Dear Mr. & Mrs. Napolitano:
The Board of Town Trustees took the following action during its regular meeting held on
January 18, 2006 regarding the above matter:
WHEREAS, ANTHONY & SUSAN NAPOLITANO applied to the Southold Town
Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code,
the Wetland Ordinance of the Town of Southold, application dated December 27, 2005,
and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on January 18, 2006, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of ANTHONY &
SUSAN NAPOLITANO to install a 12'X 36' in-ground swimming pool with brick work at
grade, 22'X 16' brick patio at grade, remove the existing deck stairs from southeast side
of deck, install a railing, and install new steps on the west end of the existing deck, with
the condition a drywell is installed to contain the pool backwash, and a line of staked
hay bales is placed down prior to construction, and all as depicted on the plan prepared
by Karen Oxholm dated December 20, 2005.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

Letter from John Edler
130 Cleaves Point Road
As per your request, I have reviewed Mr. Edler's letter, dated 01/06/06, which was sent to
Mr. Al Krupski, In his letter, Mr. Edler takes exception and voices his objection to the construction of a
new swimming pool by his neighbor who is located immediately to the east of his property.
Mr. Edler indicates that the permit to install a 12' x 36' in-ground swimming pool will endanger
his property and be harmful to the surrounding properties. He goes on to say that this proposed
construction "would endanger the current Town protection ordinances in Coastal areas". While his
concerns are legitimate, current Town Wetland, Zoning and Building Codes cover most of his
objections. These issues are routinely reviewed by Town Trustees and Building Departments and,
where necessary, the ZBA. If any objection or concern addressed by Mr. Edler is found to be
inconsistent with the Local Waterfront Revitalization Program, building permits will be denied.
The issue regarding a rising water table and potential flooding of basements within the Town
of Southold is not unique to this location. Mr. Edler has indicated that the water table at his property
has risen over four feet since his house was built in 1961. While some of his reasoning with regard to
an elevated water table has merit, it is highly unlikely that there has be a change of this magnitude
immediately adjacent to the tidal waters of Peconic Bay. The sphere of influence on the water table
from the installation of a new swimming pool would be minimal and should not have a significant
effect on the elevation of the current water table.

Flood Plain
· Refers to all land from water's edge to ten foot
elevation. Proposed pool is in this plain.
Local Waterfront Revitalization Program
· Passed November 2004. Ail land East of Greenport
is considered COASTAL and divided into 2
"Reaches". We are in Reach 5, which is from Route
25 to Gardiner's Bay.
· It compliments and underscores and extends all of
the previously mentioned ordinances.
· But it reminds me of a story ~out fighting
cocks.
· Many coastal violations exist according to code.
Penalties should be administered. Violations
should be corrected. Otherwise offenders will
believe they can continue to get away with it.

On Wednesday January 1 l, 2006 an on site inspection was
conducted by six trustees and or assistants to trustees at above
location.
At that time a suggestion was made to change our submitted
Plot Plan, re: move pool five feet toward east side of property to
get the pool away from our neighbor on the west side of our
property. 1 agreed to this.
After the on site mspect~o was over, I realized that this
could create an unsafe situation. [ am writing this letter to infbrm
you that I would like you to consider my application as submitted
originally with no changes.

L WRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of South old Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. * Except minor exempt actions includinJ( Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of South old Town).
3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the L WRP policy standards and conditions contained in the consistency
review law. Thus. each answer must be explained in detail. Iistine: both supportine: and non-
