Public Hearings
Under the current site plan application procedure, the process for
reviewing a site plan application is: a public hearing is not scheduled and
held by the. Planning Board until after, among other things, the site plan
has received a stamped Health Department approval.
The applicant shall now have the following options:

To have the Planning Board schedule and hold a public hearing on
the site plan application and have the Planning Board vote on the
proposed conditional site plan prior to the applicant receiving

General Information (Read Carefully)
In completing the form the reviewer should be guided by the question: Have my responses and determinations been
reasonable? The reviewer is not expected to be an expert environmental analyst.
The Examples provided are to assist the reviewer by showing types of impacts and wherever possible the threshold of
magnitude that would trigger a response in column 2. The examples are generally applicable throughout the State and for
most situations. But, for any specific project or site other examples and/or lower thresholds may be appropriate for a
Potential Large Impact response, thus requiring evaluation in Part 3.
The impacts of each project, on each site, in each locality, will vary. Therefore, the examples are illustrative and have been
offered as guidance. They do not constitute an exhaustive list of impacts and thresholds to answer each question.
The number of examples per question does not indicate the importance of each question.
In identifying impacts, consider long term, short term and cumulative effects.

NORTH FORK CUSTOM AUDIO/VIDEO (6619 Main Road - Mattituck)
The applicant described changes to an existing building that do not alter its
footprint. These include windows and doors on the east and south elevations, the
use of cedar shingles on elevations except the north, and a reverse gable and
parapet on the east roof. Colors will be bleaching oil on the shingles and white
trim. After an extensive discussion of alternatives, it was RESOLVED by Sanford
Hanauer and seconded by Garrett Strang to TABLE the APPLICATION to allow
reconsideration of the parapet as it is viewed from the west and submission of the
color and design of the signage as well as the exterior lighting fixtures.

The site plan status in an Unlisted Coordinated review since the May 10, 2004
public meeting. As of May 26, 2004 a revised site plan was sent to the Town
Engineer Jamie Richter requesting comments before the June 7, 2004 work
session and to the Chief Building Inspector requesting certification before the
June 14 public meeting. The site plan and materials was sent to NPV for
comment and a letter was sent to Mr~ Archer care of CVS with the NPV report.
Sent a memo to Transportation Committee requesting comments before the June
7 work session.
The site plan will be placed on the work session for June 7, 2004 to discuss.

Enclosed for your review are five (5) copies of an alternative site plan for the proposed CVS
Pharmacy to be located on the south side of NYS Route 25 at Sigsbee Road in Mattituck, N.Y.
The alternative site plan conceptually shows the realignment of Sigsbee Road to better align with
Factory Avenue directly across the street.
The realignment shown reduces the originally proposed buffer along Sigsbee Road substantially.
To reduce the impact of this buffer reduction, five parking spaces facing Sigsbee Road near
Route 25 have been eliminated and replaced with landscaping. Under this proposal the buffer
along Sigsbee Road is reduced to provide a minimum of five feet while the original proposal
provided a consistent 24.8 feet of buffer.
This alternative proposal is made in response to comments made by Raymond DiBiase of L.K.
McLean Associates. In those comments, Mr. DiBiase recommended misalignment of the
centerlines of Factory Avenue and Sigsbee Road be corrected as part of the CVS site plan. The
realignment that is proposed in the alternative site plan does not correct the entire 35-foot
misalignment cited in Mr. DiBiase's letter, but does correct more then 70% of that misalignment.
Further realignment of Sigsbee Road would substantially damage the proposed site plan by
further reducing parking and eliminating any meaningful buffer along Sigsbee Road.

The original Traffic Impact Study recommended use of two lane approaches to Route 25 for both
Factory Avenue and Sigsbee Road and use of the original signal phasing. If the realignment
allows the use of a single phase for Factory Avenue and Sigsbee Road (both Sigsbee Road and
Factory Avenue green and moving at the same time), each should be a single lane. The single
lane approach design for both streets will minimize the remaining offset between the two side
street centerlines. It is further recommended that the centerline of Factory Avenue be shifted two
to three feet to the west to narrow the approach lane and further reduce the intersection
misalignment. Should the realignment of Factory Avenue and Sigsbee Road allow for the
elimination of a signal phase it will more than offset the loss of the use of two lane approaches
on both Factory Avenue and Sigsbee Road.
Another comment raised by Mr. DiBiase recommended that only one driveway be provided on
Marlene Lane. The two driveways on Marlene Lane are designed to allow adequate truck access
to the site. This track access is designed not only for delivery trucks, but also for refuse and
compactor pickup. Truck cimulation patterns are shown in detail on the site plan. The site plan
and truck circulation patterns have been thoroughly reviewed and we have concluded that the use
of only one curb cut on Marlene Lane would be detrimental to the site truck circulation. In
addition, compliance with the State's request to eliminate access to Route 25 has reduced site
access substantially. The current access proposed is the minimum the applicant believes
necessary to maintain a valid site.
A suggestion was made that the construction of a driveway south of the building might facilitate
a single driveway on Marlene Lane. This option has several problems. To be useful, the
driveway would need to be operated as a one-way eastbound road in order to allow backing into
the loading area and the compactor. There is not sufficient room for two-way operation. The
creation of the driveway would reduce the buffer to the residential property to the south and may
also create a variance that would require Zoning Board approval.
The State suggested that left turns out of Marlene Lane be restricted to allow for right turns only.
Such a restriction would not impact the proposed site to any great extent. Customers would learn
to use Sigsbee Road and the traffic signal to exit the site. The presence of the signal would
attract most CVS left turners even without the restriction. Therefore, we believe that the only
site related impact would be on the two to three large trucks per week that would need to access
the site via Marlene Lane. As we pointed out to the State, the restriction would severely impact
residents on Marlene Lane and the shopping center on the southeast comer of Route 25 and
Marlene Lane. This retail center has access only to Marlene Lane and thus would be severely
impacted by the restriction. These are existing traffic movements, which based on accident
records obtained from the State, are currently being made without problem. We respectfully
submit that the imposition of this left turn restriction would impose a burden on the community
with little or no benefit.

