The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, December 19, 2001:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Permit
#5326 to construct a new vinyl-sheathed bulkhead within 18", measured face-to-face of the
sheathing, of the existing bulkhead which existing bulkhead totals 173 linear ft.; construct new
96 linear ft. of 4' wide walk, 4'X 6' stair landing, and 4'X 7' stairs to grade to replace existing
structures of the same size. Fill space between old and new bulkhead with clean sand. All
proposed activities approved with the condition of a 10' non-turf buffer installed landward of the
bulkhead.

At the meeting of the Southold Town Conse~ation Advisory Council held Thursday,
December 13, 2001, the following recommendation was made:
Moved by Scott Hilary, seconded by Melvyn Morris, it was
RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAl. of
the Amendment Request of JOANNE MCSHERRY to Amend Permit #5326 to construct
a new vinyl-sheathed bulkhead within 18", measured face-to-face of the sheathing, of
the existing bulkhead which existing bulkhead totals 173 linear ft; construct new 95
linear ft. of 4' wide walk, 4'X 6' stair landing, and 4'X 7' stairs to grade to replace
existing structures of the same size. Fill space between old and new bulkhead with
clean sand.
Located: 660 Bayberry Rd., Cutchogue. SCTM#118-1-13.1
The CAC recommend Disapproval of the application within 18" and recommends in-
place replacement only, and a 10' non-turf buffer behind the bulkhead.
The practice of replacing structures within 18" has a negative impact to the wetland
resource and would infringe upon and take away from the public domain. Replacing
bulkheads within 18" has an accumulative effect on the loss of wetland resources
throughout the Town of Southold.

Dear Mr. Fitzgerald:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, April 25, 2001 regarding the above matter:
WHEREAS, James E. Fitzgerald, Jr. on behalf of JOANNE MCSHERRY applied to the
Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town
of Southold, application dated April 4, 2001, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
April 25, 2001, at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of JOANNE MCSHERRY to
remove and replace, inkind/inplace, 173 linear ft. of bulkhead, 95 linear ft. of 4' wide walk, 4'X
6' stair landing, and 4'X 7' stairs to grade.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire two years from the date the permit is signed.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified upon completion of said project.

Dear Sir:
The property owner, Joanne McSherry, wishes to amend the referenced permit to allow
installation of a new bulkhead within 18" seaward of the existing bulkhead. The Project
Description should be revised to read as follows:
· PROJECT DESCRIPTION: Construct new vinyl-sheathed bulkhead within 18
inches, measured face-to-face of the sheathing, of the existing bulkhead which
existing bulkhead totals 173 linear feet; construct new 95 linear feet of 4-foot wide
walk, 4' x 6' stair landing, and 4' x 7' stairs to grade to replace existing structures of
the same size. Fill space between old and new bulkhead with clean sand.
