As indicated by several heavy rainstorms over the past month the system is working well to drain the water. In addition to the current situation the Board wants an additional ditch to run north of the tree on Mr. Hurtado's property and towards your back drain. Keeping that drain cleaned help will also be helpful. Please mark this on a survey and submit it to the Board. Please contact this office for a final inspection at the completion of the drainage work. The Trustees met with you at their Wednesday March 23, 2005 work session to discuss the drainage issues. They came to an agreement with you at that time regarding a plan to comply with your permit and contain runoff on site. On March 28, 2005 this office sent you a letter confirming this agreement. On April 14, 2005 you brought a plan into the Tmstee's office, indicating the plan for a retaining wall and the connection of the trench to the drywell. To date the only part of the agreement in place is the placement of hay bales on the Northwest side of your property. The Trustees are requiring that the drainage ditch to the south be cleaned out, where soil has filled it in. The fill has covered the hay bales and the drainage ditch is now too narrow to work correctly for containing the water. Please clean out this drainage ditch as soon as possible. Our understanding is that you have a long range plan of completion, that includes the retaining wall to the north, opening the drainage ditch on the south to widen it, native plantings around the water and landscaping, with a non-turf buffer from the 10' contour to the perimeter of the property. The agreement/requirement is the commencement of this work within 30 days o£receipt of this letter. The work is not required to be completed within 30 days, but it must be started or you will be in violation of your permit. The Permit for the above referenced site, #5721, was issued on March 18, 2003 and was valid for 2 years. All work is to be completed within those 24 months with a final inspection at the end. Please apply to the Trustees for an extension to your permit if you do not expect to be completed within the next few months. Please be aware that failure to comply with the terms of a permit may be subject to fines up to $4000.00. In order to avoid this we respectfully request the work be completed. WHEREAS, Glenn Heidtmann, Jr. applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated December 16th, 2002. On January 22, 2003, I attended a Board of Trustees meeting to present my situation to the Board, since the hearing was scheduled to include addressing a wetlands issue involving 600 Albacore Drive. Unfortunately, Mr. Glenn Heidtmann, owner and builder for the 600 Albacore Drive property, cancelled his hearing at the last moment. If you recall, 1 did have the chance to speak to you briefly in the hall to explain my situation. As a result of our conversation, you suggested that I speak with Mr. Scott Hughes to see if he could help me, especially with regard to inspecting the problem area. However, after discussion with Mr. Hughes and trying to schedule an inspection, he suggested that the best way to proceed would be to formally request of the Board of Trustees a site inspection. It is my understanding that the next date for site inspections is scheduled for March 12, 2003. Therefore, 1 would like to request that my property be included on the site inspection list for March 12. Since I would like to be present at the site inspection, I also would like to request that I be informed of the time. My preference would be either for early morning or late afternoon. I have enclosed a survey of my property for your information. Please call me to confirm receipt of this letter to schedule the site inspection on March 12. My property is Section 57, Block 1, Lot 23 located at 495 Dolphin Drive in Southold Shores. A low lying area is located on Lot No. 20 adjacent to my property, which previously was drained by a ditch maintained by the Suffolk County Department of Health Services (SCDHS) Vector Control. As a note, I have been discussing this problem and have met with the Town of Southold Highway Department (Mr. Peter Harris and Mr. Charles King) and Building Department (Mr. Bruno Semon), and the SCDHS Vector Control (Mr. Thomas Iwanejko). When the house on Lot No. 21 was being constructed in the spring (2002), I spoke to Mr. Glenn Heidtmann, who is the owner of the lot and builder, about a drainage problem he was creating behind my house because he fi'lled in the drainage ditch that ran through his property and was maintained by SCDHS Vector Control. He explained that he was aware of the problem and that, as part of development of his property, he would construct a culvert to replace the drainage ditch he filled. It is my understanding that the Board of Trustees have placed a stop work order on Lot No. 21 due to construction within 100 feet of wetlands. By not allowing Mr. Heidtmann to install a culvert, this has caused the entire Lot No. 20 to flood and encroach at least 40 feet on to my property, which is getting worse after each precipitation event. I would like to petition the Board of Trustees to direct and allow Mr. Heidtmann to construct the culvert he told me he was going to install in order to relieve the flooding problem on my property as soon as possible, since the water is threatening to flood my garage and is getting to within about 40 feet of my house. If a culvert cannot be installed at this time, I would like to request that Mr. Heidtmann be directed by the Board to construct a temporary drainage ditch at this time to relieve the water. Albert Krupski January 15, 2003 Page Two Since I do not think I will be able to attend the wetland permit hearing on Lot No. 21 on January 22, 2003, I would like to request that this be entered into and read