This is to acknowledge receipt of your submissions on the above permit application.
This permit application should be sensitive to the unique visual and historic setting of the
Long Island North Shore Heritage Area, which runs from the Queens/Nassau County line to
Orient Point, and from Route 25 or I495, whichever is farther south, north to Long Island Sound.
In rcccm years, many states have employed access management as a major technique to address
conflicts between through traffic and that generated by developments. The goals of access
management are to limit the number of access points, separate conflict points and remove turning
tral~ic From through movements. New York State is utilizln~l this technique to mlnlm/z~ impacts
to State highways. We recommend, thercfore, that cress access to this site be obtained from
adjacent properties. If this is not presently possible, it should be shown on the plans for
implementation as part of future redevelopment.
When we completed our preliminary review of this site we noted this site also has access to
Sigsbee Road, which has si?~lized access with Route 25 and Marlene Lane, which has un-
signalized access with Route 25. Our policy states that we may restrict access to a property
fronting a State highway that also fronts and has access to another public street if we determine
that the access would be detrimental to the safety and operation of the State highway.
We are also in receipt of your second submission requestin~ right turn only ingress to the site
from Route 25. We have reviewed this conceptual plan and we have determined that this
movement, combined with the internal traffic circulation, would not provide a safe means of
ingress to thc site and has the potential to cause vehicle queuing on Route 25. We will not be
able to approve any access to Route 25 for this site for this reason, which supplements the access
management technique described above.

We have had preliminary discussions with Town of $outheld personnel and it appears the Town
may be in agreement with the above noted access arrangement as well. We recommend,
therefore, that all access to this site be from Sigsb¢c Road and Marlane Lane as indicated on the
plan, which may also increase the sites parking capacity. In addition, we also recommend that
left tums be restricted from Marlane Lane. The entire Route 25 site frontage shall be constructed
with curb and sidewalk.
Please submit four (4) sets of plans for our review that address the comments above and also
include all items noted on the attached site plan checklist. In all future correspondence, please
refer to the subject case number. The plans must also include the County tax map number.

This is to acknowledge receipt of your submissions on the above permit application.
This permit application should be sensitive to the unique visual and historic setting of the
Long Island North Shore Heritage Area, which runs from the Queens/Nassau County line to
Orient Point, and from Route 25 or I495, whichever is farther south, north to Long Island Sound.
In recent years, many states have employed access management as a major technique to address
conflicts between through traffic and that generated by developments. The goals of access
management are to limit the number of access points, separate conflict points and remove turning
traffic from through movements. New York State is utilizing this technique to minimize impacts
to State highways. We recommend, therefore, that cross access to this site be obtained from
adjacent properties. If this is not presently possible, it should be shown on the plans for
implementation as part of future redevelopment.
When we completed our preliminary review of this site we noted this site also has access to
Sigsbee Road, which has signalized access with Route 25 and Marlene Lane, which has un-
signalized access with Route 25. Our policy states that we may restrict access to a property
fronting a State highway that also fronts and has access to another public street if we determine
that the access would be detrimental to the safety and operation of the State highway.
We are also in receipt of your second submission requesting right turn only ingress to the site
from Route 25. We have reviewed this conceptual plan and we have determined that this
movement, combined with the internal traffic circulation, would not provide a safe means of
ingress to the site and has the potential to cause vehicle queuing on Route 25. We will not be
able to approve any access to Route 25 for this site for this reason, which supplements the access
management technique described above.

We have had preliminary discussions with Town of Southold personnel and it appears the Town
may be in agreement with the above noted access arrangement as well. We recommend,
therefore, that all access to this site be from Sigsbee Road and Marlene Lane as indicated on the
plan, which may also increase the sites parking capacity. In addition, we also recommend that
left turns be restricted from Marlene Lane. The entire Route 25 site frontage shall be constructed
with curb and sidewalk.
Please submit four (4) sets of plans for our review that address the comments above and also
include all items noted on the attached site plan checklist. In all future correspondence, please
refer to the subject case number. The plans must also include the County tax map number.

