The Boat storage racks are temporary. The Restaurant and Marina have common parking areas. The Marina has limited hours in the winter with primarily the management staff marming the office. The parking area along the existing Boat Storage building has been designated for the restaurant parking. There are 18 marked spaces and 2 handicap spaces designated for the restaurant. In addition there is additional black top for overflow parking. The parking needs of the restaurant throughout the winter are significantly reduced, this can be confirmed by the Manager of the restaurant, Ettore (298-5851). I will provide a letter upon your request. Since the parking requirements off-season are adequately provided, the temporary boat racks have been located in the summer restaurant parking area. Currently, the ZBA considers this type of rack a structure,but has not been asked to grant variances to allow them. Perhaps this matter should be clarified at the Code Committee. Per Mr. Krazner's suggestion I applied first to the Town Trustees, as the lead agent and obtained a permit which is attached. The racks will be assembled at the west side of the storage building, three bays on the right side and seven bays on the left side as the attached plan shows. The dimensions on each bay is twelve feet wide, twelve feet high and twenty five feet deep. The overall height is 25'. Attached are copies of the tmstee's approval and the plan. It calls for certain easements to be filed in order for the zoning to become effective. As you know, the Planning Board will be reviewing the site plan aspects of the marina. The scenic easement will also be a part of their review. In order to minimize your work on the easements, I have asked the Planning Board to list the provisions they will be requiring for the scenic easement. You can, therefore, prepare one easement which will satisfy the needs of both boards, rather than executing multiple documents. I suggest that the scenic easement include the following covenants: The easement shall provide that the entire easement area shall remain in its natural state. No trees or shrubs shall be destroyed, cut, or removed from the area, except as required for reasons of irrigation, water and draining control, or sanitation or disease control. The easement area shall not be filled with soil, sand, brush or other debris. The easement area may be traversed by a walkway, whether elevated or on the ground, provided permits can be obtained from the applicable agencies, which may include the Southold Town Board of Trustees, and the New York State Department of Environmental Conservation. Any disturbance to the land within the easement shall be redressed by the restoration of said land to its prior state within sixty (60) days of the disturbance or of the date the disturbance was reported to either the Planning Board of the Bay Constable.
