SCTM# 98-1-11.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are INCONSISTENT with the Policy Standards (Policy 6.3) and therefore are INCONSISTENT with LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. Permits were not found in Town records for the "as built" retaining wall structure. Further the retaining wall was not designed or approved by an Engineer. It is recommended that the Board require an Engineer certify the as -built plans. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Walls are on east side of property between bulkhead and house. Retaining wall stabilizes an 8' berm. Re -grade and plant native plants along wall. North and south walls to be connected and made contiguous (108' in total). A 24' return would be added on north end of the north wall. Permit request is for a full amendment to our house permit (#6287) for the as -built retaining wall. Project Plan: The project plan attached includes five (5) diagrams and several pictures: • Diagram 1 provides a look -down view including retaining wall position relative to the bulkhead and house as well as tidal wetlands boundaries and high water marks. Location of the berm that the retaining wall stabilizes is also shown. Retaining wall is highlighted in green. • Diagram 2 is an exploded look -down view with specific dimensions of the retaining wall • Diagram 3 is a detailed cross-sectional view of the retaining wall. It represents how the wall is constructed, its relationship to the berm and the bulkhead, and the area requiring backfill. Backfill will also repair the erosion damage. • Diagram 4 is another cross-sectional view that provides a broader view of the retaining wall • Diagram 5 is a 24x36 survey sheet from when our home was built 5 years ago. Older surveys show more of the original retaining wall which ran parallel to the bottom of the bank. Background: Hurricane Sandy did a great deal of damage to our property. We have been cleaning up for two years doing all the work ourselves. The bulkhead held up well, but the storm surge came over the bulkhead and damaged the berm between the bulkhead and our home. The storm surge killed trees & plants and there was a lot of erosion, most especially in the berm. The storm uncovered 18"-24" retaining walls which stabilize the berm. Posts for our deck were exposed and we were concerned about the general integrity of the berm. We initially tried to just replace horizontal boards, but it became clear that the condition of the posts made this impractical. We increased the height of the replacement wall to 40" to match the height of the south retaining wall. We made the wall contiguous and connected it to the south retaining wall. We stopped the project when we found out we needed a permit and are submitting this application before proceeding any further.