The Town of Southold Planning Board has retained Nelson, Pope & Voorhis, LLC (NP&V) for
consulting services in review of the above referenced application. The site is currently occupied
by two separate structures. A plumbing supply store occupies the partial two-story structure
along the western boundary of the site while the bowling alley and restaurant/bar occupies the
larger structure located centrally on the property. The proposed action involves the demolition
of the structure housing the plumbing supply store and the remodeling of the bowling alley,
restaurant/bar structure on the 1.786-acre parcel to allow for the construction of a CVS Pharmacy
with associated site improvements. This document analyzes the site and area resources including
topography, soils, water, land use, zoning and transportation and other available information.
The full EAF Part I submitted with the application was reviewed and the site was observed for
environmental/planning constraints.
Location and Site Overview
The overall project site is located on the south side of Main Road (NYS Route 25), between
Sigsbee Road and Marlene Lane, Mattituck, Town of Southold, County of Suffolk. The property
is comprised of a 1.7986-acre parcel of developed land. The subject property can be more
particularly described as SCTM number 1000-143-02-1, 2, 4, 27.1, 28, 29 and 30. The northerly
portion of the parcel contains a total of 290.17 feet of road frontage along Main Road, 285.71
feet of frontage along Marlene Lane on the eastern side of the property and 256.90 feet of
frontage along Sigsbee Road along the western side of the property. The southern boundary of
the property abuts residential property and a vacant wooded lot. The majority of the site is
currently developed with the two structures described above. The northern two-thirds of the

property is zoned General Business B and the remaining Residential R-40. Areas to the west,
north and east of the property are zoned General Business B while areas to the south are zoned
Residential R-40. The property slopes generally from north to south. The property does not
contain wetlands or other significant geologic features. This review will discuss the proposed
project and its potential impact on the land resources.
Prol~osed Project
The proposed action involves the demolition of the structure housing the plumbing supply store
and the remodeling of the bowling alley, restaurant/bar structure to accommodate a proposed
CVS Pharmacy and associated site improvements. The existing sanitary system located on the
eastern side of the properly will be abandoned and replaced as part of the proposed project. A
total of 77 parking spaces including 4 handicapped stalls will be provided to the east, north and
west of the proposed structure. An entrance from eastbound Route 25 and a right-only exit are
proposed on the north side of the site. One access point is proposed for Sigsbee Road and two
access points are proposed for Marlene Lane. The proposed building will be 26 feet in height
and will occupy approximately 19% of the site. Landscaping will be provided in curbed areas
located on the western, northern and eastern sides of the property and will provide some
screening from the surrounding areas. In addition, plantings are proposed for the approximately
45 foot wide buffered area at the southern property boundary which will provide additional
screening to the adjacent residential properties.
Land Use and Zoning
The project site is located in an area that contains a mix of residential and commercial uses.
The northern two-thirds of the property is zoned General Business B and the remainder of the
site is zoned Residential R-40. Areas to the west, north and east of the property are zoned
General Business B while areas to the south are zoned Residential R-40.
The proposed structure will maintain the existing, non-conforming footprint of the current
bowling alley/restaurant/bar building. The following table illustrates the non-conforming zoning
elements:

The site has frontage on three streets and therefore would typically require the building to
occupy a smaller envelope. It is however noted that the existing 2-story, non-conforming
plumbing is being removed and the CVS is completely consistent with the existing setback of the
bowling/restaurant building. It is our understanding that a determination has been made that no
variances are required. As a result of this and the existing site conditions, the land use and
zoning impacts of the proposed project are expected to be minimal.

Transportation
A traffic Impact Study prepared by Dunn Engineering (Dated April 2004) was reviewed by a
traffic professional and we are in agreement with the basic finding of this study concerning trip
generation, road capacity and mitigation. Right turn access to and from Main Road is proposed
on the plan forwarded to our office; however, it is our understanding that this is likely to be
eliminated through NYSDOT review. Additionally, one access point is proposed for Sigsbee
Road and two access points are proposed for Marlene Lane. Several points which warrant
discussion include adjacent roads, site access and other considerations.
Comments and recommendations regarding the Traffic Impact Stuctv are as follows:
The Study recommends that two 10' wide lanes be provided on Sigsbee Road and Factory
Avenue on the approaches to Route 25. Although these roads currently intersect Route 25 at a
signalized intersection, their centerlines are offset by about 35 feet. Because of this offset,
separate traffic signal phases are needed for each of these roadways. This causes additional
delay for Route 25 traffic, since the signal stays red for a longer time than if the roads were
aligned opposite each other and could be given simultaneous green signals. Therefore, as part
of this development, consideration should be given to requiring the applicant to realign Sigsbee
Road to intersect Route 25 opposite Factory Avenue. An appropriate dedication of properS.
should be provided to accomplish this. In conjunction with the realignment, the northbound
Sigsbee Lane approach to Route 25 should consist of two lanes--a left turn lane and a comb#zed
thru/right lane. Southbound Factory Lane should then be restriped to provide two lanes--a left
turn lane and a combined thru/right lane.
Site Access/Site Plan
The following driveway access is proposed:
· One driveway to Sigsbee Lane
· Right turn access to and from Route 25 (we understand that NYSDOT will not permit
access to Route 25)
· Two driveways to Marlene Lane
To minimize the number of conflict points involving through and turning vehicles along Marlene
Lane, consideration should be given to combining the two proposed access points into a single
access. It is preferable to locate the single access point as far south on Marlene Lane as
possible.
At access points, minimum corner curb radii should be 20feet.

