RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Permit
#5362 to construct a new vinyl-sheathed bulkhead within 18", measured face-to-face of the
sheathing, of the existing bulkhead which existing bulkhead totals 32 linear ft. Fill space between
old and new bulkhead with clean sand, all with the condition that a 10' non-turf buffer is
installed landward of the bulkhead.

RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of
the Amendment Request of FREDERICK MAYNE to Amend Permit #5362 to cdnstruct
new vinyl-sheathed bulkhead within 18", measured face-to-face of the sheathing, of the
existing bulkhead which existing bulkhead totals 32 linear ft. Fill space between old and
new bulkhead with clean sand.
Located: 860 Bayberry Rd., Cutchogue. SCTM#118-1-15.1
The CAC recommend Disapproval of the application within 18" and recommends in-
place replacement only, and a 10' non-turf buffer behind the bulkhead.
The practice of replacing structures within 18" has a negative impact to the wetland
resource and would infringe upon and take away from the public domain. Replacing
bulkheads within 18" has an accumulative effect on the loss of wetland resources
throughout the Town of Southold.

The Board of Town Trustees took the following action during its regular meeting held on
Thursday, June 21, 2001 regarding the above matter:
WHEREAS, Proper-T Permit Services on behalf of FREDERICK MAYNE applied to the
Southe[d Town Trustees for a permit under the provisions of the Vv'etla~:d Ord~.nance of the ~'own
of Southold, application dated May 29, 2001, and,
'WHEREAS, said application was referred to the Somhold Tov. m Conse:r, ratiop. Advisory Conncil
fcr their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to 3aid application on
June 21, 2001, at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS. the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of FREDERICK MAYNE to
remove and replace, inkind/inplace, 32 linear ft. of bulkhead.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire two years from the date the permit is signed.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified upon completion of said project.

The properly owner, Frederick Mayne, wishes to again amend the referenced permit. It is now
proposed that the bulkhead will be replaced in-kind, in-place as originally proposed, and in addi-
tion, all of the remaining bulkheading and wooden walks on the Mayne property will be replaced
rather than only the 32' originally proposed. The Project Description should be revised to read as