at this meeting, and request your help in resolving this problem which is seriously impacting my property and threatening my house. In addition, this flooding situation and standing water will create a serious mosquito breeding problem in the summer and a potential health problem. Krupski, President Board of Town Trustees Southold, NY Dear Mr. Kmpski; This letter concerns an application by Glenn Heidtmann for a wetlands permit to build a house on Lot 21, Map of Southold Shores. I have lived here for almost 30 years and hope that Mr. Heidtmann will be able to build a home here. However, there are problems which should be addressed and which he should have considered when plann'mg to build. About 25 years ago Henry Voelbel resided in a home on Lot 23 of this subdivision which adjoins Lot 21 and is now owned by Carl Christianson. Mr. Voelbel asked me what he could do to solve the problem of water standing in his basement. 1 told him that there were two things he could do; (1) install a pump and keep pumping although there was no place to pump the water to and it would keep coming back, (2) fill in the basement. I believe that he finally followed my second suggestion. I was smprised to see Mr. Heidtmann excavate for a basement knowing that it would flood when there was a period of wet weather. The grade of the lot was raised so that it forms a dam which prevents the natural flow of water from Lot 20 to a drain on Blue Marlin Drive. For years the Suffolk County Mosquito Commission ( now Vector Control ) maintained a drainage ditch through this property which is closed up by the regrading. At the present time most of Lot 20 is flooded and I hear that someone is planning to build there. The only drain that carries away the accumulation of water on these lots runs from the north side of Blue Marlin Drive south to the bay through private property. It was placed there over 30 years ago by the owner of the lot through which it runs. If this drain pipe ever becomes stopped up there will really be a serious flooding problem. When the Town took over the roads several years ago I explained the situation to Ray Jacobs and gave him a map showing the existing drainage. There is a small basin at the comer of Blue Marlin Dr. and Dolphin Dr. Apiperuns fromthis basin along the west side of Lot 3 to the bay which was installed by the owner of Lot 3. Later the Southold Shores Association had a pipe installed on the east side of Dolphin Drive from this basin to an inlet at Lot 19. The "Map of Southold Shores" which was filed in 1963 shows several drams which were probably shown on the subdivision map to have it approved but were never completed. Small bas'ms with curb inlets were placed at these locations but were never connected to any drainage structure and as there are no curbs these basins would serve no purpose even if they were so connected. If I were Mr. Heidmaann I would forget a basement and use a concrete slab on grade as a foundation. A full basement will have to be designed 100 % waterproof with a reinforced concrete floor slab designed as a structural slab to withstand hydrostatic uplit~ pressure. I doubt that any contractor would construct such a foundation. He must be required to provide a drain through his property to replace the former drainage ditch. I am sure that you are already aware of most o£the foregoing facts but I thought it wise to inform you mayway as most of the residents in the area now were not here 25 or 30 years ago. The roads within this subdivision were dedicated to the Town approximately 10 years ago. At that time, all road & site drainage was directed through a Iow lying ditch systems that diverted all run-off to the Iow vegetated wetland areas surrounding the Subdivision. At that time, the lot referenced above had a ditch system traversing the site. This ditch allowed the roads and other surrounding lots to adequately drain off. Since the excavations for construction began, the drainage system has failed. Ditches were filled in and water has backed up creating flooding conditions that had never existed prior to excavations and grading of this site. In addition, the area excavated for the basement or crawl space has been totally filled in with water. Due to the amount of clayed material disturbed during the excavation and the amount of water present, any foundations placed or constructed to support new construction at this site will need to have project specific engineering performed by a licensed professional to verify the stability of the foundation system proposed for new construction. Simply filling the hole with excavated clayed material would not be considered suitable or stable enough to support any new construction. With the amount of clay in the area, it is highly unlikely that standard drainage systems would provide adequate recharge to solve the current drainage problems. I would recommend that the applicant be required to provide a complete drainage design prepared by a licensed engineer that would rectify the above referenced site drainage problems. It appears that wetlands occur in the area immediately to the east of the fill and to the west of the fill...standing water currently exists in both areas. Most likely, the applicant filled a portion of the wetland system to the east, however, the current fill makes it difficult to determine how much. The fill pad was placed in the area to construct a single family residence with a garage. Following placement of the fill pad the applicant dug through the fill pad to below grade. The area that was dug filled with groundwater and precipitation. The reason it filled so quickly is due to a high groundwater elevation coupled with poorly drained soils (most likely a wetland system depending on grade). The soil type consists of Riverhead Sandy Loam 0 to 3 percent and Walpole Sandy