Other Considerations
Since Route 25 is a State road, the NY State Department of Transportation has jurisdiction over
proposed access to that roadway, as well as over the modification of the Sigsbee Road and
Factory Avenue approaches to Route 25. Comments from NYSDOT, and approval in the form of
a Highway Work Permit, are required.
A copy of the review letter as prepared by LMKA under sub-contract, is attached. It is requested
that the applicant address these points.
Soils and Topography
The site slopes gently to the south, with all existing slopes between approximately 0-10%. The
property does not contain any significant landforms or geological features. The Suffolk County
soil survey (Warner, 1975) identifies four soil types on the subject site, which consist of the
following: CuB- Cut and fill land, gently sloping. This soil type is described as follows:
Cut and Fill (CUB): This unit is made up level to gently sloping areas that have been graded to
accommodate development. Slopes range from 1 to 8%. These areas tend to be large in size with
complex slopes. Cut and fill makes up at least 75% of the unit. Texture is dominantly loamy fine
sand and coarser material. Areas have few limitations to development. The topography and
soils on site do not appear to present severe development constraints.
Neither soils nor topography appear to pose a constraint to the proposed use of the site.
Water Resources
Public water is supplied to the general area by the Suffolk County Water Authority. The closest
water main to the site is located along the north side of Main Road (16 inch main). The Laurel
Lake Well Field & Pump Station is located on the south side of Sound Avenue approximately
150 west of Cox Neck Road, approximately 500 feet west of the project site. It is estimated that
the proposed project will utilize approximately 434 gallons of water per day.
Sanitary disposal will be managed by on-site underground sewage leaching systems. In 1978,
the Long Island Regional Planning Board published the Long Island Comprehensive Waste
Treatment Management Plan (208 Study). The 208 Study identified eight (8) hydrogeologic
zones in Nassau and Suffolk Counties. These zones were distinguished based upon differences
in underlying groundwater flow patterns and water quality. The subject site is located within
SCDHS Groundwater Management Zone IV, which according to Article VI of the Suffolk
County Sanitary Code, has an allowable flow of 600 gallons per day (gpd) per acre in areas
served by public water. Therefore, the allowable nitrogen beating flow for the overall 1.786
acres site is 1,072 gpd. The sanitary design flow is computed using the SCDHS manual
Standards for Approval of Plans and Construction for Sewage Disposal Systems for Other Than
Single Family Residences. The manual establishes the design flow as follows:

Therefore, the proposed applications would conform with Article VI of the Suffolk County
Sanitary Code and would not be expected to adversely affect groundwater quality provided
properly functioning systems are designed and installed.
SUMMARY
In conclusion, the proposed application would conform to the commercial character of the Main
Road corridor in the area of the site. The project is not anticipated to have a significant impact
on soils, topography and water usage and the site does not exhibit significant environmental
constraints or contain resources of concern. In fact, the site is currently developed and existing
non-conforming buildings will be removed to improve the degree of conformity. The site is
expected to slightly increase trips entering and exiting the site as compared to existing
conditions; however, the Traffic Impact Study finds that roads can accommodate vehicle trips.
The elimination of the access to and from Route 25 is an improvement to road circulation and
designs and may provide an opportunity to review the road alignment at the Sigsbee
Lane/Factory Avenue/Route 25 intersection. In addition, the number of driveways to Marlene
Lane should be addressed by the applicant and reviewed by the Planning Board once the road
system and circulation issues are addressed to the satisfaction of the Planning Board.

Soils and Topography
The site slopes gently to the south, with all existing slopes between approximately 0-10%. The
property Sees not contain my significant landforms or geological features. The Suffolk County
soil survey (Warner, 1975) identifies four soil types on the subject site, which consist of the
following: CuB- Cut and fi!i land, gently sloping. This so~l type is d~scti~ed as follows:
Cut and Fill (CUB). Thi~ unit i; made up level to gently ;loping areas that have been graded to
~ccommodat¢ development. Slopes range from 2 to 8%, These areas tend to be large m si~e wit]~
complex slopes. Cut and fiii makes ,~p at I~t 75% o/the shit. Texture i~ dominanIly loamy fine
sand and coarser ma!erie!. Areas haw few limitation~ to deve~oprr~nt. Th~ topography and
soils on *ite do not appear to gre.*ent severe development constraints,

Water Resources
Public water is supplied co the general area by the Suffolk County Water Authority. The closest
wa[er main m the site i* located along the north s~de of Main Road (16 inch main). The Laurel
Lake Well Field & Pump Station i,¢ located on the south side of Sound Avenue approximately
t50 west of Cox Neck Read, approximately 500 feet west of :he projec~ si~e. It ~s estimated that
[he ~'oposed project will uti;[ize approximately 434 gallons of water per day.
Sanitary disposal will be managed by on-site underground sewage leaching systems. In 1978,
the Long Islana. Regional Planmng Board published the Long Iskand Comprehensive Waste
Treatment Management Plan (208 Study). The 208 Study identified eight (8) kydmgeolog, ic
zones tn Nassau and Saffolk Counties. These zones were distinguished Dosed upon differences
in underlying groundwater flow [~atmms and water quality. The su~ect ;itc is located within
SCDHS Groundwater Management Zone IV, whzch according .'.o Article VI of thc Suffolk
Co-nty Sanitary' Cod. c, has an allowable flow of 600 gallons per day (gpa) per acre ~n aret~
served by public water. Therefore. the allot'able nitrogen bearing flow got the overall 1.786
acres si:e is 1.072 gpd. The sanitary design flow is computed using the SCDFiS manual
Standarrls for Approval qf ?lans and Construction for Sewage Disposal Systems for Other Than
Single Family Residences. The manual establishes the design flow as follow~:

