Planning Board until after, among other things, the site plan has received a stamped Health Department approval. The reviewer is not expected to be an expert environmental analyst. The Examples provided are to assist the reviewer by showing types of impacts and wherever possible the threshold of magnitude that would trigger a response in column 2. The examples are generally applicable throughout the State and for most situations. But, for any specific project or site other examples and/or lower thresholds may be appropriate for a Potential Large Impact response, thus requiring evaluation in Part 3. The impacts of each project, on each site, in each locality, will vary. Therefore, the examples are illustrative and have been offered as guidance. They do not constitute an exhaustive list of impacts and thresholds to answer each question. The number of examples per question does not indicate the importance of each question. The alternative site plan conceptually shows the realignment of Sigsbee Road to better align with Factory Avenue directly across the street. The realignment shown reduces the originally proposed buffer along Sigsbee Road substantially. To reduce the impact of this buffer reduction, five parking spaces facing Sigsbee Road near Route 25 have been eliminated and replaced with landscaping. Under this proposal the buffer along Sigsbee Road is reduced to provide a minimum of five feet while the original proposal provided a consistent 24.8 feet of buffer. This alternative proposal is made in response to comments made by Raymond DiBiase of L.K. McLean Associates. In those comments, Mr. DiBiase recommended misalignment of the centerlines of Factory Avenue and Sigsbee Road be corrected as part of the CVS site plan. The realignment that is proposed in the alternative site plan does not correct the entire 35-foot misalignment cited in Mr. DiBiase's letter, but does correct more then 70% of that misalignment. Further realignment of Sigsbee Road would substantially damage the proposed site plan by further reducing parking and eliminating any meaningful buffer along Sigsbee Road. Ms. Jerilyn Woodhouse, Chair May 25, 2004 Page 2 The original Traffic Impact Study recommended use of two lane approaches to Route 25 for both Factory Avenue and Sigsbee Road and use of the original signal phasing. If the realignment allows the use of a single phase for Factory Avenue and Sigsbee Road (both Sigsbee Road and Factory Avenue green and moving at the same time), each should be a single lane. The single lane approach design for both streets will minimize the remaining offset between the two side street centerlines. It is further recommended that the centerline of Factory Avenue be shifted two to three feet to the west to narrow the approach lane and further reduce the intersection misalignment. Should the realignment of Factory Avenue and Sigsbee Road allow for the elimination of a signal phase it will more than offset the loss of the use of two lane approaches on both Factory Avenue and Sigsbee Road. Another comment raised by Mr. DiBiase recommended that only one driveway be provided on Marlene Lane. The two driveways on Marlene Lane are designed to allow adequate truck access to the site. This track access is designed not only for delivery trucks, but also for refuse and compactor pickup. Truck cimulation patterns are shown in detail on the site plan. The site plan and truck circulation patterns have been thoroughly reviewed and we have concluded that the use of only one curb cut on Marlene Lane would be detrimental to the site truck circulation. In addition, compliance with the State's request to eliminate access to Route 25 has reduced site access substantially. The current access proposed is the minimum the applicant believes necessary to maintain a valid site. A suggestion was made that the construction of a driveway south of the building might facilitate a single driveway on Marlene Lane. This option has several problems. To be useful, the driveway would need to be operated as a one-way eastbound road in order to allow backing into the loading area and the compactor. There is not sufficient room for two-way operation. The creation of the driveway would reduce the buffer to the residential property to the south and may also create a variance that would require Zoning Board approval. The State suggested that left turns out of Marlene Lane be restricted to allow for right turns only. Such a restriction would not impact the proposed site to any great extent. Customers would learn to use Sigsbee Road and the traffic signal to exit the site. The presence of the signal would attract most CVS left turners even without the restriction. Therefore, we believe that the only site related impact would be on the two to three large trucks per week that would need to access the site via Marlene Lane. As we pointed out to the State, the restriction would severely impact residents on Marlene Lane and the shopping center on the southeast comer of Route 25 and Marlene Lane. This retail center has access only to Marlene Lane and thus would be severely impacted by the restriction. These are existing traffic movements, which based on accident records obtained from the State, are currently being made without problem. We respectfully submit that the imposition of this left turn restriction would impose a burden on the community with little or no benefit. The site is currently occupied by two separate structures. A plumbing supply store occupies the partial two-story structure along the western boundary of the site while