendment or a new Permit with DEC at a later date. When we have obtained a determination or further advisement from the Town, we will further process your application. Whatever spoil site is determined to be acceptable to the Town, you will need to submit to DEC a detailed site preparation plan on a recent or updated survey at a scale 1" = 50' , 1" = 40' , 1" - 30', or 1" = 20' , showing width of dikes, outlines and relationship to mean high water and nearby tidal wetlands edges. A cross- section showing slopes and height should be included. Thank you for your anticipated cooperation on this matter. Very truly yours, Robert N. The question of whether an action may be significant is not always easy to answer. Frequent- ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine significance may have little or no formal knowledge of the environment or may be technically expert in environmental analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action. Full EAF Components: The full EAF is comprised of three parts: Part 1: Provides objective data and information about a given project and its site. By identifying basic project data, it assists a reviewer in the analysis that takes place in Parts 2 and 3. Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially- large impact. The form also identifies whether an impact can be mitigated or reduced. f Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the / impact is actually important. DETERMINATION OF SIGNIFICANCE—Type 1 and Unlisted Actions Identify the Portions of EAF completed for this project: ❑ Part 1 C] Part 2 ❑Part 3 Upon review of the information recorded on this EAF(Parts 1 and 2 and 3 if appropriate), and any other supporting information, and considering both the magitude and importance of each impact, it is reasonably determined by the lead agency that: ❑ A. The project will not result in any large and important impacts) and, therefore, is one which will not have a significant impact on the environment, therefore a negative declaration will be prepared. ❑ B. Although the project could have a significant effect on the environment, there will not be a significant effect for this Unlisted Action because the mitigation measures described in PART 3 have been required, therefore a CONDITIONED negative declaration will be prepared.' ❑ C. The project may result in one or more large and important impacts that may have a significant impact on the environment, therefore a positive declaration will be prepared. Applicant,Sponsor Name Date Signature Title If the action is in the Coastal Area, and you are a state agency, complete the Coastal Assessment Form before proceeding with this assessment. - 5 Part 2—PROJECT IMPACTS AND THEIR MAC NUDE Responsibility of Lead Agency General Information (Read Carefully) • In completing the form the reviewer should be guided by the question: Have my responses and determinations be reasonable? The reviewer is not expected to be an expert environmental analyst. • Identifying that an impact will be potentially large (column 2) does not mean that it is also necessarily significant Any large impact must be evaluated in PART 3 to determine significance. Identifying an impact in column 2 simp asks that it be looked at further. • The Examples provided are to assist the reviewer by showing types of impacts and wherever possible the threshold magnitude that would trigger a response in column 2. The examples are generally applicable throughout the State ar for most situations. But, for any specific project or site other examples and/or lower thresholds may be appropria for a Potential Large Impact response, thus requiring evaluation in Part 3. • The impacts of each project, on each site, in each locality, will vary. Therefore, the examples are illustrative ar have been offered as guidance. They do not constitute an exhaustive list of impacts and thresholds to answer each questio • The number of examples per question does not indicate the importance of each question. • In identifying impacts, consider long term, short term and cumlative effects. Instructions (Read carefully) a. Answer each of the 19 questions in PART 2. Answer Yes if there will be any impact. b. Maybe answers should be considered as Yes answers. c. If answering Yes to a question then check the appropriate box (column 1 or 2) to indicate the potential size of th impact. If impact threshold equals or exceeds any example provided, check column 2. If impact will occur but threshol is lower than example, check column 1. d. If reviewer has doubt about size of the impact then consider the impact as potentially large and proceed to PART e. If a potentially large impact checked in column 2 can be mitigated by change(s) in the project to a small to moderat impact, also check the Yes box in column 3. A No response indicates that such a reduction is not possible- Th: must be explained in Part 3. 1 2 3 Small to Potential Can Impact Be Moderate Large Mitigated By IMPACT ON LAND Impact Impact Project Change 1- Will the proposed action result in a physical change to the roject site? the ❑YES Examples that would apply to column 2 • Any construction on slopes of 15% or greater, (15 foot rise per 100 ❑ ❑ ❑Yes ONO foot of length), or where the general slopes in the project area exceed 10%. • Construction on land where the depth to the water table is less than ❑ ❑ Dyes ONO 3 feet. , • Construction of paved parking area for 1,000 or more vehicles. ❑ ❑ ❑Yes ONO • Construction on land where bedrock is exposed or generally within ❑ ❑ ❑Yes ONO 3 feet of existing ground surface. • Construction that will continue for more than 1 year or involve more ❑ ❑ ❑Yes ❑No i than one phase or stage. • Excavation for mining purposes that would remove more than 1,000 ❑ ❑ ❑Yes ❑No tons of natural material (i.e., rock or soil) per year. • Construction or expansion of a sanitary landfill. ❑ ❑ Oyes ❑,N0 • Construction in a designated floodway ❑ ❑ ❑Yes ON • Other impacts Da ❑Yes ONO 2 Will there be an effect t- -..iy u;:,que or unusual land for is found on the site?