We have the following comments:
Treffi.c Impact, Study
The Study recommends that two 10' wide lanes be provided on Sigsoee Road
and ~aot0ry Avenue on the approaches to Route 25. Although these roads currently
irllarsect Route 2.5 at a sigr,a,lzed intorseetlon, their cente~lines are offset by about 35
teat. Because of this offset, separate traff:c signal ~hases are neeoe.'~ for ead~ of these
roaoways. This causes additional delay for Route 25 ~affic. since the signal Stays red
for e longer time than ii the roads were aligned opposite each other and could be given
simultaneous green signals. Therefore, as p~.~ of this development, consideration
should be given to requiring the applicant to realign S~gsbee Road to fntersect Route 25
go, posits Factory Avenue. An appropriate dedication of property should Oe provided to
accomplish this. In oonjunotfan with the realignment, the norttlbound Sigsbee Lane
approach tc Route 25 should ~nsist of two lanes~ left turn fane and a combined
thru/r!ght lane. Southbound Factory Lane should ;hen be restrfpeo tc provide two

concerning site engineering issues from the Town of Southold Architectural Review
Committee (ARC) during the April 15, 2004 meeting for the above referenced project on
behalf of the Laker Development (The "Applicant").
The following changes/additional information is being provided in accordance with ACR
comments:
1. Building Sidewalks: The site plans will be updated to include red stampcrete for
sidewalks adjacent to the proposed CVS.
2. Freestanding Sign: The proposed freestanding sign detail and location are attached for
review. This information will be included on the updated site plan drawings.
3. Wall mounted Exterior Light Fixtures: All exterior lighting fixtures mounted to the CVS
building will be revised to enclosed source, soffit mounted lights. A catalog cut of the
proposed light fixture is attached. The site plans will be updated to present this change.
4. Parking Lot Lights: The parking lot lights will be no more than 14 feet tall in accordance
with Township requirements.
5. Building Signs: Attached building signage will be wood carved signs illunrinated by
gooses neck lights approved by the Township.

The Suffolk County Department of Health Services (SCDHS) has received your letter dated
March 31,2004, concerning the above- referenced application, and has no objection to the Town's
designation as lead agency.
This correspondence is intended primarily to expedite the procedural requirements of SEQRA
pertaining to the establishment of lead agency. The comments provided below are, therefore, general
nature, representing several of our most common concerns regarding Suffolk County projects. The
department wishes, however, to reserve its right to provide more detailed information within the
comment period(s) established for this action.
I. Suffolk County Sanitary Code (SCSC)
1. The SCDHS maintains jurisdiction over the final location of sewage disposal and water supply
systems~ pursuant to the authority and requirements of Articles 4, 5, and 6 of the SCSC.
Applications must comply with all relevant density and construction standards for water supply
and sewage disposal. Applicants should not undertake the construction of, or connection to,
either system without Health Department approval.
2. The Suffolk County Department of Health Services has not received an application for the
proposed subdivision as required by Article VI of the Suffolk County Sanitary Code (SCSC). The'
project sponsor should submit an application to our agency's Bureau of Water and Wastewater at

Because the simulated brick veneer approved at the March 4 meeting was not
satisfactory in its appearance, the applicant's representatives proposed the use of
Cedar Impressions vinyl shingles on all sides and horizontal siding of the same
material in the gables., all in ,,~now color. Moved by Robert Keith and seconded by
Howard Meinke it was RESOLVED to accept this modification with the
CONDITION that a sample, of the trim color be submitted for approval

APPROVE the addition of an external stair in the rear of the building required as

GAlA HOLISTIC CIRCLE (Shipyard Lane - East Marion)
The representatives of the applicant described a 108 unit healing, meditation and
hotel facility on the 18 acre site with a circular main building to contain a 200 seat
restaurant., all in the Japanese style of architecture. The grounds will have a 30
foot waterfall and small man-made lakes, emphasizing circular patterns and
Japanese landscaping but with local plantings. It was subsequently RESOLVED
by Howard Meinke and seconded by Herbert Adler to APPROVE the project
CONCEPTUALLY, subject to detailed submissions, and to strongly
RI:COMMEND that the Planning Board "land bank" as much of the parking as
possible.
Vote of the Committee: Ayes All.
CVS PHARMACY (Main Read - Mattituck)
Following a presentation of the proposed project, it was RESOLVED by Robert
Brown and seconded by Herbert Adler to APPROVE the proposal with the
CONDITIONS that the divided light windows be continued across the remaining 2
bays on North elevation and in the first and third bays from the North on the East
elevation (.with the understanding that these may be display windows), that the
roofing will be architectural shingles, that pavers or red stampcrete be used for the
internal sidewalks, that drawings of the ground signage be submitted for approvai.
and that the building mounted light fixtures be clarified (a preference for soffit
fixtures was expressed)..
Vote of Committee: Ayes all.

2. Limiting clearing to retain maximum undisturbed recharge areas.
3. Conserving open space and placing conservation easements to protect these areas. The project
should be designed in context of adjoining areas to maintain unfragmented, contiguous open
space to maximize the benefit of these areas both ecologically and in terms of watershed
protection.
4. Limiting fertilizer dependent vegetation to minimize turf areas.
5. Using native plants for landscaping purposes that require less water and are more drought
tolerant.
6. Preserving existing native vegetation to the maximum extent practical keeping in mind realistic
accessory uses that will likely occur (ie; sheds, pools). A conservation easement should be placed
on the preserved area so it is not disturbed for accessory uses.
7. Using natural stormwater management practices (grass swales, filter strips, created wetlands,
etc), where possible.
8. Only installing ornamental water features that recycle water. Signs should indicate that water is
recycled. These water features should not be operated during a drought.
9. Using porous pavements, and/or minimizing road widths to the extent practical, while still
allowing adequate emergency access.
10. Requiring the use of landscape methods that minimize recharge of contaminants.