the bowling alley and restaurant/bar occupies the larger structure located centrally on the property. The proposed action involves the demolition of the structure housing the plumbing supply store and the remodeling of the bowling alley, restaurant/bar structure on the 1.786-acre parcel to allow for the construction of a CVS Pharmacy with associated site improvements. This document analyzes the site and area resources including topography, soils, water, land use, zoning and transportation and other available information. The full EAF Part I submitted with the application was reviewed and the site was observed for environmental/planning constraints. Location and Site Overview The overall project site is located on the south side of Main Road (NYS Route 25), between Sigsbee Road and Marlene Lane, Mattituck, Town of Southold, County of Suffolk. The property is comprised of a 1.7986-acre parcel of developed land. The subject property can be more particularly described as SCTM number 1000-143-02-1, 2, 4, 27.1, 28, 29 and 30. The northerly portion of the parcel contains a total of 290.17 feet of road frontage along Main Road, 285.71 feet of frontage along Marlene Lane on the eastern side of the property and 256.90 feet of frontage along Sigsbee Road along the western side of the property. The southern boundary of the property abuts residential property and a vacant wooded lot. The majority of the site is currently developed with the two structures described above. Areas to the west, north and east of the property are zoned General Business B while areas to the south are zoned Residential R-40. The property slopes generally from north to south. The property does not contain wetlands or other significant geologic features. This review will discuss the proposed project and its potential impact on the land resources. Prol~osed Project The proposed action involves the demolition of the structure housing the plumbing supply store and the remodeling of the bowling alley, restaurant/bar structure to accommodate a proposed CVS Pharmacy and associated site improvements. The existing sanitary system located on the eastern side of the properly will be abandoned and replaced as part of the proposed project. A total of 77 parking spaces including 4 handicapped stalls will be provided to the east, north and west of the proposed structure. An entrance from eastbound Route 25 and a right-only exit are proposed on the north side of the site. One access point is proposed for Sigsbee Road and two access points are proposed for Marlene Lane. The proposed building will be 26 feet in height and will occupy approximately 19% of the site. Landscaping will be provided in curbed areas located on the western, northern and eastern sides of the property and will provide some screening from the surrounding areas. In addition, plantings are proposed for the approximately 45 foot wide buffered area at the southern property boundary which will provide additional screening to the adjacent residential properties. Land Use and Zoning The project site is located in an area that contains a mix of residential and commercial uses. The northern two-thirds of the property is zoned General Business B and the remainder of the site is zoned Residential R-40. Areas to the west, north and east of the property are zoned General Business B while areas to the south are zoned Residential R-40. The proposed structure will maintain the existing, non-conforming footprint of the current bowling alley/restaurant/bar building. It is however noted that the existing 2-story, non-conforming plumbing is being removed and the CVS is completely consistent with the existing setback of the bowling/restaurant building. It is our understanding that a determination has been made that no variances are required. As a result of this and the existing site conditions, the land use and zoning impacts of the proposed project are expected to be minimal. Page 2 CVS Pharmacy @ Mattituck EAF Part I Review NP&V #04145 Transportation A traffic Impact Study prepared by Dunn Engineering (Dated April 2004) was reviewed by a traffic professional and we are in agreement with the basic finding of this study concerning trip generation, road capacity and mitigation. Right turn access to and from Main Road is proposed on the plan forwarded to our office; however, it is our understanding that this is likely to be eliminated through NYSDOT review. Additionally, one access point is proposed for Sigsbee Road and two access points are proposed for Marlene Lane. Several points which warrant discussion include adjacent roads, site access and other considerations. Comments and recommendations regarding the Traffic Impact Stuctv are as follows: The Study recommends that two 10' wide lanes be provided on Sigsbee Road and Factory Avenue on the approaches to Route 25. Although these roads currently intersect Route 25 at a signalized intersection, their centerlines are offset by about 35 feet. Because of this offset, separate traffic signal phases are needed for each of these roadways. This causes additional delay for Route 25 traffic, since the signal stays red for a longer time than if the roads were aligned opposite each other and could be given simultaneous green signals. Therefore, as part of this development, consideration should be given to requiring the applicant to realign Sigsbee Road to intersect Route 25 opposite Factory Avenue. An appropriate dedication of properS. should be provided to accomplish this. In conjunction with the realignment, the northbound Sigsbee Lane approach to