Loam which is commonly found along the margins of tidal marshes and creeks. Walpole Sandy Loam is poorly drained or somewhat poorly drained soils with a seasonal hiqh water table. The SEQR form submitted is incorrect in that it does not identify wetlands in the significant habitat area section. However, no wetlands were shown on the survey. No wetlands were also identified in the Trustee application in addition, no fill was identified either. The 6' wide "ditch" is misleading in that although it is a swale it also is a wetland system. Only if all drainage systems could look like that. The Trustees may want to request the submission of a long EAF now based upon new information not previously stated. I also would be concerned with drainfield failure regarding the septic system. The applicant is creating a building pad surrounded by high water in certain seasons. I think that a basement may not be possible.., even a foundation may require dewatering the site. Due to the hydrology, this site may not be the best location for a below grade home. The Trustees may want to require an engineers report mapping groundwater elevations in regard to the septic and home design as a supplemental item to the SEQR review. Silt fence, hay bales and/or removal of fill could be required at this time to prevent the further encroachment into the wetland drainage system limiting its function. In addition, it is very likely that the collector itself is filled with silt and cannot work effectively. As you are aware, at the June 22, 2005 Board of Trustees meeting, it was agreed by the Board and Mr. Heidtmann, that Mr. Heidtmann was to complete all drainage work; including construction of an effective system to drain water from the property west at 450 Albacore within 60 days, that being August 22, 2005. To date this still has not been completed. At a minimum, in addition to the drainage ditch being routed north/west of the tree as directed in your November 22, 2005 letter, the entire west drainage ditch needs to be deepened, silt blocking the water collector needs to be removed and the water collector itself should be cleaned out to ensure that the system works properly as intended, which is to drain water from the 450 Albacore property in an effective and timely manner. To make matters worse, Mr. Heidtmann has recently l>laced about 4 feet of soil l~artiall¥ over the water collector, which interferes with maintenance of the drainaee svstem. While Mr. Heidtmann finds plenty of time to work on his house, garage, lawn and pond, he has chosen time and again to ignore his responsibility to construct an effective drainage system as agreed to at the June 22, 2005 meeting. As I explained at the work session, I have been trying to get the drainage problem behind my home, located at 495 Dolphin Drive, solved for over three years. The lot behind my home is a natural collection point for drainage in the area. This area was drained by a ditch constructed many years ago and maintained by Suffolk County Mosquito Control. When Mr. Heidtmann started to build his house, he filled in the drainage ditch which created a flooding problem and caused water to back up onto my property. It also created standing, stagnant water which is a breeding haven for mosquitoes. As a result of this situation, I petitioned the Board of Trustees to require Mr. Heidtmann to correct the problem. In response, the Board, as a condition of his permit, required him to construct a drainage system to relieve the flooding. After three years, in spite of all of his numerous promises to the Board and me, the drainage system is still not installed, and every winter and spring, water backs up onto my property so much so that it locally raises the water table which floods my crawl space. Last year I had to install a sump pump system to relieve the water in the crawl space. On January t5, 2003, February 12, 2003, April 13, 2004 and February 16, 2005, my wife and I have written the Board of Trustees to resolve this matter and enforce the conditions of Mr. Heidtmann's permit (copies of letters attached). Also, 1 have met with Trustees during site inspections, including Mr. Krupski, and appeared before the Board in 2003, 2004 and 2005, again asking their assistance, the result of which is that the Board meets with Mr. Heidtmann, he promises to comply with his permit and nothing happens. In fact, the situation is getting worse as evidenced by the Board letter to Mr. Heidtmann dated May 9, 2005, directing him to clean up the ditch on the somh side of his house which he partially filled in and to re-establish the silt fence and hay bales he covered. Not only did he not follow the Board's directives, but he filled in the ditch even more, including covering wetland vegetation. It is apparent that Mr. Heidtmann has not only no regard for the problem he has created, nor for his neighbors, but also has no regard for the Board of Trustees. His standard procedure is to claim hardship, tell everyone what they want to hear and does what he warns. At the June 22 work session, Mr. Heidtmann was given 60 days to restore the drainase ditch he filled in, including returning the grades to that shown on his building permit and re-establishing the erosion controls, and to complete a working drainage system. (Unfortunately, we will not know if the system functions properly until next winter and spring.) I hope that the Board keeps its word to take enforcement action if everything is not completed by August 22, including issuance of the maximum fine of $4,000, and an additional $4,000 every 30 days until it is complete. Ia/so request that a certificate of occupancy not be issued to Mr. HeidOnann until after next spring to ensure that the drainage system operates properly as he claitns it will I hope that you will be able to help me in this matter.