POLES STRAIGHT SQUARE ALUMINUM
SPECIFICATIONS
POLE SHAFT: The pole shaft is a one-piece, 4"
square, seamless 6000 series extruded aluminum
tubing and is heat treated to achieve a T6 temper
with & guaranteed minimum yield strength of 31
KSL Pole wall thickness is .100"
BASE TENON ASSEMBLY: The tenon anchor
base assembly consists of ~tructural quality
carbon steel tubing with a minimum 46 KSI yield
strength welded to a structural stae~ base with a
guaranteed minimum yield strength of 50 KSL
The base plate telescopes the pole shaft and is
circ[/mferentially welded on both top and bottom.
The base is provided with slotted bolt holes to
accommodate a = .5" variation in the rotational
flexibility. The entire assembly is hot-dipped
galvanized. Four (4) mechanically galvanized
fasteners secure the aluminum pole shaft to the
base tenon assembly.
ANCHOR BOLTS; Anchor bolts are fabricated
from a commercia~ quality hot rolled carbon steel
bar that meets or exceeds a minimum guaranteed
yield strength of 50,000 psi. Bolts have an '%"
bend on one end and threaded on the opposite
end. Anchor bolts are completely hot dipped
galvanized, Four (4) properly sized bolts, each
furnished with two (2) regular hex nuts, two (2) fiat
washers and one (1) lock washer are provided per
pole, unless otherwise specified.
BASE COVER: A two-piece, fabricated aluminum
cover completely conceals the entire base plate
and anchorage. The base cover is secured to the
base assembly with four (4) stainless steel
fasteners.
HANDHOLE: The handho~e has a nominal
rectangular 2" X 4" inside opening in the pole
shaft and tenon assembly Included is an
aluminum cover plata with attachment screws.
The handhole is lccatad 18" above the base and
180° cfockwise with respect to the luminaire arm
when viewed from the top of the pole for one arm.
For two arms the handhole is located directly
under one arm.
POLETOP CAP: Each pole assembly is provided
with a removable cast aluminum pole top cap.
The pole top cap is secured with two (2) stainless
steel allen head set screws.
FINtSH: Poles are available with bronze, natural
or black Aluminum Association Architectural Class
1 anodized finish. Eiectrostaticaily applied,
thermally cured TGIC polyester powdercoat finish
is also available.
DESIGN: The poles as charted are designed to
withstand dead loads and predicted dynamic
loads developed by variable wind speeds with an
additional 30% gust factor under the following
conditions:
The charted weights foclude luminaire(s) and/or
mounting bracket(s).
The wind velocities are based on 10 mph
increments from 80 mph through 100 mph. Poles
to be located in areas of known abnormal
conditions may reduJre special consideration For
example: coastat areas, airports and areas of
special winds.
Poles are designed for ground mounted
applications. Poles mounted on structures (such
as buildings and bridges) may also necessitate
special consideration requiring Gardco/Emco
Lighting's recommendation,
Height correction factors and drag coefficients are
applied to the entire structure. An appropriate
safety factor is maintained based on the minimum
yield strength of the material incorporated in the
pole
WARNtNG: This design information is intended as
a general guJdetine only. The customer is solely
responsible for proper selection of pole, luminaire,
accessory and foundation under the given site
conditions and intended usage. The addition of
any items to the pole, in addition to the lumlnaire,
will drama¢catly impact the EPA Icad on that pole.
It is strongly recommended that a qualified
professional be consulted to analyze the loads
given the user's specific needs to ensure proper
selection of the pole, luminaire, accessories, and
foundation. Gardco/Emco Lighting and Genlyte
Thomas Group, LLC assume no responsibility for
such proper analysis or product selections.
Failure to insure proper site analysis, pole
selection, loads and installation can result in
pole failure, leading to serious injury or
property damage.
GENERAL INFORMATION: Mounting height is
the vertical distance from the base of the lighting
pole to the center of the luminaire arm at the point
of luminaire attachment.
Twin arms as charted are oriented at 180° with
respect to each other. For applications of two (2)
arms at 90° or other mudiple arm applications,
consult the factory.