Route 25 should consist of two lanes--a left turn lane and a comb#zed thru/right lane. Southbound Factory Lane should then be restriped to provide two lanes--a left turn lane and a combined thru/right lane. It is preferable to locate the single access point as far south on Marlene Lane as possible. At access points, minimum corner curb radii should be 20feet. Comments from NYSDOT, and approval in the form of a Highway Work Permit, are required. A copy of the review letter as prepared by LMKA under sub-contract, is attached. It is requested that the applicant address these points. Soils and Topography The site slopes gently to the south, with all existing slopes between approximately 0-10%. The property does not contain any significant landforms or geological features. The Suffolk County soil survey (Warner, 1975) identifies four soil types on the subject site, which consist of the following: CuB- Cut and fill land, gently sloping. This soil type is described as follows: Cut and Fill (CUB): This unit is made up level to gently sloping areas that have been graded to accommodate development. Slopes range from 1 to 8%. These areas tend to be large in size with complex slopes. Cut and fill makes up at least 75% of the unit. Texture is dominantly loamy fine sand and coarser material. Areas have few limitations to development. The topography and soils on site do not appear to present severe development constraints. Neither soils nor topography appear to pose a constraint to the proposed use of the site. Water Resources Public water is supplied to the general area by the Suffolk County Water Authority. The closest water main to the site is located along the north side of Main Road (16 inch main). The Laurel Lake Well Field & Pump Station is located on the south side of Sound Avenue approximately 150 west of Cox Neck Road, approximately 500 feet west of the project site. It is estimated that the proposed project will utilize approximately 434 gallons of water per day. Sanitary disposal will be managed by on-site underground sewage leaching systems. In 1978, the Long Island Regional Planning Board published the Long Island Comprehensive Waste Treatment Management Plan (208 Study). The 208 Study identified eight (8) hydrogeologic zones in Nassau and Suffolk Counties. These zones were distinguished based upon differences in underlying groundwater flow patterns and water quality. The subject site is located within SCDHS Groundwater Management Zone IV, which according to Article VI of the Suffolk County Sanitary Code, has an allowable flow of 600 gallons per day (gpd) per acre in areas served by public water. Therefore, the allowable nitrogen beating flow for the overall 1.786 acres site is 1,072 gpd. The sanitary design flow is computed using the SCDHS manual Standards for Approval of Plans and Construction for Sewage Disposal Systems for Other Than Single Family Residences. The manual establishes the design flow as follows: 0.03 gpd/SF/Day 434 gpd Page 4 CVS Pharmacy @ Mattituck EAF Part I Review NP&V #04145 Therefore, the proposed applications would conform with Article VI of the Suffolk County Sanitary Code and would not be expected to adversely affect groundwater quality provided properly functioning systems are designed and installed. SUMMARY In conclusion, the proposed application would conform to the commercial character of the Main Road corridor in the area of the site. The project is not anticipated to have a significant impact on soils, topography and water usage and the site does not exhibit significant environmental constraints or contain resources of concern. In fact, the site is currently developed and existing non-conforming buildings will be removed to improve the degree of conformity. The site is expected to slightly increase trips entering and exiting the site as compared to existing conditions; however, the Traffic Impact Study finds that roads can accommodate vehicle trips. The elimination of the access to and from Route 25 is an improvement to road circulation and designs and may provide an opportunity to review the road alignment at the Sigsbee Lane/Factory Avenue/Route 25 intersection. In addition, the number of driveways to Marlene Lane should be addressed by the applicant and reviewed by the Planning Board once the road system and circulation issues are addressed to the satisfaction of the Planning Board. The grounds will have a 30 foot waterfall and small man-made lakes, emphasizing circular patterns and Japanese landscaping but with local plantings. It was subsequently RESOLVED by Howard Meinke and seconded by Herbert Adler to APPROVE the project CONCEPTUALLY, subject to detailed submissions, and to strongly RI:COMMEND that the Planning Board "land bank" as much of the parking as possible. The project should be designed in context of adjoining areas to maintain unfragmented, contiguous open space to maximize the benefit of these areas both ecologically and in terms of watershed protection. 4. Limiting fertilizer dependent vegetation to minimize turf areas. 5. Using native plants for landscaping purposes that require less water and are more drought tolerant. 6. Preserving existing native vegetation to the maximum extent practical keeping in mind realistic accessory uses that will likely occur (ie; sheds, pools). A conservation easement should be placed on the preserved area so it is not disturbed for accessory uses. 7. Using natural stormwater management practices (grass swales, filter strips, created wetlands, etc), where possible. 