ARTICLE X, General Business (B) District [Added 1-10-1989 by L.L. No.
1-1989EN(t)]
§ 100-100. Purpose.
The purpose of the General Business 03) District is to provide for retail and wholesale
commercial development and limited office and industrial development outside of the hamlet
central business areas, generally along major highways. It is designed to accommodate uses that
benefit from large numbers of motorists, that need fairly large parcels of land and that may
involve characteristics such as heavy trucking and noise.
§ 100-101. Use regulations.
In the B District, no building or premises shall be used and no building or part thereof shall be
erected or altered which is arranged, intended or designed to be used, in whole or in part, for any
uses except the following:
A. [Amended 5-9-1989 by L.L. No. 6-1989] Permitted uses. The following uses are permitted
uses and, except for those uses permitted under Subsection A(1) hereof, are subject to site
plan approval by the Planning Board:
(1) Any permitted use set forth in and regulated by § 100-31A(2) and (3) of the
Agricultural-Conservation District.
(2) Any permitted use set forth in and regulated by § 100-91A(3) to (19) of the Hamlet
Business District. [Amended 2-7-1995 by L.L. No. 3-1995]
(3) Wholesale businesses, warehouses and building material storage and sale, but excluding
storage of coal, coke, fuel oil or junk.
(4) Building, electrical and plumbing contractors' businesses or yards.
(5) Cold storage plants, baking and other food processing and packaging plants that are not
offensive, obnoxious or detrimental to neighboring uses by reason of dust, smoke,
vibration, noise, odor or effluent.
(6) Wholesale or retail sale and accessory storage and display of garden materials, supplies
and plants, including nursery operations, provided that the outdoor storage or display of
plants and materials does not obstruct pedestrian flow or vehicular traffic and does not
occur within three (3) feet of the property line.

(7) Wholesale/retail beverage distribution.
(8) Funeral homes.
(9) Train or bus stations.
(10) Telephone exchanges.
(l 1) [Added 11-29-1994 by L.L. No. 26-1994] Wineries which meet thc following standards:
(a) It shall be a farm winery licensed under New York State law from which wine made
from primarily Long Island grapes is produced and sold.
(b) It shall obtain site plan approval.
(c) It shall have retail sales on site.
B. Uses permitted by special exception by the Board of Appeals. The following uses are
permitted as a special exception by the Board of Appeals, as hereinafter provided, subject to
site plan approval by the Planning Board:
(1) Any special exception use as set forth in and regulated by § 100-3 lB(2) to (12), except
wineries are not required to be in connection with a vineyard. [Amended 8-1-1989 by
L.L. No. 15-1989]
(2) Hotel or motel uses as set forth in and regulated by § 100-61B(4) of the Resort
Residential (RR) District, except that the minimum lot size shall be three (3) acres.

(3) Bed-and-breakfast enterprises or boarding and/or tourist homes as set forth in and
regulated by § 100-31B(14) of the Agricultural-Conservation District, except that no site
plan approval is required.
(4) Tourist camps as regulated by Chapter 88, Tourist and Trailer Camps, of the Town
Code.
(5) Research, design or development laboratories, provided that any manufacturing shall be
limited to prototypes and products for testing.
(6) Fully enclosed commercial recreation facilities, including but not limited to tennis clubs,
skating rinks, paddle tennis, handball and squash facilities, dance halls, billiard parlors,
bowling alleys, health spas and clubs and uses normally accessory and incidental to
commercial recreation, such as locker rooms, eating and drinking facilities and retail sale
of goods associated with the particular activity.
(7) Laundry or dry-cleaning plants, subject to the following conditions:

(a) All processes and storage shall be carried on within an enclosed building.
(b) All fluids used in processing shall be recycled, and the overall facility shall be
designed, located and operated to protect surface waters and the groundwater
reservoir from pollution.
(8) Fraternal or social institutional offices or meeting halls (nonprofit).
(9) Take-out restaurants, provided that eating on the premises of the take-out restaurant shall
be permitted only inside the structure or in areas specifically designated and properly
maintained outside of the structure and where the minimum lot size for a freestanding
structure is forty thousand (40,000) square feet. [Amended 5-16-1994 by L.L. No.
9-1994]
(l 0) Drinking establishments.
(11) Automobile laundries.
(12) Public garages, gasoline service stations, new and used motor vehicle lots, vehicle sales
and rental, including the sale of recreation vehicles and trailers and boat sales, with
accessory repair facilities, all subject to the following requirements:
(a) Entrance and exit driveways shall have an unrestricted width of not less than twelve
(12) feet and not more than thirty (30) feet and shall be located not less than ten (10)
feet from any property line and shall be so laid out as to avoid the necessity of any
vehicle backing out across any public right-of-way.
(b) Sale of used vehicles or boats shall be conducted only as accessory to the sale of new
vehicles or boats.
(c) Vehicle lifts or pits, dismantled automobiles, boats and vehicles and all parts or
supplies shall be located within a building.
(d) All service or repair of motor vehicles, other than such minor servicing as change of
tires or sale of gasoline or oil, shall be conducted in a building.
(e) The storage of gasoline or flammable oils in bulk shall be located fully underground
and not less than thirty-five (35) feet from any property line other than the street line.
(f) No gasoline or fuel pumps or tanks shall be located less than fifteen (15) feet from
any street or property line.
(g)EN{2)No gasoline service or repair shops or similar businesses are to be located within
three hundred (300) feet ora church, public school, library, hospital, orphanage or
rest home.
(13) Partial self-service gasoline service stations, subject to all of the provisions of §

100-101 B( 12 ) herein and the following additional requirements:
(a) Each partial self-service gasoline facility shall have a qualified attendant on duty
whenever the station is open for business. It shall be the duty of the qualified
attendant to control and operate both the console regulating the flow of gasoline to
the dispensing equipment thereafter to be operated by the customer at the self-service
pump island and the dispensing equipment on the other pump islands.
(b) Gasoline shall at no time be dispensed without the direct supervision of the qualified
attendant. A control shall be provided which will shut offthe flow of gasoline to the
dispensing equipment at the self-service pump island whenever the qualified
attendant is absent from the control console for any reason whatever, including when
he is operating the dispensing equipment on the other pump islands.
(c) The console regulating the flow of gasoline to the remote dispensing equipment
thereafter operated by the customer at the self-service pump island shall be situated
in such a manner as to give the qualified attendant controlling said console an
m~obstructed view of the operation of said remote dispensing equipment.
(d) The self-service pump island shall have controls on all pumps that will permit said
pumps to operate only when a dispensing nozzle is removed from its bracket on the
ptnnp and the switch for this pump is manually operated.
(e) The self-service pump island shall be protected by an automatic fire-protection
system in the form of an approved system of dry powder release which will act as an
automatic fire extinguisher.
(f') No customer shall be permitted to dispense gasoline unless he shall possess a valid
motor vehicle operator's license.
(g) There shall be no latch-open device on any self-service dispensing nozzle.
(14) Private transportation service, including garage and maintenance facilities.
(15) One-family detached dwellings, not to exceed one (1) dwelling on each lot. [Added

(16) [Added 5-16-1994 by L.L. No. 9-1994] Formula food restaurants loc ated within a
shopping center in this zone, subject to the following requirements:
(a) There must be sufficient parking as provided for by the Article XIX, Parking and
Loading Areas, of this chapter, and such parking area shall be available within the
shopping center site to accommodate the use.
(b) The operation of the establishment shall not create traffic problems.

(c) There shall be no counter serving outdoor traffic via a drive-in, drive-through,
drive-up, drive-by or a walkup window or door.
(d) Exterior signage shall conform in all respects to Article XX, Signs, of this chapter
and, further, may not be lit from within.
(e) Advertisements, including trademark logos, may not be affixed, painted or glued
onto the windows of the business or onto any exterior structure, including waste
disposal receptacles and flags.
(f) The signage must conform to the existing color theme and signage style of the
shopping center.
(g) The existing exterior architectural style of the shopping center building may not be
altered or modified in any way to accommodate the proposed use.
(h) The use must be located within the shopping center's main primary building complex
and may not be located within a single freestanding structure within the shopping
center site.
(17) Flea markets. [Added 1047-1995 by L.L. No. 21-1995]
C. [Amended 5-9-1989 by L.L. No. 6-1989] Accessory uses. The following uses are permitted
as accessory uses and, except for residential accessory uses and signs, which are governed by
Article XX, are subject to site plan review:
(1) Accessory uses set forth in and as regulated by § 100-31C(1) through (8) and (10) of the
Agricultural-Conservation District, subject to the conditions set forth in § 100-33
thereof. [Amended 11-29-1994 by L.L. No. 26-1994]
(2)EN(3)Open storage of materials or equipment, provided that such storage shall be at least
twenty-five (25) feet from any lot line, not be more than six (6) feet high and be suitably
screened by a solid fence or other suitable means of at least six (6) feet in height.
§ 100-102. Bulk, area and parking requirements.
No building or premises shall be used and no building or part thereof shall be erected or altered
in the B District unless the same conforms to the Bulk Schedule and Parking and Loading
Schedules incorporated into this chapter by reference, with the same force and effect as if such
regulations were set forth herein in full. EN(4)

A. Structures shall be set back at least one hundred (100) feet from the right-of-way.
B. There shall be an exception to Subsection A if the adjacent parcels are developed, in which
case the minimum front yard setback shall be the average of the setbacks of the adjacent
parcels.
C. A project shall be divided into separate structures so that no single structure shall have more
than sixty (60) linear feet of frontage on one (1) street. The setbacks of multiple structures on
a parcel may vary, provided that the average setback of the structures meets the setback
required above and all buildings are at least seventy-five (75) feet from the right-of-way.

ARTICLE IliA, Low-Density Residential R-40 District [Added 1-10.1989 by L.L. No.
1-1989]
§ 100-30A. 1. Purpose.
The purpose of the Low-Density Residential R-40 District is to provide areas for residential
development where existing neighborhood characteristics, water supply and environmental
conditions permit full development densities of approximately one (1) dwelling per acre and
where open space and agricultural preservation are not predominate objectives.
§ 100-30A.2. Use regulations.
In an R-40 District, no building or premises shall be used and no building or part of a building
shall be erected or altered which is arranged, intended or designed to be used, in whole or in part,
for any uses except the following:
A. Permitted uses:
(1) Sameas§ 100-31AoftheAgricultural-ConservationDistrict, except that wineries are
excluded. [Amended 11-29-1994 by L.L. No. 26-1994]
B. Uses permitted by special exception of the Board of Appeals. The following uses are
permitted as a special exception by the Board of Appeals, as hereinafter provided, and subject
to site plan approval by the Planning Board:
(1) Same as § 100-31B of the Agricultural-Conservation District, except that a children's
recreation camp, farm labor camp and veterinarian's office and animal hospital are not
permitted and bed-and-breakfast uses do not require site plan approval.
(2) Libraries, museums or art galleries.
C. Accessory uses, limited to the following:
(1) Same as § 100-31C of the Agricultural-Conservation District.
§ 100-30A.3. Bulk, area and parking regulations.
No building or premises shall be used and no building or part thereof shall be erected or altered
in the Low-Density Residential R-40 District unless the same conforms to the requirements of
the Bulk Schedule and of the Parking Schedule,EN(1) with the same force and effect as if such
regulations were set forth herein in full.