8. Only installing ornamental water features that recycle water. Signs should indicate that water is recycled. These water features should not be operated during a drought. 9. Using porous pavements, and/or minimizing road widths to the extent practical, while still allowing adequate emergency access. 10. (b) Gasoline shall at no time be dispensed without the direct supervision of the qualified attendant. A control shall be provided which will shut offthe flow of gasoline to the dispensing equipment at the self-service pump island whenever the qualified attendant is absent from the control console for any reason whatever, including when he is operating the dispensing equipment on the other pump islands. (c) The console regulating the flow of gasoline to the remote dispensing equipment thereafter operated by the customer at the self-service pump island shall be situated in such a manner as to give the qualified attendant controlling said console an m~obstructed view of the operation of said remote dispensing equipment. (d) The self-service pump island shall have controls on all pumps that will permit said pumps to operate only when a dispensing nozzle is removed from its bracket on the ptnnp and the switch for this pump is manually operated. (e) The self-service pump island shall be protected by an automatic fire-protection system in the form of an approved system of dry powder release which will act as an automatic fire extinguisher. (f') No customer shall be permitted to dispense gasoline unless he shall possess a valid motor vehicle operator's license. (g) There shall be no latch-open device on any self-service dispensing nozzle. (14) Private transportation service, including garage and maintenance facilities. (15) One-family detached dwellings, not to exceed one (1) dwelling on each lot. [Added 7-13-1993 by L,L. No. 11-1993] (16) [Added 5-16-1994 by L.L. No. 9-1994] Formula food restaurants loc ated within a shopping center in this zone, subject to the following requirements: (a) There must be sufficient parking as provided for by the Article XIX, Parking and Loading Areas, of this chapter, and such parking area shall be available within the shopping center site to accommodate the use. (b) The operation of the establishment shall not create traffic problems. 4 Town of Southold PC/Codebook for Windows (c) There shall be no counter serving outdoor traffic via a drive-in, drive-through, drive-up, drive-by or a walkup window or door. (d) Exterior signage shall conform in all respects to Article XX, Signs, of this chapter and, further, may not be lit from within. (e) Advertisements, including trademark logos, may not be affixed, painted or glued onto the windows of the business or onto any exterior structure, including waste disposal receptacles and flags. (f) The signage must conform to the existing color theme and signage style of the shopping center. (g) The existing exterior architectural style of the shopping center building may not be altered or modified in any way to accommodate the proposed use. (h) The use must be located within the shopping center's main primary building complex and may not be located within a single freestanding structure within the shopping center site. (17) Flea markets. [Added 1047-1995 by L.L. No. 21-1995] C. [Amended 5-9-1989 by L.L. No. 6-1989] Accessory uses. The following uses are permitted as accessory uses and, except for residential accessory uses and signs, which are governed by Article XX, are subject to site plan review: (1) Accessory uses set forth in and as regulated by § 100-31C(1) through (8) and (10) of the Agricultural-Conservation District, subject to the conditions set forth in § 100-33 thereof. No. 26-1994] (2)EN(3)Open storage of materials or equipment, provided that such storage shall be at least twenty-five (25) feet from any lot line, not be more than six (6) feet high and be suitably screened by a solid fence or other suitable means of at least six (6) feet in height. § 100-102. Bulk, area and parking requirements. No building or premises shall be used and no building or part thereof shall be erected or altered in the B District unless the same conforms to the Bulk Schedule and Parking and Loading Schedules incorporated into this chapter by reference, with the same force and effect as if such regulations were set forth herein in full. Structures shall be set back at least one hundred (100) feet from the right-of-way. B. There shall be an exception to Subsection A if the adjacent parcels are developed, in which case the minimum front yard setback shall be the average of the setbacks of the adjacent parcels. C. A project shall be divided into separate structures so that no single structure shall have more than sixty (60) linear feet of frontage on one (1) street. The purpose of the Low-Density Residential R-40 District is to provide areas for residential development where existing neighborhood characteristics, water supply and environmental conditions permit full development densities of approximately one (1) dwelling per acre and where open space and agricultural preservation are not predominate objectives. § 100-30A.2. Use regulations. In an R-40 District, no building or premises shall be used and no building or part of a building shall be erected or altered which is arranged, intended or designed to be used, in whole or in part, for any uses except the following: A. Permitted uses: (1) Sameas§ 100-31AoftheAgricultural-ConservationDistrict, except that wineries are excluded. [Amended 11-29-1994 by L.L. No. 26-1994] B. Uses permitted by special exception of the Board of Appeals.
